RESOLUTION NO. (R) 08 19 - A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, ACCEPTING THOSE STREETS WITHIN THE VERDE CATALINA TOWN HOUSES II, LOCATED OFF OF MOUNTAIN VISTA DRIVE APPROXIMATELY ONE QUARTER MILE NORTH OF MAGEE ROAD ON THE EAST SIDE OF ORACLE ROAD, AS PUBLIC STREETS WHEREAS, the Town of Oro Valleyis political subdivision of the State of a Arizona vested with all associated rights, privileges and benefits and is entitled to the immunities and exemptions granted municipalities and political subdivisions under the Constitution and laws of the State of Arizona and the United States; and WHEREAS, the Town Council of the Town of Oro Valley recognizes that the Verde Catalina Town Houses II Homeowners Association desires to dedicate to the Town, and requestedacceptance has formal for maintenance, those streets within Verde Catalina Town Houses II as public streets: and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the Town of Oro Valley, Arizona, as follows: Section 1. That the Town of Oro Valley accepts the following streets within the Verde Catalina Town Houses II subdivision for maintenance: Mediterranean Drive, Gibraltar Drive, Madrid Drive and an un-named alley. The acceptanceof the foregoing streets for maintenance is conditioned upon receipt g by the Town of Oro Valleyof all of the following items and acceptance thereof by the Town Engineer and Town Attorney: 1. p Specific dedication or conveyance (which may include road maintenance easements where appropriate)ro rof all parts of those streets as actually constructed within the subdivision by the party or parties holding title thereto; 2. Title insurance and recordable warranty deeds or easements from the respective owners of any property where the streets are constructed; 3. An accurate right-of-way map of all streets to be dedicated; 4. A title report for all parcels to be dedicated; 5. Consent to the transfer of ownership from any utility companies that may have easements or other interests in the areas to be conveyed to the Town; 6. A statement from the homeowner's association of the history and the types of maintenance that have been performed on the private streets in the past. The Town Manager shall review the verification request and confirm the prior status, as reflected by Town records. 7-7-5 NOTICE OF HEARING Upon receipt of a complete application for vacating as described in Section 7-7-3, the Town Clerk shall cause to be published and posted a notice of a hearing upon said application before the Town Council. Notice of a public hearing shall be given not less than five days prior to the hearing by publication of the notice at least once in the official newspaper used for legal publications by the Town. Also, the notice of public hearing shall be given to all adjacent property owners by first class mail. In addition, notice of the public hearing shall be posted a minimum of thirty (30) days prior to the public on the affected property in at least three (3) locations, one at each end and one centrally located on the public easement and/or public right-of-way. The posted notice shall be printed so that the following are visible from a distance of 100 feet: "Public Hearing, Request for Vacating." All of the above-described notices shall contain the nature of the request, a legal description of the property to be vacated, the time and place of hearing and a statement that anyone wishing to protest the proposed vacating may do so at the hearing in person or by writing. Upon passage of a resolution of vacating the easement and/or public right-of-way, such vacating shall become final and the Town Clerk shall be authorized to provide any party with a copy of the resolution. 7-7-6 TIME LIMITS The vacating shall be effective upon approval by the Town Council, however, if additional requirements or conditions have been placed upon the approval, the vacating shall not be effective until the conditions or requirements has been satisfied. The applicant shall have sixty (60) days from the time of the Council hearing to complete the additional requirements for conditions placed upon the approval period. By action of the Council, one time extension of not more than sixty (60) days may be granted as long as a formal written request has been submitted to the Council before the expiration date. If the conditions imposed by the Town Council are not met, or the time limit has expired, the approval will automatically become null and void. A. Whenever areas must be platted or re-platted in order to dedicate street rights-of- way, sidewalk, drainage and utility easements and other easements, the platting or re- platting shall conform to current Town Standards at the time of the request for acceptance B. Where easement, liens, other property rights, rights to any person, utility or corporation have been previously dedicated, granted or otherwise conveyed, within the proposed rights-of-way, a release must be obtained from each person, utility or corporation agreeing to the change in ownership. A comprehensive title report showing all property interests in the property sought to be considered for acceptance shall be furnished to the Town at the time of the application. C. A marketable title subject only to necessary public utility easements, must be deeded to the Town. Proof that no liens or taxes are due on the property to be deeded must be provided to the Town. Further, a warranty deed subject only to necessary public utility easements shall be provided. Upon acceptance by the Town, a title insurance policy shall be furnished by the applicant showing the title is vested in the Town, subject only to necessary public utility