A RESOLUTION OF THE MAYOR AND COUNCIL OF THE
TOWN OF ORO VALLEY, ARIZONA, ACCEPTING THOSE
STREETS WITIN THE VERDE CATALINA TOWN HOUSES
I AS PUBLIC STREETS LOCATED OFF OF CATALINA
SHADOWS BLVD APPROXIMATELY ONE THIRD MILE
NORTH OF MAGEE ROAD ON THE EAST SIDE OF
ORACLE ROAD
WHEREAS, the Town of Oro Valley is a political subdivision of the State of
Arizona vested with all associated rights, privileges and benefits and is entitled to
the immunities and exemptions granted municipalities and political subdivisions
under the Constitution and laws of the State of Arizona and the United States; and
WHEREAS, the Town Council of the Town of Oro Valley recognizes that the
Verde Catalina Town Houses I Homeowners Association desire to dedicate to the
Town, and will request formal acceptance for maintenance, those streets within
Verde Catalina Town Houses I as public streets: and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of
the Town of Oro Valley,Arizona, approves the acceptance of the following streets:
Mesquite Shadows Drive, Verde Catalina Drive, Cholla Shadows Drive and
Mountain Morning Drive; provided that following items are presented to and
approved by the Town Engineer and Town Attorney:
1. Specific dedication or conveyance (which may include road maintenance easements
where appropriate) of all parts of those streets by the party or parties holding title
2. Title insurance and warranty deeds from the respective owners
3. An accurate right-of-way map of all private streets to be dedicated as determined by
the Town Engineer.
4. A title report for all parcels to be dedicated
5. Consent to the transfer of ownership from utility companies that may have easements
or other interest in the areas to be conveyed to the Town.
6. The history of the types of maintenance that has been performed on the private streets
in the past.

A request that the Town verify the conditions which vacated a street, alley or easement
shall not be subject to the requirements for vacating of easements and public rights-of-way.
The Town Manager shall review the verification request and confirm the prior status, as
reflected by Town records.
7-7-5 NOTICE OF HEARING
Upon receipt of a complete application for vacating as described in Section 7-7-3, the
Town Clerk shall cause to be published and posted a notice of a hearing upon said
application before the Town Council. Notice of a public hearing shall be given not less than
five days prior to the hearing by publication of the notice at least once in the official
newspaper used for legal publications by the Town. Also, the notice of public hearing shall
be given to all adjacent property owners by first class mail. In addition, notice of the public
hearing shall be posted a minimum of thirty (30) days prior to the public on the affected
property in at least three (3) locations, one at each end and one centrally located on the
public easement and/or public right-of-way. The posted notice shall be printed so that the
following are visible from a distance of 100 feet:
"Public Hearing, Request for Vacating." All of the above-described notices shall
contain the nature of the request, a legal description of the property to be vacated,
the time and place of hearing and a statement that anyone wishing to protest the
proposed vacating may do so at the hearing in person or by writing. Upon passage •
of a resolution of vacating the easement and/or public right-of-way, such vacating
shall become final and the Town Clerk shall be authorized to provide any party with
a copy of the resolution.
7-7-6 TIME LIMITS
The vacating shall be effective upon approval by the Town Council, however, if
additional requirements or conditions have been placed upon the approval, the vacating
shall not be effective until the conditions or requirements has been satisfied. The applicant
shall have sixty (60) days from the time of the Council hearing to complete the additional
requirements for conditions placed upon the approval period. By action of the Council, one
time extension of not more than sixty (60) days may be granted as long as a formal written
request has been submitted to the Council before the expiration date. If the conditions
imposed by the Town Council are not met, or the time limit has expired, the approval will
automatically become null and void.

ACCEPTANCE OF EXISTING PRIVATE STREETS, SIDEWALKS, TRAILS, DRAINAGE
AND UTILITY EASEMENT AS PUBLIC DOMAIN

An existing private street, sidewalk, trail, drainageway, utility and other easement shall
not be accepted for designation under public domain until the Town Council has formally
accepted by a public vote, the private streets, sidewalks, trails, etc. The satisfaction of the
procedures and conditions set forth herein does not guarantee or obligate acceptance by
the Town.

