Board of Adjustment Staff Report CASE NUMBER: OV1700129 MEETING DATE: February 28, 2017 AGENDA ITEM: 2 STAFF CONTACT: Patty Hayes, Senior Planning Technician Applicant: Peter Zorilla Request: Allow a detached garage to be built 5' taller than the main house. Location: 720 W. Linda Vista Boulevard SUMMARY: The homeowner is requesting to build a garage on his property as shown in the application, Attachment 1. The garage would be built as a freestanding building, otherwise referred to as a detached garage. The detached garage is proposed to be 5 feet taller than the main house as illustrated in Attachment 2. Zoning code section 23.6.A.3.b, requires a detached accessory building, such as the proposed garage, not to be taller than the main house. The purpose for this code requirement is to ensure height proportionality between the house and detached buildings on the same lot. In this specific case the garage is proposed to be built several feet away and slightly downhill, unattached from the house, due to an existing septic system that is located in the area that would have normally allowed the garage to be attached to the home. The maximum building height of 18', allowed in the R1-36 zoning district, would be the height applied to the garage if there was an area on the lot that allowed the garage to be attached to the home. Since the location of the existing septic system prevents the garage from being attached to the home, the code's detached building height limits are applied. The height of the detached garage is limited to the 12'6" height of the main house. The owners' specific needs to park taller vehicles in a garage requires a taller structure than a 12'6" garage would accommodate. In summary, the variance request meets many of the five findings but does not meet finding number one, special circumstances of the property. Although the existing septic system prevents the garage from being attached to the home, the situation could be resolved by relocating the septic, thus eliminating the need for a variance. Based on the analysis provided in the discussion section of this report, staff recommends denial of the request unless the applicant can provide evidence that the land will not accommodate a septic system located elsewhere on the lot. OV1700129 Linda Vista Blvd Variance Board of Adjustment Staff Report BACKGROUND: Existing Site Conditions • Property is located in the Oro Valley Estates (Attachment 3) Lot size: 1 acre • Structures on the property include: o One-story home built in 1970 o Detached storage building which is proposed to be removed. Related Approvals Page 2 of 6 Final plat was approved in 1958 while in Pima County and was originally zoned CR-1. Subdivision was annexed into the Town in 1974 when the Town was first established and later the zoning was translated to Oro Valley R1-36. The home was built prior to annexation. The existing land use and zoning for the subject site and surrounding properties: Location Zoning Land Use Subject site R1-36 Single Family Home North R1-36 Single Family Home South R1-144 Single Family Home East R1-36 Single Family Home West R1-36 Single Family Home DISCUSSION: State Law and the Oro Valley Zoning Code require the Board of Adjustment to determine that all of the following variance findings have been met in order to grant a variance. The required five findings are shown in italics below, followed by the applicant and staff comments in regards to the finding. The Applicant's complete findings are included in Attachment 1. 1. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district, Applicant Comment: The applicant states the house was built in 1970 at a time when houses in the Tucson area were generally built with shorter ceilings and rooflines. Limiting a garage to the same height of a shorter older house does not permit the new structure to be built at a height commonly found in today's structures. Also the existing septic system is located in the area where an attached garage would normally be built onto the home, which would have eliminated the need for a variance. OV1700129 Linda Vista Blvd Variance Board of Adjustment Staff Report Staff Comment: Page 3 of 6 An addition built onto the main house in an R1-36 zoning district would be allowed to be as tall has 18' in height. When an addition is built detached from the main house, the allowed height becomes limited by the height of the existing house which in this case is 12'6". The left (west) side of the lot contains adequate space for adding a garage attached to the house except for the septic system located in that same area. Building the garage as a detached structure away from the septic is a logical solution. However, once the garage is proposed to be built separate from the house, the height of the garage becomes limited by the shorter height of the house. The shorter garage height which does not meet the owner's need for a taller garage to accommodate larger vehicles. Attaching the garage to the house would require the homeowner to relocate the septic system to another location on the lot. Relocating the septic would require soils testing, appropriate slope on the lot and approval by Pima County Wastewater. Building the garage detached from the home, away from the existing septic system, would alleviate the need to relocate the septic. The location of the existing septic system is not related to the topography of the lot and is not considered a special circumstance of the lot and therefore this finding is not met. 2. That special circumstances were not created by the owner or applicant; Applicant Comment: The applicant refers to the shorter height of the 1970's house, the conversion of the home's original garage into living space by prior owners and the location of the septic as limiting factors that were not created by the current owners. Staff Comment: The location of the house and septic along with the existing shorter home are circumstances the current owners did not create. Building a detached garage in the proposed location does not in itself require a variance. The requested height of 17', which is 5' taller than the house, is a feature the homeowner states is needed for their specific vehicles and needs. An 18' tall garage would be allowed to be built on the property, without a variance, if it was built attached to the home. The septic system is the factor that is preventing the garage from being attached to the home and allowing the 18' height. The existing locations of facilities on the lot and height of the house were not created by the owner, therefore this condition is met. OV1700129 Linda Vista Blvd Variance Board of Adjustment Staff