LA CANADA DRIVE Call to Order at or around 4:00 p.m. Chairman Hagedorn called the meeting to order at 4:01 p.m. Roll Call PRESENT: Steve Hagedorn, Chairman Zev Cywan, Commissioner Shirley Dornberg, Commissioner Gail Munden, Commissioner Matthew Moutafis, Commissioner EXCUSED: Jeanie Honn, Vice Chair 1. Approval of the April 6, 2010, ARC minutes. MOTION: A motion was made by Commissioner Moutafis and seconded by Commissioner Dornberg to approve the April 6, 2010, ARC minutes. MOTION carried, 5-0. 2. Election of Chair and Vice Chair. David Ronquillo, OV Senior Planner, reviewed the Art Review Commission bylaws regarding the election of chairman and vice chair. MOTION: A motion was made by Commissioner Moutafis and seconded by Commissioner Cywan to nominate Chairman Hagedorn to continue as Chairman of the ARC. Chairman Hagedorn said he would like to step back and allow someone else to serve as chairman. Commissioner Moutafis withdrew his motion. MOTION: A motion was made by Commissioner Cywan and seconded by Commissioner Munden to nominate Commissioner Matthew Moutafis as Chairman of ARC. MOTION carried, 5-0. MOTION: A motion was made by Commissioner Dornberg and seconded by Commissioner Munden to nominate Commissioner Zev Cywan as Vice Chair for the ARC. MOTION carried, 5-0. Commissioner Cywan stated he wanted a correction noted for the record that Chairman Hagedorn referred to agenda item #1 as the February 2, 2010, minutes instead of the April 6, 2010, minutes. 3. 0V510-004, Kelly Copeland, represented by artist Elsa Fernandez, requests conceptual approval of a public art proposal for Villa Fatima Skilled Nursing Facility, located on the northwest corner of Rancho Vistoso Boulevard and Sun City Boulevard. Mr. Ronquillo gave the following presentation: - Location Map - Site Plan - Public Art Work - Elevations Discussion: Chairman Hagedorn asked what the indentation on the site plan represented. Mr. Ronquillo said it is a passenger drop off and loading zone, and according to Town code it has to be separate from the drive aisle. Chairman Hagedorn said the artwork was away from the front entrance. Commissioner Cywan asked if a religious iconic statue is considered to be public artwork. Mr. Ronquillo said it can be a sensitive issue, but if it meets the criteria of the code it is acceptable. Mr. Ronquillo said it is the purview of the Art Review Commission to make a formal decision. Kelly Copeland, applicant, said the artist is Secundino Garcia from Guadalajara, Mexico. He contacts him through Elsa Fernandez, the owner of La Buhardilla in Tucson. Commissioner Moutafis asked if the statue is a one of a kind piece of artwork or a production piece. Mr. Copeland said the Lady of Life statue is a unique connotation developed by an individual in town, who obtained the sanctioning from Bishop Kicanas to support the cause for our Lady of Life. The picture in the packet is of the statue located at the Holy Family Catholic Church in Tucson. Commissioner Moutafis said according to our ordinance, the commission wants to know what it will look like and what will be standing. Mr. Copeland said it was chosen because it was founded here in Tucson and will be similar to this one but not a duplicate. Commissioner Moutafis asked if he could get a statement in writing stating this statue will be a one of a kind. Mr. Copeland said he could ask the artist to state that this statue would be the only one of this kind that he will do. Commissioner Dornberg asked if the facility is owned by the Catholic Church. Mr. Copeland said no, the facility is called Villa Fatima and will house dementia and Alzheimer patients. Mr. Ronquillo said the applicant would have to come back to the commission for final review. MOTION: A motion was made by Chairman Hagedorn and seconded by Commissioner Dornberg to approve OV510-004, conditional on the location of the statue. Discussion: Chairman Hagedorn asked Mr. Ronqulllo if the site plan had gone to the Development Review Board (DRB) for approval. Mr. Ronquillo said no. Commissioner Hagedorn said his concern was the location of the statue. He feels losing one or two parking spaces at the entry would be a more prominent location. Commissioner Moutafis said his concern is the replication, location, and the absence of facts about the artist. He stated to the commission that he would attend the DRB meeting and address the commission's concerns about the location. MOTION carried, 5-0. Adjournment MOTION: A motion was made by Commissioner Dornberg and seconded by Commissioner Cywan to adjourn the ARC meeting at 4:47 p.m. MOTION carried, 5-0. 