Discussion ensued among the Board, applicants and staff.    Motion by Vice Chair Stephen Roach, seconded by Member Mary Murphy to approve this variance request to reduce the rear yard setback from 40 feet to 14.5 feet for the proposed addition at 1241 W. EXECUTIVE SUMMARY: The applicant is requesting a variance to reduce the rear yard setback from 5 feet to 2.5 feet to accommodate a portion of a newly constructed swimming pool, located at 2290 W. Azure Creek Loop. The subject property is notated with a star on the image below. It is located in the newer Saguaro Viejos subdivision near the northwest corner of Naranja Dr. and La Cholla Blvd. Code requirement: Section 25.2.E of the Zoning Code states, "No swimming pool or in-ground spa shall be located closer than five (5) feet to any rear property line." Additionally, all swimming pools must be the applicable side setbacks. Variance request (Attachment 1): The applicant's request to reduce the rear setback from 5 feet to 2.5 feet for a portion (9 linear feet) of the existing pool was evaluated by the five findings established in State Law. Notable factors meeting the findings are below with a detailed analysis included in the Discussion section of this report.   The shape of the lot is irregular due to the angle of the rear lot line. This irregular shape was designed and platted by the developer, prior to the owner purchasing the lot and building a home.  A swimming pool is common to single-family residential zoning districts.  The location of the existing pool meets the intent of the zoning code requirement. The slant of the rear lot line creates a 35 - 43' distance from the pool to the abutting homes. Additionally, the pool is screened by a 5-6 foot block wall with a landscaped area between the wall and the pool.  Therefore, staff determines all the five findings have been met and recommends approval.  Although not relevant to the findings, it is noteworthy that the homeowner took the proper steps to meet all zoning code requirements by submitting plans and acquiring a pool permit. However, the contractor failed to account for the irregular shaped rear yard and placed a portion of the pool within the 5-foot setback.    BACKGROUND OR DETAILED INFORMATION: PROPERTY DETAILS:  2019 Saguaro Viejos subdivision was platted 2020 Existing house was built on the 7,589 sq.ft. lot 2021 Permit for pool issued with proper setbacks indicated DISCUSSION:  The applicant is requesting a variance to reduce the required 5-foot rear yard setback to 2.5 feet to accommodate an existing swimming pool. State Law and the Oro Valley Zoning Code require the Board of Adjustment to determine that all the variance findings have been met in order to grant a variance. The required five findings are shown in italics below, followed by the applicant and staff comments regarding the findings. The applicant's complete responses and supporting evidence are included in Attachment 1. 1. That there are special circumstances or conditions applying to the property strictly related to its size, shape, topography, location or surroundings which do not apply to other properties in the district. Existing building configuration shall be included only when constrained by the special circumstances or conditions of the property; APPLICANT COMMENT:  Unique lot line is angled and not parallel to home. Lot line itself is angled and wall was built on that lot line. My rear wall, which is my property line, was built at an angle by Meritage Homes. STAFF COMMENT:  The special circumstance applying to the property is the angle of the rear lot line. The angled rear lot line reduces the size of the rear yard towards the western edge of the property. As shown in the left image below, the house and subsequent pool (not shown) were built parallel to the front lot line. Due to the irregular shape of the lot, a portion of the pool encroaches the required 5' setback (right image below). 2. That special circumstances or conditions as defined in subsection C.1 of this section were not created by a previous or current owner; APPLICANT COMMENT: As the homeowner, I did not create the lot line the developer did. The contractor I hired, Mr. Chad Cox from Southern Arizona Pools who is a licensed contractor in the State of Arizona (license #322628), created this issue. In his CAD drawings for the pool, the pool was supposed to be parallel to the wall on the back portion of the pool. With that in mind, if the project was built as the original CAD plans were created, presented, and approved by me, we would not be in this situation. Chad began construction and I assumed that pool lines would be straight like the drawings that we agreed upon. When that part of the pool was finish, I realized it was completely off from the drawings. It took many phone calls, text, messages, and emails letting him know that edge of the pool was completely off from the drawings. He finally returned a call, I asked him to meet me at my property. I had mentioned to Chad that the pool layout seemed off to the back wall. His response was, he made the pool square to the house. This decision was made solely on his part without consulting me whatsoever. In summary, this is where the problem lies, the job was completely different than our original and only signed contract. Mr. Chad Cox chose to ignore the Town of Oro Valley’s codes as a pool contractor. STAFF COMMENT: The shape of the lot was designed by the developer and platted in 2019, prior to the homeowner purchasing the lot. An image of the platted lot is below, depicted the angled rear lot line. The odd angle represents a unique challenge by creating an irregular shaped rear yard.    3. That the authorizing of the variance is necessary for the preservation of privileges and rights enjoyed by other properties of the same classification in the same zoning district; APPLICANT COMMENT: Pools are common. For a pool to be in single family homes in Oro Valley is common, on my street 4 out of 6 homes have or are under construction for a pool. STAFF COMMENT: The property is located within the Saguaro Viejos subdivision, which is zoned R1-7. A swimming pool is very common to single-family residential zoning districts, including R1-7. 4. That any variance granted is subject to such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; APPLICANT COMMENT: No special requests are being made. Landscaping is ready in place. STAFF COMMENT: The intent of the 5-foot rear setback for a swimming pool is to create space between the pool and abutting home. Only a portion (9 linear feet) of the existing swimming pool encroaches the setback. Due to the angle of the rear lot line, the home most impacted by the setback encroachment is actually further away from the rear lot line than the home where the setback is met. The image below illustrates the distance between the homes and the rear lot line with the area of encroachment circled in red. Therefore, this finding has been met, and no special conditions need to be applied to this case.  5. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. APPLICANT COMMENT:  After having a conversation with an inspector from the Town of Oro Valley, I have a better understanding that this should have no effect on my neighbors or myself by passing this requested variance. Rear neighbors have more space because of the angel of the fence. STAFF COMMENT: The location of the existing swimming pool will not be detrimental to the neighbors. The neighbors with the highest potential to be impacted are to the rear. The following factors meet this finding:  The swimming pool is located behind a 5-6 foot block wall. Landscaping is provided between the pool and the wall in its entirety (see image below) The majority of the pool meets the 5-foot setback and all side setbacks  The portion of the pool that is too close to the rear setback meets the intent of the code by being 35-43.2 feet away from adjacent homes. PUBLIC PARTICIPATION:  Notice sent to all property owners within 300 feet of the subject properties. Notice posted on the property. Notice posted online at www.orovalleyaz.gov. Notice advertised in the Daily Territorial. SUMMARY AND RECOMMENDATION: Staff finds that the variance request meets all the findings per State Law and the Zoning Code and staff recommends approval.  FISCAL IMPACT: N/A SUGGESTED MOTION: The Board of Adjustment may consider the following motions: I MOVE to approve this variance request to reduce the rear yard setback from 5 feet to 2.5 feet for an existing swimming pool at 2290 W. Azure Creek Loop., based on the finding that the five criteria have been met. Azure Creek Loop Oro Valley AZ 85742~ 520-444-3390 I am requesting a variance because my pool is already built and is in place as is my landscaping. In addition, the wall between my yard and my rear neighbor’s yard is also a built structure. The area in question is 2.5 feet by 9 feet long. A. Unique lot line is angled and not parallel to home. Lot line itself is angled and wall was built on that lot line. The special circumstance is that the contractor Mr. Chad Cox of Southern Arizona Pools dug, shotcrete, and completely mismeasured the distance from the waterline (edge) of the pool to the property line/common wall.
