HENOERSON April 7, 1975 Mr. Dennis DeConcini Pima County Attorney Pima County Administration Building Tucson, Arizona Dear Mr. DeConcini : am writing you as attorney for a number of residents of the Town of Oro Valley, who are interested in seeing the town main- tain its incorporated status. We have reason to believe that the residents who favor disin- corporation are prepared to ffle petitions seeking to disIncor- porate within the next few days. So that we all will not have to suffer the incriminatibtal and haluciations that recently attend the resignation of the past mayor, we suggest and would appreciate your setting the guide- lines and procedure for those who file petitions and those who contest their validity, number, etc. It appears to us that the Code is somewhat lacking in providing specifics for disincorporating. For instance we have the following questions : 1. The Code speaks of the requirement of 2/3 ' s of the registered voters residi_na in the town. Does this mean, therefore, that this is 2/3 ' s of the voters who presently (today) reside in the town? 2. Apparently, provision is made for filing the wtitions with the Clerk of the Board of Supervisors. How long does the Clerk hold ther7 Who is advised of the filing? What opportunity do opponents of disincorporation have to examine them?
