LA CANADA DRIVE Call to Order at or around 4:00 p.m. Chairman Hagedorn called the meeting to order at 4:00 p.m. Roll Call PRESENT: Steve Hagedorn, Chairman Jeanie Honn, Vice-Chair Shirley Dornberg, Member Matthew Moutafis, Member Gail Munden, Member ABSENT: Andrea Fowler, Member EXCUSED: Zev Cywan, Member 1. Approval of the October 6, 2009, ARC minutes. MOTION: A motion was made by Member Dornberg and seconded by Member Moutafis to approve as amended the October 6, 2009, ARC minutes. MOTION carried, 5-0. 2. Final Review: OV5-09-010, McDonald's Restaurant, represented by Rachel Slick, requests final approval of public art for a new restaurant pad at Rooney Ranch Area B, proximate to the northwest corner of Oracle Road and First Avenue. Karen Berchtold, OV Senior Planner, provided the staff report and an exhibit from Rachel Slick, the artist. Darla Bowen of McDonalds, provided the sample of material as requested by the Art Review Commission (ARC) at the last meeting. The material is a non rust metal. Ms. Bowen said that Rachel Slick has agreed to be on call to fix anything needed. Member Moutafis asked if the square pole was considered instead of the round pole. Ms. Bowen responded the decision was made to keep the round pole. MOTION: A motion was made by Member Munden and seconded by Member Dornberg to approve OV5-09-010, McDonald's Restaurant, represented by A4 Rachel Slick,,. .esus final approval of public art for a new restaurant padat Rooneyanch Area B, proximate to the northwest corner of Oracle Road and �- y First Avenue. MOTION carried, 4-1 with Member Moutafis opposed. 3. 0V5-09-08, The Oro Valley Parks and Recreation Department, requests recommendation of artwork funding for an art proposal at the James D. David Ronquillo, OV Senior Planner, provided the staff report. Mr. Ronquillo stated theur ose of the item is to determine a specific amount and staff p p recommended a maximum of $15,000. Once a recommendation is received it will be forwarded to Town Council for final approval. Discussion was opened. Member Moutafis said the money should be used for maintenance on pieces that are older. Member Moutafis said a private source could be used to find the money to do this project. Member Munden said money should be left alone because this is not 1% for public artwork. We could do a memorial park to collect money. I believe we can get contributors and the money doesn't seem like the right fit when we can get the money from private donations. Member Dornberg said if the money is not to be used for new art then we need to do something proactive with the money. Member Moutafis said there is a tremendous amount of rust under the tree that stands at the library. We need to start building on that money to repair some of the older pieces and maybe some of the newer pieces. We need to find another source to get the money. Member Munden stated I would much rather see a client like McDonalds put their money into a fund for artwork repair rather than have the art that will probably be hidden. Chairman Hagedorn said we might look into Planned Area Development (PAD). We have a fund with a minimal amount of money in it and as a commission we have no way of knowing what the need is in the Town. Maybe the Town should have a line item in the budget. Request feedback from the staff on how to fund maintenance and start to build the fund. Mr. Paul Popelka, OV Acting Planning and Zoning Director said the issue is whether the in-lieu fund can be used for maintenance. Code says it shall be earmarked for public art work projects. We need to seek a legal opinion as to what the intent is. Chairman Hagedorn asked why the maintenance isn't being done on the pieces that the Town owns. We need a line item for maintenance. This needs to be taken to the Town Manager. Member Moutafis noted that a set aside has to be made to maintain the pieces. Member Dornberg stated the in-lieu money should go to fund new public art not maintenance. MOTION: A motion was made by Member Dornberg and seconded by Vice-Chair Honn to approve OV5-09-08, The Oro Valley Parks and Recreation Department, requests recommendation of artwork funding for an art proposal at the James D. Kriegh Park, located off Calle Concordia in the amount of $15,000. MOTION carried, 4-1 with Member Moutafis opposed. Member Moutafis stated that this does not meet the 1°/0 requirement. This should be used for public art and does not meet the criteria. Member Munden said she agreed with member Dornberg and said we need to get it in the budget. Chairman Hagedorn stated he agreed with member Dornberg in that money should be used for public art and maintenance should be a line item in the budget. Mr. Popelka stated expenditure of funding has to be approved by council. Adjournment MOTION: A motion was made by Vice-Chair Honn and seconded by Member Munden to adjourn at 4:34 p.m. MOTION carried, 5-0. . 