Council Liaison Harry Greene stated that the Town Council expressed interest in hearing the monsoon
preparedness report in the future.
DIRECTORS REPORT (INFORMATIONAL ONLY)
Stormwater Utility Division Manager John Spiker reported on the following:
- Monsoon season update: Pima County rain gauge at 680 W Calle Concordia has recorded six inches of rain
this year.
- Town Council approved an update to the 1983 Intergovernmental Agency (IGA) between the Town and Pima
County Flood Control for water course maintenance. The new IGA will define responsibilities via GIS map. It will
also address The Loop maintenance and address the Town's need for an Operations laydown yard to store
materials.

PRESENTATION AND DISCUSSION OF PIMA COUNTY AND THE TOWN OF ORO VALLEY WATERCOURSE
MAINTENANCE INTER-GOVERNMENTAL AGREEMENT (IGA)
RECOMMENDATION:
For informational purposes only.
EXECUTIVE SUMMARY:
This intergovernmental agreement (IGA) updates and replaces a 1984 IGA between the Town of Oro
Valley (Town) and the Pima County Regional Flood Control District (PCRFCD) largely incorporating
authorization for the Town to utilize Pima County property for a streets & drainage operations/materials
laydown yard. With the current expansion of Naranja Park, the longstanding operations yard needed to
move. There is inadequate space remaining at Naranja Park, as well as within another town-owned
useful location. The ideal placement of such a yard would be semi-central to Town, away from residential
areas as much as possible and along an arterial route for easy access. There is, however, land available
along La Cholla Blvd., just south and west of the Town boundary owned by Pima County, that meets the
operational requirements. This area is just north of Overton, on the east side of La Cholla Blvd.,
composed of portions of parcels 225-06-016C, 225-06-016A and 225-06-014A (approximately at 9350 N.
La Cholla Blvd.).
Currently, the Town has a right of entry to utilize this county-owned land. In order to finalize an
agreement for perpetual use, the Town needs to either purchase said land if it were available or enter
into an IGA with the County. Staff opted for the latter as there was no appraised purchase cost and more
expedient to process. The County agreed. And during the crafting of this IGA, it was discovered that
there was a longstanding IGA with the PCRFCD that was in need of updating.
The Pima County Board of Supervisors and the Oro Valley Town Council have had an IGA in place for
the maintenance of the Canada Del Oro (CDO) Wash and its major tributaries as they pass through the
town boundaries since 1984. This agreement was predicated on watercourses with a 100-year peak flow
rate of 3,000 cubic feet per second (cfs); flow rates greater than 3,000 cfs were to be maintained by the
County and flows falling below this threshold maintained by the Town.
In the nearly 40 years since the IGA was signed, new floodplain data has been obtained, new floodplain
modeling techniques have been introduced, Town boundaries have expanded, public and private
development has transpired, and new infrastructure has been introduced along the major watercourses
in the form of the Chuck Huckelberry Loop (Loop).
This new IGA seeks to:
1) Update wash maintenance locations in the form of a Geographic Information Systems (GIS) mapping
product that is shared between the County and the Town to more rapidly address changes in
responsibility due to annexation, acquisition, and new floodplain data. See IGA attachment for map
2) Introduce the Loop infrastructure within the Town and assign responsibility. See IGA attachment for

