(0) 03-3��� AN ORDINANCE AMENDING THE TOWN OF ORO VALLEY ZONING MAP BY REZONING THE PROPERTYLOCATED SOUTH OF M04RE ROAD ON THE WEST SIDE OF LA CANADA DRIVE EXTENDED FROM R1-144 (SINGLE-FAMILY RESIDENTIAL WITH 144,000 S.F. LOT MINIMUM TO � ORO VALLEY R1-20 (SINGLE-FAMILY RESIDENTIAL WITH 2O,000 S.F. LOT MINIMUM) AND R1-36 (SINGLE FAMILY WITH 36,000 S.F. LOT MINIMUM) AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH WHEREAS, that certain real property located south of Moore Road on the west side of La Canada Drive extended and further described by Assessor Parcels 219-49-0040 and 219-510=01 A and the map attached to and made part of this Ordinance, is currently zoned R1-144 in the Town of Oro Valley; and � WHEREAS, an application requesting that the property be rezoned to R1-20 and R1-36 has been filed with the Town; and WHEREAS, the Planning and Zoning Commission, having considered said application and request at a duly noticed public hearing in accordance with State Statute, and having made its recommendation to the Town Council; and WHEREAS, the Oro Valley Town Council has considered the requested rezoning at a duly noticed public hearing and finds it is consistent with the Town's General Plan and Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND TOV�►TN COUNCIL OF THE TOV�►�N OF ORO VALLEY: SECTION 1: That certain real property located south of Moore Road on the west side of La Canada Drive extended and further described as Assessor's Parce1219-49-0040 and by the map attached to and made a part of this Ordinance is hereby rezoned to R1-20 (Single Family Residential) and R1-36 (Single Family Residential) subj ect to those conditions, stipulations,plan for development and all other conditions of approval as speci�ed in Exhibit A attached hereto. SECTION 2: That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 3: That this ordinance and the various parts thereof are hereby declared to be severable. If any section, sub-section, sentence, clause, word or phrase of this ordinance is, for any reason, held to be unconstitutional, such holdings shall not affect the validity of the remaining portion of this ordinance. All Standard Conditions for Non-PA.D Rezonings must be adhered to (attached). 2. Permanent,wildlife-friendly fences shall be installed along the fifteen(15') foot riparian apron, except where wash access is provided in common areas. 3. The developer and/or owner of record shall pay in lieu fees for bicycle and sidewalk improvements along La Canada Drive prior to the issuance of a grading permit. 4. The developer and/or owner of record shall dedicate to the Town of Oro Valley a�fteen (15') foot public non-motorized recreation easement in the wash. 5. Page 4, I-C Hydrology,the summary of watershed table is inconsistent with maps I-C.1 and I- C.4. The information from the summary table, and maps I-C.1 and I-C.4 shall be consistent. 6. The right-of-way of La Canada Drive shall be provided immediately to the Town. 7. The connection to Sunkist shall be paved at the time of development. 8. All dwelling units in the subdivision shall be limited to single story and eighteen(18') feet. Conditions 2 and 8 shall be notes on the Tentative Development Plan and Preliminary Plat. � (0)03-38 P.4 ORO V�I.LEY PLAN1vING AND ZONING DEPARTMENT STANDARD CONDITIONS FOR NON-P.A.D.REZONINGS Completion of the following requirements for a rezoning ordinance withi.n.the time frame specified herein from the date of approval by the Town Council: � 1. Submittal of a complete hydraulic and hydrologic drainage report. . 2. Approval of a development plan andlor recordation of a final plat as determined necessary by the appropriate Town Departments. 3. A suitable arrangement with Pima County Health Department or Pima County Wastewater Management for . sewage dlsposal. 4. Recording a covenant holding the Town of Oro Valley harmless in the event of flooding. 5. Provisions of development-related assurances as required by the appropriate Town Depar�ments. � 6. , Recording a covenant to remove only that vegetation that is necessary for building pads and accessory uses and the necessary roads and driveways and to salvage all healthy Palo Verde,Mesquite,Ironwood, Saguaros, and Barrel Cacti for on-site landscaping purposes. � 7. Recording any other development-related covenants as determined necessary by the appropriate Town Departments. 8. Roads shall be constructed in conformance with the Town of Oro Valley standards. 9. Landscaping to consist of low water use and low pollen-producing vegetation. 10. Adherence to the Tentative Development Plan approved by the Oro Valley Town Council. � 11. Significant change to the Tentative Development Plan or conditions of rezonin , as defined b Section 3- g Y 104(B), shall require re-review by the Planning Commission and Town Council in accordance with Cha ter 3 p of the Oro Valley Zoning�Code Revised. 12. The relocation ancUor extension of utilities pursuant to the development or redevelopment of the sub'ect arcel J p will be at no cost to the Town of Oro Valley. 13. Dedication of public rights-of-way through plat recordation in accordance with current Town ordinances. 14. Submittal of a traffic impact analysis in accordance with Section 9-110(��,unless modified by the Town Engineer and Zoning Administrator. � 16. Completion of the requirements for a zoning ordinance within two (2).years from the date of approval by the Town Council.