A. Whenever areas must be platted or re-platted in order to dedicate street rights-of-
way, sidewalk, drainage and utility easements and other easements, the platting or re-
platting shall conform to current Town Standards at the time of the request for acceptance
B. Where easement, liens, other property rights, rights to any person, utility or
corporation have been previously dedicated, granted or otherwise conveyed, within the
proposed rights-of-way, a release must be obtained from each person, utility or corporation
agreeing to the change in ownership. A comprehensive title report showing all property
interests in the property sought to be considered for acceptance shall be furnished to the
Town at the time of the application.
C. A marketable title subject only to necessary public utility easements, must be deeded
to the Town. Proof that no liens or taxes are due on the property to be deeded must be
provided to the Town. Further, a warranty deed subject only to necessary public utility
easements shall be provided. Upon acceptance by the Town, a title insurance policy shall
be furnished by the applicant showing the title is vested in the Town, subject only to
necessary public utility easements.
D. An environmental audit shall be prepared by a qualified environmental professional
certifying that no known or potential environmental hazards exist with respect to the
properties being considered for acceptance as public domain. This audit shall be submitted
prior to consideration by the Town Council of the request for acceptance.
E. Only those streets, drainageways and rights-of-way for which an environmental audit
certifies there are no known or potential environmental hazards on any of the property to
be deeded or dedicated to the public may be considered for acceptance for maintenance
by the Town; and
F.
When appropriate, the Town Engineer may require a map and plat showing proposed
right-of-way widths, building setbacks, sidewalk locations, easement widths and locations,
curve data and other pertinent geometric details. This map or plat must be drawn to a scale
of 1" - 50' (pr 1" =100' of receiving prior written approval form the Town Engineer) by
licensed professional engineer or land surveyor. A complete legal description of the area
being proposed for acceptance must also be submitted with the map or plat.
G. An hydrology report must be submitted showing all drainageways, drainage
structures and 100 year storm (Q 100) flows on, crossing and/or impacting the private
streets, sidewalks, trails, easements, etc. This hydrology report must include maps
showing the source of the water, how the water flows over, and crosses, the property
described for Town acceptance and how the waters flow into the major drainageways
(such as Big Wash, CaOada del oro, etc).
H. The existing street construction details must be certified by a professional civil
engineer licensed and registered in the State of Arizona. This certification must be
accompanied by surveys, sketches, existing cross-sections and test borings for all streets
giving the pavement material and drainage data including storm drainage analysis or
current conditions. The design shall be one that met all reasonable engineering standards
at the time of construction. The applicant shall furnish documents certified by a registered
professional engineer stating that engineering design and construction standards, at the
time of construction, were met. Further, in the event that streets were redesigned and/or
reconstructed, the engineer shall certify that such redesign and/or reconstruction complied
with Engineering Design and Construction Standards at the time of re-engineering or
reconstruction.
I. The date of the construction of the street, trail, easement, etc. was completed and a
history of maintenance including types of maintenance treatment and dates must be
furnished.
J. After review of the submitted data by the Town Engineering and Planning and Zoning
staffs, the Town Council shall hold a public hearing to consider acceptance, with notice of
such hearing being published in one issue of the official newspaper used by the Town for

publishing of legal advertisements, in accordance with the Town's publication
requirements for non-zoning matters, not less than 15 full calendar days prior to the date of
such hearing.
K. The above requirements may be reduced or waived by the Town Council. The
request for waiver or reduction shall be in writing and shall specify the reasons for the
request. This request for waiver may be submitted prior to, or in conjunction with, the
application. The request for waiver will be acted upon at a regularly scheduled Council
meeting at which time the applicant, or the applicant's representative, shall be present to
respond to any Council inquiries.
L. The Town Council, after the public hearing, may render a decision as to whether it
will accept, or not accept, the street, trail, easement, etc. Such decision shall be at the
Town Council's sole discretion. Formal approval of the Town Council shall be required to
accept any street, trail, easement, etc.
Article 7-9
ACCEPTANCE OF DEEDED OR DEDICATED STREETS, DRAINAGEWAYS AND
RIGHTS-OF-WAY