3) Provide the Town an opportunity to utilize the property at 9350 N. La Cholla Boulevard as an Operations
Laydown Yard for the storage of Town materials and equipment. See IGA attachment for map
This IGA has been approved by the Oro Valley Town Council at the July 20, 2022 Council Meeting and will be
placed on the agenda for approval by the Pima County Board of Supervisors in August of 2022.
BACKGROUND OR DETAILED INFORMATION:
In May 1984, the Pima County Board of Supervisors and the Oro Valley Town Council passed an IGA in regard to
watercourse maintenance responsibilities for the CDO Wash and its major tributaries. The driving factor behind this
agreement was the 1983 Pima County Flood Plain Management Ordinance and the desire to clearly identify
responsibilities between the County and Town for the CDO Wash and its tributaries as they travel through Town
boundaries. The prevailing thought was to maintain consistency of the CDO Wash and its tributaries in design,
construction, and maintenance for the Town as well as our upstream and downstream agency partners.
The IGA stipulated that the maintenance shall take place on any river, stream, creek, wash, arroyo, or other body of
water or channel having banks and bed through which waters flow at least periodically and any depressions serving
to give direction to a current of storm water where the peak flow is 3,000 cubic feet per second (cfs) or greater
during the regulatory flood.
Watercourses the County and Town understand to have a 100-year peak flow rate of 3,000 cfs have been identified,
but the exact location where that flow rates shifts below or above the threshold were never clearly defined. As
development creeps closer to the floodplain boundaries it is imperative the County and Town identify exact
locations for watercourse responsibility to ensure consistent floodplain management is taking place and to minimize
impacts to properties both upstream and downstream. New hydrologic data and hydraulic modeling techniques have
also shifted the understanding of where the original 3,000 cfs threshold may have existed to where it is today and
may change in the future. Updated rainfall information from the National Weather Service and United States
Geological Survey groups and new modeling techniques in the form of 2 dimensional flow analysis have changed
the way flow rates are identified.
This updated IGA seeks to clearly identify where and what activities the PCRFCD and the Town will provide
watercourse services. This IGA is served in the form of Geographical Information Systems mapping layers, shared
between the County and Town, and will be updated to track new property ownership, floodplain modifications, and
new infrastructure.
In addition to clearly identifying areas for watercourse maintenance, the Town desired a new location for the
Operations Laydown Yard to replace the area of yard at Naranja Park. The development of Naranja Park required
the Oro Valley Public Works Operations Division to relocate from that location. The PCRFCD will allow use of their
property along La Cholla Boulevard, north of Overton Road for such a purpose. The Town will be required to
secure, maintain and abide by the Right of Entry requirements contingent upon the IGA being signed.
Lastly, since the original 1984 IGA was signed, significant portions of the Chuck Huckelberry Loop (Loop) have
been developed within the Town boundaries along the CDO and Big Washes. These Loop segments provide a
significant regional amenity for our residents in Oro Valley. The updated IGA seeks to identify this regional asset
and similarly to the watercourse itself, spell out who is performing maintenance and where this is to take place. As
the Loop is ever expanding, the County and Town will maintain a GIS map layer showing responsibility and update
the map layer as new segments come online.
FISCAL IMPACT:
The Town will assume maintenance responsibility for the La Cholla Laydown Yard. These activities were already
happening at the Naranja Park site and should pose no additional fiscal impact to the Town. The site was secured
last fiscal year and an additional $325,000 was allocated this year in the Town's Capital Improvement Program
funds for future programming to be coordinated with Pima County.
The Town will assume the maintenance of the Chuck Huckelberry Loop (Loop) segments within the Town
boundaries from Overton Road to Rancho Vistoso Boulevard along the CDO and Big Washes. The Town is
currently maintaining the Loop from La Canada Drive to Tangerine Road. Trash pick up and minor pavement
rehabilitation for nearly 2 miles of new asphalt pathway will become the responsibility of the Town. Projections of
roughly $4,106 shall be allocated annually to address maintenance of the new Loop segments. These maintenance
responsibilities will provide in-kind value to Pima County for the use of their property.

IGA History
The Oro Valley Town Council and Pima County Board of
Supervisors entered into an intergovernmental
agreement in May of 1984 for watercourse
maintenance on the Canada Del Oro Wash and its
major tributaries
Substantial flooding in Pima County in 1979 and again
in 1983 triggered a need to develop a floodplain
management ordinance. An outcome of that work was
the IGA with Oro Valley to ensure consistent floodplain
management was taking place.
Need For Update -Laydown Yard
The impetus for this update:
•Town's need for a streets & drainage
operations/materials laydown yard.
•No suitable town-owned location could be
identified to meet this criteria.
•Land is available along La Cholla Blvd., just south
and west of the Town boundary owned by the
Pima County Regional Flood Control District, that
meets the operational requirements.
•The IGA will grant Oro Valley access and
utilization of the nearly 8 acres of property
subject to County regulations.
Need For Update –Outdated Floodplain Information
Beyond the Town’s need for an
Operations Laydown Yard, the current
watercourse IGA has remained
unmodified for nearly 40 years. In that
time developments within Honey Bee,
Big, and CDO Washes have crept closer
to the floodplains, producing updated
floodplain information and modifying
the locations of watercourse
maintenance responsibilities
Need For Update –Loop Pathway Expansion
In addition to subdivision
development, there has been
significant expansion of the Chuck
Huckelberry Loop within the
Town of Oro Valley over the last 40
years. The IGA update seeks to
identify responsibilities and
locations for Loop maintenance.
