Call to the Audience opened and closed with no speakers. IV. Approval of Minutes: May 21, 2009 Regarding Steam Pump Ranch, Mr. Nelson said that the contractor completed stabilization work per the judgment of the structural engineer. Total bill with additioral repairs to Lieber house was $1600. The contract for renovation of the pump house and Pusch house should be done by this time next year. HPC can review the contract prior to the July meeting and if any issues arise they can be followed up on. The budget is tight and each additional meeting with the consultant will cost more money. MOTION: Commissioner Nagy MOVED to approve the May 21, 2009, minutes as amended. Vice Chair Zwiener seconded the motion. Motion carried 5:0. V. Election of Commission Officers Commissioner Nagy nominated Dan Zwiener as Chair for HPC. There were no other nominations. MOTION: Commission Nagy MOVED that Vice Chair Zwiener be elected to Chair by acclamation. Commissioner Pullara seconded the motion. Motion carried 5:0. June 15, 2009 Draft Historic Preservation Commission Minutes Chair-elect Zwiener nominated Lois Nagy as Vice Chair for HPC. There were no other nominations. MOTION: Chair-elect Zwiener MOVED that Commissioner Nagy be elected to Vice Chair by acclamation. Commissioner Pullara seconded the motion. carried 5:0. VI. Items for discussion and possible action regarding staff report 9 9 p A. Status of Steam Pump Ranch designation and funding Council Member Latas reported on the status of Steam PumpRanch (SPR) designation and funding. The first step is going to the State Historic Sites Review Committee, who will hold a special session on June 30. Council Member Latas, Assistant Town Manager Jerene Watson, Assistant Planning and Zoning Director Paul Popelka, Chair - elect elect Zwiener, Chair Baughman and Consultant Drew Gorskyfrom Poster Frost will be attending that meeting, which will be a strong showing of support bythose involved in pp the project. After being listed on the National Register itoes to the Keeper in g p Washington, DC. This will keep it moving in the Congressional Interior Appropriations g Subcommittee to Save American's Treasures. Council Member Latas encouraged g d the HPC members to attend the Wednesday night Town Council budget meetingand thank Council for keeping money for building repairs. She stressed the importance of preserving SPR. Mr. Nelson added that consultant JeffreyBrooks earlyin '02-'03 prepared a recommendation that SPR be listed under the National Registry. Our current application is better. B. Commission vacancy and appointment Mr. Popelka reported that the only applicant that hada lied for the HPC pp vacancy was interviewed this morning, but no decision was reached. VII. Discussion and possible action regarding Steam Pump Ranch A. Proposed Well Site for Oro Valley Water Utility i. Review and action on project concept plan ii. Architectural input for wall design Chair-elect Zwiener and Vice Chair-elect Nagy were appointed byChair p Baughman to review the architectural input for the wall design. Mr. Nelson suggested approving the concept plan so the Water Utility can go forward. The concept plan approval should list a few conditions to worked out prior to actual drilling: 1. Final compensation, 2. Salvaging of the doors in the barn, both interior and exterior. 3. Future infrastructure credits. 2 June 15, 2009 Draft Historic Preservation Commission Minutes MOTION: Chair Baughman MOVED to approve the proposed well site plan for Steam Pump Ranch depending upon final agreement between the Town represented by Mr. Nelson and the Water Utility over final reimbursement, salvaging the outside and interior barn doors, and infrastructure credits. Commissioner McClung seconded the motion. Chair-elect Zwiener suggested a friendly amendment to the motion adding the following conditions: 1. The final plans be returned to the Historic Preservation Commission for approval. 2. The color and/or texture of the wall are consistent with historic structures on the site. 3. The "roofline" of the wall is modified to remove projections. 4. The faux windows are modified to be consistent with structures on the site, with a minimum of three per elevation. 5. There be a plan for removal of historic materials from the barn prior to its demolition. Chair Baughman and Commissioner McClung accepted the friendly amendment. Motion carried, with the friendly amendment, 5:0. VIII. Discussion and possible action regarding HPC Work Plan A. Cultural Resources Inventory Chair Baughman combined the discussion and possible action on Cultural Resources inventory with item IX, discussion and possible action regarding Environmentally Sensitive Land (ESL). Discussion followed regarding the definition of cultural resources. A handout was distributed that had the following potential wording: "A prehistoric and/or historic site or object which evidences activity of community interest." Discussion points: - "past" activity - scientific interest - ethnic significance - basic definition