A. In accordance with the most recently adopted edition of the Town of Oro Valley
Subdivision Street Standards and Policies and/or sound engineering practices, the Town
Engineer shall accept for full maintenance by the Town such streets, drainage-ways and
rights-of-way intended to be deeded to the public whether depicted on a recorded final plat
or on an approved development plan.
B. The final recorded plats and development plans pertaining to such streets, drainage-
ways and rights-of-way must have been reviewed and approved by all appropriate
agencies of the Town. The approved streets, drainage-ways and rights-of-way shall
become property of the Town at the time of recordation.
C. The final recorded plats and development plans pertaining to such streets,

D. Improvement plans and construction details must be certified by a professional civil
engineer licensed and registered in the State of Arizona. This certification must be

E. All street name signs, traffic control/pedestrian control signs and their appurtenant
supports must conform to the Town of Oro Valley specifications or, in the case of no
specifications, those of Pima County or the State of Arizona or Federal Government. In the
case of such signs and posts having been installed prior to the passage of this ordinance,
the Town of Oro Valley disclaims all responsibility to maintain any special signs and/or
posts which are not in conformance to the appropriate specifications, the responsibility
being that of the developers, their successors and/or assigns. The Town may at any time
install or replace such signs and posts with standard specification signs and posts which
shall thenceforth remain under Town control.
F. Prior to the release of subdivision assurances, the developer shall post a cash
assurance or other assurance acceptable to the Town Engineer in an amount determined
by the Town Engineer, to ensure that construction defects are repaired and an acceptable
surface treatment is performed upon cessation of new home construction within the

The Town of Oro Wiley appreciates the opportunity you have provided for Li5 tc
share with you the types of municipal services you would receive when you join
the Town of Oro Valley. We have shared with you the numerous opportunities
that exist in Oro Valley which would maintain and enhance your quality of life.
In order for you to make a decision on annexation, I am providing you this letter
in order to detail the Town's position regarding residential (private) streets and
sound watts.
Streets:
As we discussed at our March 13th meeting, as long as the Town can be
presented "clear and marketable title" to Verde Catalina I & II private streets,
the Town will take over the maintenance responsibility for these streets following
annexation, Any costs t.o create this "dear and marketbie title" would be borne
by the Verde Catalina HOA.
Sound Walls:
Also at our March 13th meeting, an inquiry was made about the possibility of
sounds walls being instzlied to reduce the sound from Oracle Road. In
recognition of the noise concerns of the residents of Verde Catalina I & II the
TQvtin will commit, within an 18 month vend of the effective date of
annexation to the construction of a 4.2}10_,I sound wail up_on
pyalid_mrnit from the Arizoriant of Tranvprtation ".
The sound wall will be cons'quaed within the Oracle Road right of way on the
west side of the Verde Catalina I & 1J subdivision. Additionall‘4 it would be the
Town's desire to involve representatives of your association in the ultrnate
design of the 6' high sound wail during this process.

