Tuc s on., Arizona RE : Town of Oro Valley Dear Mr. DeConcini: called you yesterday, but apparently your busy schedule pre- vented re .vented your returning my call. Therefore, . am writing this letter. First of all, I want to extend to your civil deputy, Rose Silver, my appreciation for her courtesy and consideration at the Board of Supervisor' s hearing on Monday, April 14. She also advised me at the time that she would attempt to give me adequate notice of any further hearing that the Board might schedule to consider the matter of disincorporation of the t own, so that ray clients and i might be present. should also direct your attention to my letter of April 7 , in which 1 suggested that your office set certain guidelines with re- spect to disincorporation, and determine certain matters of law relative thereto, which, in my opinion, are not set forth in the statutes . Particularly, these matters should be determined now, since both Supervivors Asta and. Joyner have indicated through the media that there is now additional time (beyond the year period) for the propon- ents of disincorporation to seek signatures on petitions. Also, your aide, John Neubauer, again according to the media, is authority for the propositions that not only is the one year period extended in- definitely n-definitely for the purpose of obtaining signatures , but , also, that all signatures on petitions for disincorporation should be considered valid if the petitioner at the time of signing was a bona fide elector Page 2 17 April 1975 of Oro Valley, regardless of the fact that he was no longer a resident and elector of Oro Valley at the time that the petitions are filed. If you carry forward these absurd propositions to con- clusion, the proponents of disincorporation could conceivably, over an extended period of time, file petitions containing signatures in excess of the number of qualified electors residing in the town at the time of filing the petitions . Several of us who support the town would appreciate the opportunity of meeting with you to discuss these issues . It seems appropriate that the natter with respect to validity of signatures; period of time in which they can be obtained; and other pertinent issues should be determined.