MOTION: Chair-elect Zwiener MOVED to define Cultural Resource as "A prehistoric and/or historic site or object which evidences past activity of scientific or community interest." Commissioner Pullara seconded the motion. Motion carried 5:0. The Commission went on to produce definitions for the following: archaeological site, architectural site, community site and historic site. 3 June 15, 2009 Draft Historic Preservation Commission Minutes Discussion points: JAVLI - use of dictionary definition - location instead of site - mitigation - ESL ordinance - Arroyo Grande (AG) - jurisdiction and authority Mr. Popelka said any Oro Valley ordinance does not apply today,AG toda , but we are planning the ESL ordinance not only for existing Town limits, but for any annexed areas in the future. We have no jurisdiction in AG at this time. Mary Davis, Town of Oro Valley Communications Administrator and member of the project team for ESL, said whether this definition will have any authority over AG or not, the intent is it will cover the Planning Area which is adopted in the Town's General Plan, which does include AG. This will incorporate any existing inventory and resources within the Town as well as future planning area boundaries. It will not be enforceable in the planning area until annexed. The ordinance would apply after annexation. The only body that can offer enforcement of the ordinance going forward is the Mayor and Council. We can provide definitions and recommendation for what the Council will approve. Chair Baughman would like to invite the Town Attorney to the next meeting so we can determine what ways this will affect AG now and in the future. Ms. Davis said the ESL ordinance adoption is the second phase of ap rocess that began in 1999 and carried through 2008. ESL is not just about AG. It is about the Town of Oro Valley and preservation efforts. If and when AG becomesp art of the Town it will also apply there. It is for what exists today and what will exist tomorrow. MOTION: Chair-elect Zwiener MOVED to accept the definition of cultural resources (as defined in above motion) as a permanent definition. Commissioner Pullara seconded the motion. Motion carried 5:0. Break 6:55 p.m. for 5 minutes. Chair Baughman stated he objects to defining historic site. Mr. Popelka said in a zoning ordinance definitions are included for any item or word subject to interpretation. A dictionary definition is not used. Commissioner McClung suggested producing the definitions and at next meeting ask for input from David Williams and the Town Attorney and let them decide whether they should be in the ordinance. Motion carried 5:0. Discussion: - Substitute either location or resource for site. Chair-elect Zwiener suggested changing the definition for Historic Site to: "A location, district, structure, object or evidence of human activities that represent facets of our identity as a nation, state, or locality." MOTION: Chair-elect Zwiener MOVED to substitute the word "resource" as applied to archaeological and architectural as defined. Commissioner Pullara seconded the motion. Motion carried 5:0. MOTION: Chair-elect Zwiener MOVED to amend the definition of Archaeological Resource to: A location or object associated with past human activity consisting of artifacts, features and other material remains that may be subject to scientific methods for their recovery and analysis. Commissioner Nagy seconded the motion. Motion carried 4:1, with Chair Baughman voting no as he felt the Commission was defeating their purpose. Motion carried 4:1, with Chair Baughman voting no. Mr. Popelka gave an update on the Request for Proposal (RFP). They are working on a contract with William Self Associates that will be completed by Wednesday. We should have an execute contract next week for Phase 1, which involves Archival Research, Historic Context narrative, and Initial Survey work. He will share that information with Chair-elect Zwiener and Vice Chair-elect Nagy. The consultant will be at the July 13 Commission meeting and will present preliminary results on the records search, with a full review at a subsequent meeting. B. Budget schedule for FY 2010-2011 HPC will soon have to address a schedule of activities to develop a budget recommendation to take to Council for FY 2010-2011. IX. Discussion and possible action regarding Environmentally Sensitive Lands Ordinance This was addressed with item VIII above. X. The first is definitions to be included in the ESLO; the second item is related to the existing Cultural Resources Preservation ordinance in the Town of Oro Valley Zoning Ordinance. DEFINITIONS In response to the June 8 HPC meeting and discussion, the following definitions have been prepared for your approval: - Cultural resources - Archaeological site - Architectural site - Community site - Historic site Cultural Resources: Any prehistoric historic site or object having archaeological, historical, architectural or community importance, as defined below, including artifacts, records, and