easements. D. An environmental audit shall be prepared by a qualified environmental professional certifying that no known or potential environmental hazards exist with respect to the properties being considered for acceptance as public domain. This audit shall be submitted prior to consideration by the Town Council of the request for acceptance. E. Only those streets, drainageways and rights-of-way for which an environmental audit certifies there are no known or potential environmental hazards on any of the property to be deeded or dedicated to the public may be considered for acceptance for maintenance by the Town; and F. When appropriate, the Town Engineer may require a map and plat showing proposed right-of-way widths, building setbacks, sidewalk locations, easement widths and locations, curve data and other pertinent geometric details. This map or plat must be drawn to a scale of 1" - 50' (pr 1" =100' of receiving prior written approval form the Town Engineer) by licensed professional engineer or land surveyor. A complete legal description of the area being proposed for acceptance must also be submitted with the map or plat. G. An hydrology report must be submitted showing all drainageways, drainage structures and 100 year storm (Q 100) flows on, crossing and/or impacting the private streets, sidewalks, trails, easements, etc. This hydrology report must include maps showing the source of the water, how the water flows over, and crosses, the property described for Town acceptance and how the waters flow into the major drainageways (such as Big Wash, Canada del oro, etc). H. The existing street construction details must be certified by a professional civil engineer licensed and registered in the State of Arizona. This certification must be accompanied by surveys, sketches, existing cross-sections and test borings for all streets giving the pavement material and drainage data including storm drainage analysis or current conditions. The design shall be one that met all reasonable engineering standards at the time of construction. The applicant shall furnish documents certified by a registered professional engineer stating that engineering design and construction standards, at the time of construction, were met. Further, in the event that streets were redesigned and/or reconstructed, the engineer shall certify that such redesign and/or reconstruction complied with Engineering Design and Construction Standards at the time of re-engineering or reconstruction. I. The date of the construction of the street, trail, easement, etc. was completed and a history of maintenance including types of maintenance treatment and dates must be furnished. J. K. The above requirements may be reduced or waived by the Town Council. The request for waiver or reduction shall be in writing and shall specify the reasons for the request. This request for waiver may be submitted prior to, or in conjunction with, the application. The request for waiver will be acted upon at a regularly scheduled Council meeting at which time the applicant, or the applicant's representative, shall be present to respond to any Council inquiries. L. The Town Council, after the public hearing, may render a decision as to whether it will accept, or not accept, the street, trail, easement, etc. Such decision shall be at the Town Council's sole discretion. Formal approval of the Town Council shall be required to accept any street, trail, easement, etc. Article 7-9 ACCEPTANCE OF DEEDED OR DEDICATED STREETS, DRAINAGEWAYS AND RIGHTS-OF-WAY Sections: 7-9-1 Acceptance of Deeded or Dedicated Streets, Drainageways and Rights-of-Way 7-9-1 Acceptance of Deeded or Dedicated Streets, Drainageways and Rights-of-Way A. In accordance with the most recently adopted edition of the Town of Oro Valley Subdivision Street Standards and Policies and/or sound engineering practices, the Town Engineer shall accept for full maintenance by the Town such streets, drainage-ways and rights-of-way intended to be deeded to the public whether depicted on a recorded final plat or on an approved development plan. B. The final recorded plats and development plans pertaining to such streets, drainage- ways and rights-of-way must have been reviewed and approved by all appropriate agencies of the Town. The approved streets, drainage-ways and rights-of-way shall become property of the Town at the time of recordation. C. The final recorded plats and development plans pertaining to such streets, drainageways and rights-of-way must have been reviewed and approved by all appropriate agencies of the Town. D. improvement plans and construction details must be certified by a professional civil engineer licensed and registered in the State of Arizona. This certification must be accompanied by surveys, sketches, existing cross-sections and test borings for all streets giving the pavement material and drainage data including storm drainage analysis. E. All street name signs, traffic control/pedestrian control signs and their appurtenant supports must conform to the Town of Oro Valley specifications or, in the case of no specifications, those of Pima County or the State of Arizona or Federal Government. In the case of such signs and posts having been installed prior to the passage of this ordinance, the Town of Oro Valley disclaims all responsibility to maintain any special signs and/or posts which are not in conformance to the appropriate specifications, the responsibility being that of the developers, their successors and/or assigns. The Town may at any time install or replace such signs and posts with standard specification signs and posts which shall thenceforth remain under Town control. F.