RESOLUTION NO. (R) 08-23
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE
TOWN OF ORO VALLEY, ARIZONA, AUTHORIZING AND
APPROVING THE PARKS AND RECREATION DEPARTMENT
OF THE TOWN OF ORO VALLEY TO APPLY FOR A LOCAL,
REGIONAL AND STATE PARK (LRSP) HERITAGE FUND
GRANT IN THE AMOUNT OF $27,660.00 FOR CONSTRUCTION
OF A DOG PARK IN THE CANADA DEL ORO RIVERFRONT
PARK AND FOR THE TOWN TO SHARE IN SUCH COST
WHEREAS, the Town of Oro Valley is a political subdivision of the State of Arizona
vested with all associated rights, privileges and benefits and is entitled to the immunities
and exemptions granted municipalities and political subdivision under the Constitution
and laws of the State of Arizona and the United States; and
WHEREAS, A.R.S. §41-503 authorized the establishment of the Local, Regional and
State Parks (LRSP) Heritage Fund program, which provides funds to the State of
Arizona, its political subdivisions and Indian Tribes for acquiring lands and developing
non-motorized trails and facilities for public use; and
WHEREAS, Arizona State Parks Board ("Board") is responsible for administering the
LRSP Heritage Fund program in Arizona, setting up necessary rules and procedures
governing application by local agencies under the program; and
WHEREAS, adopted procedures established by the Board to receive a grant require the
applicant to certify the approval of the application, signature authorization, the
availability of local matching funds (if applicable), and authorization to sign a Participant
Agreement with the Board prior to submission of said applications to the Board; and
WHEREAS, the Town desires to construct a dog park at the Canada del Oro Riverfront
Park; and
WHEREAS, the Town wishes to file an application for fiscal year 2008 LRSP Heritage
Fundp gro ram to obtain a grant which will help defray the cost of construction of the dog
park, which Summary of Grant Application is attached hereto as Exhibit "A"; and
WHEREAS, the total cost of the dog park for Canada Del Oro Riverfront Park is
estimated at $55,320; and
WHEREAS, if the Grant is approved, the Town shall receive $27,660 from the LRSP
Heritage Fund for construction of the dog park; and
WHEREAS, if the Grant is approved, the Town's share for construction of the dog park
is estimated to be $27,660; and

WHEREAS, the Town shall be responsible for any cost over the estimated $55,320 for
the dog run; and
WHEREAS, it is in the best interest of the Town of Oro Valley to file an application for
fiscaly ear 2008 LRSP Heritage Fund Grant to share in the cost of constructing a dog
park at the Canada del Oro Riverfront Park.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWN
COUNCIL OF THE TOWN OF ORO VALLEY to:
1. Approve the filing of an application for FY 2008 LRSP Heritage Fund
Grant.
2. Certify that the application is consistent and compatible with all adopted
plans and programs of the Oro Valley Town Council for non-motorized
trails and facility development.
3. Agree to comply with all appropriate procedures, guidelines, and
requirements established by the Arizona State Parks Board as a part of the
application process; and
4. Certify that the Town of Oro Valley will comply with all appropriate state
and federal regulations, policies, guidelines, and requirements as they
relate to the application.
5. Certify that the Town of Oro Valley has matching funds in the amount of
$27,660 from the following source: Recreation In-Lieu Fees.
6. Appoint the Multimodal Coordinator, Nancy Ellis as agent of the Town to
conduct all negotiations, execute and submit all documents including, but
not limited to, applications, agreements, amendments, billing statements,
and so on which may be necessary for the completion of the
aforementioned project.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the Mayor and the Council
of the Town of Oro Valley, Arizona, that:
1. The Town of Oro Valley authorizes and approves the Parks and
Recreation Director to apply for fiscal year 2008 LRSP Heritage Fund
Grant to help construct a dog park at the Canada del Oro Riverfront Park.
2. If the Grant is approved, the Town of Oro Valley commits to providing the
additional funding necessary to complete construction of a dog park at the
Canada del Oro Riverfront Park.

Summary of Grant Application for LRSP—Heritage Funding for dog park at CDO
Riverfront Park
The LRSP — Heritage Fund grant, if awarded, will establish a much-needed dog park facility at
the Town of Oro Valley's Canada del Oro (CDO) Riverfront Park, one of the Town's two active
recreation parks. Currently, the Town has one dog park, located within the boundaries of James
D. Kriegh Park, which is heavily used. At CDO Riverfront Park, dog owners are currently using
ballfields and other areas in which to exercise their dogs, creating conflicts among users. The
Town will establish this .25 acre dog park with chain link fencing, user gates, lights, grass, shade
structures, benches, water fountains, and access for the disabled to meet the needs of dog owners
within the Town.
The grant request for the LRSP—Heritage Fund application was in the amount of$55,320,which
will cover all amenities in the dog park. Since the grant program is a 50% match, the Town will
be responsible for contributing $27,660 of this amount, to come from Recreation In-Lieu Fees
from subdivision development. The grant funding is scheduled to be awarded in late 2008.