3 TOWN OF ORO VALLEY ART REVIEW COMMISSION MEETING DATE: June 1, 2010 TO: ART REVIEW COMMISSION FROM: Paul R. Popelka, RLA/AICP, Acting Planning & Zoning Director SUBJECT: OV510-003, Desco Southwest, represented by artist Joe Tyler, requests approval of a conceptual public art proposal for the Miller Ranch development, located on the northwest corner of La Canada Drive and Tangerine Road. SUMMARY: Nature of Application The proposed public art will consist of three components: an obelisk sculpture, luminaries, and transit shelter sculpture. The art will be installed in several phases on the site. Phase One will provide two sculptures. The first is an interior lit obelisk placed at the northwest corner of La Canada and Tangerine road within the buffer yard. The second component is twelve welded steel luminaries grouped in sets of three placed on two sides by the entrance adjacent to building #6. Phase Two will include a transit shelter sculpture by the entrance adjacent to building #9. Phase Three will provide nine luminaries at the entrance adjacent to building #11. Proposed Improvements • 189,866 square feet of building area • Uses include retail, restaurant, professional and medical office • Vehicular spaces and passenger drop off/loading zone areas • Transit station and car pool spaces • Proposed art will satisfy requirements for the entire site BACKGROUND: Oro Valley Zoning Code Revised (OVZCR) Compliance Based on the building permit valuation estimate of$19,912,500 (five phases), the applicant will provide $199,275 for public art, which includes costs associated with design, fabrication and installation. The preliminary amount satisfies the 1% requirement as specified in the OVZCR. A detailed construction cost estimate must be submitted for staff review as each phase is developed. Current Site Conditions • Property is 20.39 acres • Zoning is C-1, Commercial District and T-P, Technological Park District • Property is vacant and undeveloped Approvals To Date • May 2010: Master development plan, development plan for Phase One, master landscape plan and landscape plan for Phase One approved by Development Review Board • May 2010: Conditional use permit for bank drive through within Phase One approved by Town Council ART REVIEW COMMISSION Page 2 of 2 PUBLIC WORKS COMMENTS: Public Works staff has found that all engineering related Zoning Code items and other engineering requirements have been satisfied, and provided the following comments/conditions: • Coordinate proposed transit shelter location with project's Civil Engineer to ensure that adequate space is available for the structure. • Finished surface of transit shelter shall be constructed so as not to exceed a 2% cross slope perpendicular to the bus pull-out. • Coordinate final locations of proposed vertical luminaries with project's Civil Engineer; vertical luminaries are to be placed outside of intersection sight visibility triangles. • Coordinate final location of obelisk with project's Civil Engineer; proposed location of the obelisk is within the vicinity of a detention basin. CONCLUSION/RECOMMENDATION: The conceptual public art is in conformance with OVZCR requirements. Staff recommends approval of this application. A more detailed building construction cost estimate must be submitted for staff review as each specific phase is developed. The Public Works items must also be addressed. Miller Ranch Corporate Park is an approximately 180,000 square foot retail and office development located at the northwest corner of La Canada Drive and Tangerine Road. The development is split into 4 development phases. The first phase has two components consisting of retail and office. Construction will occur and an unknown time in the future when the developer deems appropriate and as the market dictates. Once construction commences, site construction will take approximately 8 months to complete and vertical construction will take approximately 6 months to complete once the site construction has been completed. Phase I will occur first and the subsequent phases will proceed as the developer and market dictate. PHASE I The proposed public artwork pertaining to Phase I is comprised of two major sculptural elements. The first sculptural element is an interior lit sculptural obelisk placed at the hard corner of La Canada Drive and Tangerine Road. This structure will be approximately 8 feet by 