2 TOWN OF ORO VALLEY ART REVIEW COMMISSION MEETING DATE: February 2, 2010 TO: ART REVIEW COMMISSION FROM: David Ronquillo, Senior Planner SUBJECT: Conceptual and Final Review: OV5-10-001, Dr. Ronald Walker, represented by artist Paul Orzech, requests conceptual and final approval of a public art proposal for the Neighborhood Smile Center, located on lot 10 of the Foothills Business Park in proximity to the northeast corner of Oracle Road and Hanley Boulevard. EXECUTIVE SUMMARY The proposed public art will be a sculpture depicting a life size charging ram standing on top of a base. The sculpture consists of cast silicon bronze that is attached to a stone faced/concrete base. The stone faced/concrete base is three and a half feet long, by two and a half feet wide, and three feet tall (3'-6" long x 2'- 6"wide x 3' tall). The ram sculpture is four feet eight inches high. The total height of the base and sculpture is approximately seven feet eight inches tall. The sculpture will be located on the northeast corner of the building and be visible from the main entrance to the project. The applicant is requesting conceptual and final review/approval as part of this application. BACKGROUND Summary: The applicant has provided a public art submittal for stage one and two (conceptual and final review) of the public art review process. The purpose of the conceptual and final review is to allow the applicant the opportunity to present their design renderings and specifications. At this stage, the Art Review Commission will have review and approval authority for this proposal. Once this stage is complete, the applicant must submit for final staff certification. Oro Valley Zoning Code Revised Compliance: Based on the building permit valuation estimate of$1,087,200, the applicant has provided $10,975 for public art. The proposed amount satisfies the 1% requirement as specified in the Oro Valley Zoning Code Revised (OVZCR). Current Site Conditions: • This project is located within Lot 10 of the Foothills Business Park. • The zoning is La Reserve Planned Area Development, Campus Park Industrial (CPI). • The site is currently vacant and undeveloped. Proposed Improvements: • The building use will be office. • The total building square footage proposed on the site is 11,325 square feet. This building will be constructed in phase one and will consist of 4,014 square feet of office space. • 51 vehicular spaces and passenger drop off/loading zone area will be provided. • The artwork will be located on the northeast corner of the building within a landscaped area. ART REVIEW COMMISSION Page 2 of 2 • Additional public art may be required for the remaining building phases (lots 2 - 4) if the building construction costs exceed the specified amount. PUBLIC WORKS COMMENTS Staff finds that all engineering related OVZCR items and other engineering requirements have been satisfied. The public art proposal is located outside of all sight visibility triangles and does not impact site drainage or underground utilities. This dynamic pose, that we all are familiar with, reminds us the excitement that these creatures posses. It is through g this excitement that I hope to capture peoples interest in the sculpture and the history of the desert ram in the Pusch ridge area. Ap p o ulation that no longer exist to this area through natural causes (ie. mountain lions) and human encroachment of their environment. A bronze plaque attached to the sculpture's base will give viewers historical information on the rams of the Pusch ridge area. The ram stands on top of a base that echoes the rocky surface of the building and Pusch ridge area. The Ram's head overhangs the base an appropriate distance from viewers so that one looks up at the charging ram. g 9 The overall vertically of the design, which is mirrored in the building, creates an uplifting feeling of hope and strength that is present in these fantastic animals. The insurance shall be for the full value of sculpture and installation. Compliance for Oro Valley Zoning Code Revised Section 27.3G- 1) The artwork is made of cast silicon bronze that is attached to a stone faced/ concrete base using concrete epoxy and half inch stainless steel all-thread and nuts welded into the interior of the sculpture. The stone face/ concrete bases foot print is three and half feet longbytwo and half feet wide bythree feet tall. The head of the ram sculpture over hangs the base and is at a height of six feet from the ground. It