Property - Acceptance of Streets - 904 A 06 Exchanging a Portion of the Right of Way on Avenida Vallejo for New Public Right of Way and
RESOLUTION NO. (R) O6- A R RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, EXCHANGING A PORTION OF THE RIGHT-OF- WAY ON AVENIDA VALLEJO FOR NEW PUBLIC RIGHT-OF-WAY AND GRADING EASEMENTS. WHEREAS, the Town of Oro Valley is a political subdivision of the State of Arizona, andp ursuant to Article 13, Section 7 of the Arizona Constitution, is vested with all rights, privileges, benefits and is entitled to the immunities and exemptions granted municipalities and political subdivisions p under the Constitution and laws of the State of Arizona and the United States; and WHEREAS, the Town of Oro Valley has the authority to exchangepublic roadways or portions of roadways for new public roadway Y pursuant to ARS 28-7203; and WHEREAS, portions of the Avienda Vallejo right-of-way have beenreviousl dedicated to the Town by process of annexation from Pima p Y County; and WHEREAS, the right-of-way to be exchanged is not needed for public use; and WHEREAS, no land adjoining said right-of-way would be left without access to a public street; and WHEREAS, the new right-of-way is necessary to meet Town standards for local subdivision streets; NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Town of Oro Valley, Arizona: 1. To approve the vacation of a portion of the Avienda Vallejo right- of-way as described in Attachment 1, to the adjacent property owner; 2. To accept dedication of the new right-of-way as described in Attachment 2, contingent upon the establishment of clean title; 3. To accept the granting of the grading easements necessary to maintain the new right-of way as described in Attachment 3; 4. To authorize the Mayor and Town Administrative staff to take such steps necessary as to implement the exchange of the roadways described herein.