8 feet at its base and 30 feet in height. The structure fabricated from welded steel. The four sided obelisk will have plasma cut visual imagery with positive and negative images that convey a theme that correlates with the Sonoran desert, climate and other native imagery (examples attached). The negative images are backed with perforated steel which allows interior light to pass through the imagery. The perforated steel only allows a limited amount of light to pass through the openings. The finish of the sculpture is designed to be a naturally rusted patina. This finish will require no protection or maintenance. The artist will take great care when designing fabricating to make sure the finished work is as durable, maintenance free and vandal resistant as possible. All edges of artwork will be finished. The second sculptural element consists of 12 welded steel vertical luminaries designed to accentuate the main entrances into the project. These vertical luminaries will be in sets of 3 on both sides of the two main entrances. These luminaries will be approximately 2 feet by 2 feet in width and staggered in heights ranging from 6 feet, 7 feet and 10 feet. These luminaries will have woven steel strapping emulating a woven basket (examples attached). Both main sculptural elements will be lit. The light will be soft lit and will comply with the dark sky ordinance in Oro Valley. All lighting, light fixtures, lumens will be designed by an electrical engineer and submitted to town staff for final approval. The developer will construct a structural masonry base to support the steel obelisk. This base and structure will be structurally engineered by a licensed engineer. The structure will be fabricated and built at the artist's studio located off site. The art will be delivered to the site and set upon preconstructed base by crane. The preconstructed base will include all prewiring for the art. Once the structure is set permanently a licensed electrician will complete the electrical wiring for the interior lighting of the art. The art will be designed with safety issues in mind and construction will incorporate these safety ideas. PHASE II The proposed public artwork pertaining to Phase H is comprised of a sculptural transit shelter located at the main entrance of the project near building number 9 (see site plan). The structure will be designed and fabricated to compliment the previous artistic structures and themes. Seating will be provided for 12 persons. The posts of the structure will be designed similarly and with the same elements as the obelisk structure (see model). The sculpture will meet all ADA and transportation department requirements. Seats will be powder coated requiring no maintenance and clean surfaces. The finish of the main structure will be a sealed finish over a rusted patina. This will require resealing maintenance of the finish every 8 to 10 years. The art will be designed with safety issues in mind and construction will incorporate these safety ideas. Individual parts will be constructed offsite and the components assembled on site. PHASE HI Additional luminaries at the entrance to Phase III as described above. ARTIST BIOGRAPHY Joe Tyler has been designing, fabricating, and installing public artwork for over 20 years. His commissioned public work can be found in most major cities and towns in Arizona and Many cities in the United States. He has also done large scale sculptures in Japan. He has completed 3 public art projects in ORO VALLEY: 1. " The learning Tree"-Oro Valley Public Library 2. "The La Canada Road Project" 3. CONFORMING TO THE ZONING CODE DEFINITION OF "PUBLIC ART" Section 31 of the Land Use Code 268.1 Public Artwork Shall mean artwork that is accessible to the community and the general public. It may be privately funded and owned or it may be fully funded by public agencies for public benefit. Public artwork adds aesthetic appeal, draws visitors and improves the image of the Town. It entails the application of skill and taste by an artist in creating an original work of art. Examples of appropriate public artwork include, but are not limited to: sculpture - freestanding, wall-supported or suspended; murals or paintings; earthworks; fiber works; and mosaics. Privately funded and owned, public artwork may not include: directional graphics or color-coded location indicators; mass-produced or standard "off- the-shelf' items, including playground equipment, fountains, or statuary, and most art reproductions.