is located in area whereeo le do not p p need to walk near the over hanging head to enter the building. Given the height, location, and design of the sculpture it poses no hazard to theubli . p c 2) The ram sculpture is four feet, eight inches high and stands on top p a stone faced pedestal (matching the buildings stone work) that is about three . feet high, for a total height of around seven feet, eight inches. This will all be placed on the south side of the Neighborhood Smile Center Office. The sculpture will be visible from the street and parking as you ou enter the building. Trees and desert vegetation (an appropriate distance from the sculpture) will surround the sculpture giving it a feeling of an animal in the wild. The sculptures body has an arc that echoes the arch of the building's entrance. g t ance. The Ram's vertical design relates to the buildings overall thirty Y foot vertical design. The maturing of trees ( an appropriate distance from the sculpture) will create a shaded viewing area as the trees mature. The sculpture poses no obstruction to landscaping materials at their maturity. 4) Two to three benches will be provided for viewing the sculpture by the Clients/ Property Owner. 5) Cast silicon bronze is the most durable medium in the sculpture industry that require little to no maintenance in the Arizona environment. The sculpture's base is made of stone faced/concrete, which is the industry standard for outdoor sculpture. The sculpture will be attached with four, half inch thick, six inches long stainless steel all- thread using concrete epoxy. Their is no potential for breakage under normal or extreme circumstances. 6) The ram sculpture is a created for this project by the artist and will be a limited edition bronze sculpture that will not be duplicated in its overall design including the base and surrounding vegetation. 7) The stone facing of the building and the sculpture's concrete base is appropriate for the desert ram sculpture as rams are known for living is rocky environments. Also, the building is located near Pusch Ridge, where native desert rams used to live. The wildlife nature of the sculpture and the buildings use of natural materials in its design work together to create a cohesive design appropriate for the Pusch Ridge area and the ascetics of Oro Valley. 8) The patina of a ammonia base coat with a finishing layer of French gold creates a translucent light brown earth tone that matches the southwest landscape and the tones of the rocks and paint of the building. The texture of the desert ram sculpture will appropriately match the native animals own texture. The raised upper torso of the ram sculpture matches the buildings overall vertically. The integration rock shapes in the sculpture and the rock facing of the concrete base matches the use of natural materials in the building. 9) The sculpture's medium of cast silicone bronze ages beautifully in the desert, and withstands just about all types of vandalism from physical abuse to graffiti. It is one of the strongest and most durable mediums used for public sculpture. The base is of stone faced/concrete an industry standard. Upon installation acceptance and p Of the finished sculpture, the sculpture becomes the responsibilityof the Clients. s. Timeline: Project starts with client signing this contract, approval from the Town of Oro Valley Arts Commission, and approval of Dr. Ronald Walker's ' business loan approval for this project. Estimated project completion is January2011. � Exact date set by the Town of Oro clients. Valley and d Size: The sculpture is a life-size desert ram mounted to a concrete base with a total height of seven feet eight inches. Sculpture is approximatelyfour feet eet eight inches high, by one foot eight inches wide, by five feet six inches long. Theg g concrete base is approximatelythree feet high, by two feet six inches wide, bythree g ' feet six inches long. Sculpture Materials: The materials are cast silicone bronze mounted with stainless steel bolts, nuts and washers. The sculpture will have a welded construction, and a light Ammonia Gold patina. Mounting: Client is responsible for concrete base. Sculpture is p to be mounted to the concrete base b four - 1/2 inch stainless steel bolts (six inchesy long), nuts and washers. The Plaque mounted to concrete base � q will be by four welded- / inch stainless steel bolts hardware (four inches long). All mounting will be covered to protect the from vandalism and weather. Payments two, three, and four are dependent upon acceptance of this proposal by the Town of Oro Valley's Art Commission and approval of Dr. Ronald Walker's business loan for this project.