material remains related to such property or resource. Note: This is the definition from the June 8 HPC meeting. Archaeological site: A site containing any structure, articles or remains resulting from prehistoric human life, habitation or activity, including but not limited to petroglyphs, pictographs, paintings, pottery, tools, ornamentation, jewelry, textiles, ceremonial objects, weapons, armaments, vessels or vehicles. Y TOWN OF ORO VALLEY CULTURAL RESOURCES PRESERVATION ORDINANCE As you know, the ESL ordinance will include cultural resources along with natural resources in its treatment of environmentally sensitive elements. David Williams from Willdan plans to begin drafting a cultural resources section for the ESL ordinance, and your feedback is requested toward that initial effort. The definitions outlined above will provide a building block for future work with this ordinance. The HPC will eventually need to establish categories for various cultural resource types and establish priorities for the appropriate treatment of those resources. That work will be done later in the process after we have results from the inventory project. J At this point I am asking for your feedback on the existing ordinance. If anyone wishes differently it can go on the agenda at the next meeting. III. Discussion and possible action regarding Environmentally Sensitive Lands Ordinance David Williams, Willdan, gave a PowerPoint presentation on the Environmentally Sensitive Land Ordinance (ESLO) process and schedule. A copy of the PowerPoint is available. It was suggested that Oro Valley Historical Society and the Pima Trails Association be added to the list of stakeholders. Mary Davis, Communications Specialist for the Town will be helping with outreach to the community, and will facilitate information to all stakeholders and to the public. Media outlets and other communications tools will be utilized to ensure complete information distribution. Mr. Williams continued with the project schedule. A public workshop is planned for July 23, with a second one scheduled for August. The process may be done in nine months. Mr. Williams needs HPC to define what cultural resources are and prioritize those so that it can be integrated with the ESLO. Prioritization can be done by the following: (1) Resources so valuabale that they need to be totally preserved and left alone. (2) Those resources that can co-exist with man. (3) Those resources that may be able to be moved to another location (i.e. visitor's centers). There was extensive discussion on definitions of words such as significance, integrity, archaeological site, historic building, and others. The inventory consultant will be under contract in a couple of weeks and will begin with the archive and records search. They will also be involved with the HPC in determining priorities. Access to cultural resources adjacent to the Town, such as Tortolita Mountain Reserve and Catalina State Park, should be considered for trail access. ESL will not focus on access to resources, but access may need to be considered. Interconnectivity will be looked at. Access may not be provided because of biological and cultural sensitivity. Fossils and remains should be in ESL. HPC's charge is not to prepare and write the ESL ordinance, but to provide building blocks so Willdan can write the ordinance, which will come back to HPC for review and endorsement. The following definition was decided upon for Cultural Resource: 1. Any prehistoric or historic site or object having historical, architectural, archaeological, or community importance, as defined below, including artifacts, records, and material remains related to such property or resource. Definitions will be brought to the HPC at next Monday's meeting for approval. Mr. Williams and Mr. Popelka will work on preparing definitions for cultural, archaeological and historic site for next week's meeting. The Commissioners are to work on defining archaeological site, architectural site, and community site during the week and bring back to the June 15 meeting. 2 IV. Call to the Audience Council Member Kunisch said at the May 20 Council meeting there was around $700,000 for funding dedicated to the Steam Pump Ranch (SPR) site. IV. Approval of Minutes: April 16, 2009 MOTION: Vice Chair Zwiener MOVED to accept the April 16, 2009, Historic Preservation Commission meeting minutes as presented. Commission McClung seconded the motion. Motion carried 6:0. V. Presentations a. Presentation from Matthew Moutafis on a sculpture at Steam Pump Ranch. Mr. Moutafis talked about the importance of history in art. He presented a handout on "Imagineering the Past...creating the future...NOW." He made a proposal today to the Oro Valley Historical Society regarding acquisition of his bronze horse titled "Steam Pump Pony" which is outlined in his handout. He would be contributing his efforts and he expects to raise a total of $12,500 on his own, and the horse would become the May 21, 2009 Historic Preservation Commission