Dear Mrs. Silver;
The members of the Oro Valley Town Council, as you are aware ,
are trying to set an election date for Town Council members and
comply with all the Pima County, Arizona State and Federal laws
that are reauired to hold a legal election. There appears to be
some Federal approval that we are not aware of, as to exceptions
of local elections laws.
We of the Town Council would sincerely appreciate it if your office
can consult with the State Attorney General' s Office and provide
us with a written opinion on how to procede . We would like the
- opinion to include , but not limited to, how to resolve the con-
flict with constitutional, statuate , Federal and Pima County
Election requirements . We would also like to know if the election
date of May. 28th, 1974 can be used as a Primary date , and still
comply with the fourth Monday in May rule in th A.R. S . Can a
Common Council by ordinance or resolution, shorten the fifty days
prior to election registration cut off date, to thirty days? Can
the Common Council deviate from the General Election' s laws of
Arizona? What are the Public notice and publication requirements
in the town that are reauired to comply with County, State, and
Federal laws? If it is not possible to reconsile all the laws
on the subject of a town council election, may we be provided with
an opinion, and plan of procedure that would conform as nearly as
possible, and be approved by the County, State and appropiate
Federal officials?
