CALL TO ORDER— Chair Hoffmann called the meeting to order at 4:34 p.m.

Dave Powell — Commissioner

CALL TO AUDIENCE — No one spoke at this time.
ITEM #1 UPDATE ON IGA WITH TUCSON WATER FOR CAP WHEELING
An update on discussions with Tucson Water was given to the subcommittee by Mr. Saletta.
Council approved the Intergovernmental Agreement for the Cost of service Study. A Scope
of Work is currently being reviewed by Tucson Water Metro and Oro Valley. There was an
overview and discussion on the wheeling concept and that the CAP water belongs to Oro
Valley but we would be recharging and recovering it as groundwater and then delivering it
through the Tucson Water System to the Oro Valley Water Service area. There was
discussion on the timing of the study and that a final IGA may not be in place for another
year or year and one-half. It was discussed that this would not interfere with the plans for
developing our CAP Water Treatment and delivery System because this would be on a short
term interim basis.

ITEM #2 UPDATE ON NORTHWEST WATER PROVIDERS IGA (P.Saletta)
An update on discussions regarding the proposed Intergovernmental Agreement with
Flowing Wells, Marana, Metro and Oro Valley by Mr. Saletta. The IGA is proposed to
include the design and construction of the Central Arizona Project Water Treatment and
Delivery System. An IGA on Operations and Maintenance will be drafted later once the
treatment and delivery system is designed and preliminary operation annuals are
developed. Governance was discussed and that Management Committee would be formed
and it is also proposed that Authorized Representatives would be appointed by the
governing body of each entity. The Authorized representatives are proposed to be the
Directors and/or General Mangers. The concept of the Lead Agent was discussed and the
concept that one of the NVVWP or a third party may be the Lead Agent. There was
discussion regarding the structure of the governing bodies of each of the entities and that all
are elected and that Marana and Oro Valley are towns and that Flowing Wells and Metro are
water districts. There was discussion on the concept of sharing Lead Agent responsibilities
and options for changing the Lead Agent in the future.

ITEM #3 UPDATE ON CAP WATER STUDIES
An update was given by David Ruiz regarding the proposed scope of work and status of the
water quality and distribution studies for the delivery of CAP water to Oro Valley. The
Tucson Water wheeling proposal will be included in this study. Negotiations are underway
with CH2M-Hill and WestLand Resources on the scope and contract.

ITEM #4 USE OF GROUND WATER PRESERVATION FEE
Mr. Saletta discussed the establishment and uses of the Ground water Preservation Fee.
An excerpt from the August 20, 2003 Rate Report was discussed. It was discussed that the
GPF is for renewable water resources and the associated debt and capital. There was
discussion as to whether the wheeling arrangement with Tucson Water for the interim
delivery of Oro Valley's CAP water could be paid from the GPF revenues. This will also be
discussed at the Water Utility Commission Finance Subcommittee and then brought back to
the Commission and then to Council.
There was no action taken on this item.
CALL TO AUDIENCE — Doug McKee, Oro Valley citizen, spoke regarding water quality for
the CAP treatment and delivery system and if all four entities would receive the same water
quality. He also discussed that Arroyo Grande may be further out in time and how that
could affect CAP water delivery system timing and the proposed interim wheeling
agreement with Tucson water. He also discussed the ground water preservation fee for
renewable water and operations and maintenance costs.
FUTURE AGENDA ITEMS — Future field trip to Tucson Water recharge facilities.