Draft Minutes property of the Oro Valley Historical Society. He also presented a possible logo for SPR park. This presentation was for HPC's information and he would like HPC's best wishes. Chair Baughman said he wishes Mr. Moutafis well and he personally supports the Oro Valley Historical Society's decision to support acquisition of the sculpture. b. Presentation from Mark Moore, OV Water Department, on the proposed Well Site for Oro Valley Water Utility. Mark Moore, Oro Valley Water, gave a brief PowerPoint presentation regarding the new well at SPR. Robert Jacklitch, Oro Valley Water, also was in attendance. They would like HPC's direction on the site plan and architectural concept/theme. They would also like direction and/or possible assistance in the savage of materials when the barn is demolished. Discussion points: - Security. - Time frame: next FY proceed with drilling the well, putting the casing in ground and capping it. - Design wall and equipment in FY 10/11. - Council has given the Water Department direction to proceed. There is not a signed agreement, but a set dollar amount of funding was approved. The Water Utility is buying the right to be there; the Town will still own the site. HPC cannot vote for no well. - The Task Force designated the location for the pump because access easement from the north only utilizes the well site itself. - Demolition of the barn will take less than a week and will include salvage of the barn door and other materials. - HPC should prepare a list of materials to salvage and monitor the work. - Demolition of the barn will not affect any grants. - A couple of Commissioners should work with staff on architecture to bring examples back at a later meeting. - A 5,000 gallon horizontal tank will be on the site. - Civil engineering would address grade and water flow. - Opportunity to development interpretive story about water. VI. Items for discussion and possible action regarding staff report a. Status of Steam Pump Ranch designation Council Member Salette Latas gave a brief status report on SPR designation via conference call. They had a meeting at the State Legislature with Representatives Nancy Young Wright, Nick Williams and Senator Al Melvin, and Assistant Director of State Parks Department Mr. Ziemann. The project is now in front of the Interior Appropriations Subcommittee, who will put it forward into the budget. The project needed to be listed on the National Register of Historic Places before they would move 2 May 21, 2009 Historic Preservation Commission Draft Minutes the project forward. The State committee reviewing applications for listings is where it is now. There may be a special meeting in June or July to review the application. Regarding the funding options for building and site improvements, Council Member Latas, Chair Baughman, and Scott Nelson met with Commissioners Spoerl and Zwiener, consultants from Poster Frost, and Linda Mayro from the County Preservation office and discussed funding options including County bond money, and came up with a punch list of what needs to be done this year to stabilize and protect structures. Council has $770,000 available now, pending final approval of the budget, which is what is needed to do all the stabilization and reconstruction of the pump house. Chair Baughman praised Councilperson Latas for her hard work. Mr. Nelson met and mobilized the contractor that oversaw the SABHA stabilization work. The structural engineer outlined what needed to be done to stabilize before the monsoon. This should be done within three days, which will get us through until the budget is passed. Approval has been given to do a direct select contract with Poster Frost, which is being processed and will be executed when the budget is passed. b. Environmentally Sensitive Land (ESL) Vice Chair Zwiener reported on the ESL TAC. There was some confusion on cultural resources, which has been resolved. The Commission needs to consider developing definitions and criteria for cultural resources at this point. c. Study session schedule Paul Popelka said the additional information sent in the packet is homework to review for the next HPC meeting. The June 8 session will be dedicated to this. A consultant from Willdan will attend. The intent is to work through HPC and provide feedback to ESL TAC and PA groups, P&Z and Council for approval. Over the next 3 months the HPC needs to conViete our input so an ordinance can be completed by September. d. Commission vacancy and appointment HPC has one vacancy. Staff will present security examples from existing well sites at the meeting and request direction from the Commission. Per the Zoning Code, staff recommends a ten foot landscape buffer be provided surrounding the wall on all four sides. It is also not clear what surfacing materials are proposed for the access drive. PROCEDURAL INFORMATION Per the funding agreement with Pima County, this proposal will be reviewed by the Pima County Cultural Resources Manager, Historic Preservation Office.