Report Page 4 of 6 3. Variance is necessary for the preservation and enjoyment of substantial property rights, Applicant Comment: The homeowner states the garage will allow him to place his truck, trailers and other items into an enclosed space which will improve the atheistics of the property which will also improve enjoyment of the property for himself and neighborhood. Staff Comment: When a homeowner can place their vehicles and other belonging into a garage, the property most often visually improves. The homeowner could build a garage in the proposed location at a height of 12'6", the same height as the house, without a variance. However, the homeowner requires a taller garage for his specific vehicles. Generally garage door heights are 7' to 9' tall in the average home today. Specialty garage doors for recreational vehicles can range from 12' to 14' tall. Allowing an enclosed garage on the property is important to the enjoyment of the property and is also a common feature in single family home developments, therefore this criteria has been met. 4. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located, Applicant Comment: The applicant states that several detached buildings exist in the area and that authorizing this variance would not create a special privilege for this lot. Staff Comment: The Oro Valley Estates is a subdivision that was originally developed in 1958 under Pima County's zoning standards. Taller structures would have been allowed at that time and even for several years following annexation until the Oro Valley zoning code was adopted with the current height limits. A few homes in the area are two story and many properties have detached accessory buildings. A detached garage built on the subject property would not be out of place for the neighborhood nor would a taller building. Garages, either detached or attached, are common in many single family home developments and is not a special privilege, therefore this criteria has been met. 5. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. OV1700129 Linda Vista Blvd Variance Board of Adjustment Staff Report Applicant Comment: Page 5 of 6 The applicant states he has gained approval for the taller garage from the homeowner's association along with two of the adjoining neighbors. He will also build the garage to blend with the house and enhance the vegetation on the lot in order to ensure the garage fits into the neighborhood. Staff Comment: The land where the detached garage is proposed is slightly lower than the existing house. This will help make the garage appear not too much taller than the house. The slight topography change along with designing the garage to match the main house should help the garage blend with the property and neighborhood. Other properties in the area are generally screened from view by mature vegetation and/or situated in such a way that views should minimally obstructed. The neighboring properties to the west, whose views could potentially be impacted generally slope downward by approximately 10' toward Calle El Milagro. A detached garage built either at the allowed 12'6", proposed 17" 2" or attached at 18' could potentially be seen by any one of those homes because the garage would be at an upslope view as are many other homes and structures in the area. The proposed garage does not exceed the normally allowed 18' building height for this zoning district, but only the detached height limits. The garage would have no greater impact to the neighborhood whether it is detached or attached, therefore this criteria has been met. PUBLIC PARTICIPATION Public Notice has been provided as follows: • Notice sent to all property owners within 300 feet of the subject properties. • Notice posted on the property. • Notice posted online at www.orovallevaz.gov • Notice advertised in the Daily Territorial. • Staff has received one email from a neighbor who objects to the variance (Attachment 6) STAFF RECOMMENDATION In summary, the variance request meets many of the five findings but does not meet finding number one, special circumstances of the property. OV1700129 Linda Vista Blvd Variance Board of Adjustment Staff Report SUGGESTED MOTIONS: 01 Page 6 of 6 I move to approve OV1700129 a variance to allow a detached garage to be built 5' feet taller than the main house, based on the finding that the five criteria have been met. •: I move to deny OV1700129, a variance to allow a detached garage to be taller than the main house, based on the finding that the five criteria have not been met. Email from Neighbor Bayer Vella, Planning Manager Page 1 of 2 Mark and Susan McIntyre February 6, 2017 720 W Linda Vista Blvd. Oro Valley, AZ 85704 RE: Oro Valley Country Club Lot 27 Project Description/Narrative A) Our request for variance concerns current height restrictions on additions and detached structures. The current residence has a ridge height of 12'- 6" and this is by code the maximum height of any new structures. My client requires a height of 17'-2" on the detached garage to meet the same architectural features as the residence. A 12' high garage door is required to provide clearance for his truck to access the proposed garage. We have designed the lowest height truss possible for the garage plan. The location of the septic field prevents attaching either closer location or attaching the garage to the residence. This would have lowered the profile of the structure in relation to the residence. This necessitated the garage to be located as per plan. 5 Question response i. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district. The code requirement is that the heights of additions or detached structures be equal to or less than the existing residence roof. The residence was built in 1970 and residential buildings at that time were lower in height. Parapet or ridge lines were 10' to 12' typically. Current homes are 14' to 18' in height on gable roofs. The allowable height of buildings in Oro Valley Country Club is a maximum of 18'-0". The location of the existing septic field prohibits attaching the garage to the main house. Further, to move the garage toward the front of the property is another zoning violation. ii. That special circumstances were not created by the owner or applicant. The revision of the code to restrict the height of additions or detached structure. To place a height restriction base on a 1970 house height is not realistic. In this case, the allowable building heights for Oro Valley Country Club are 18'-0" for new construction. The location of the septic system built with the house in 1970, prevents any other logical location for the garage on the property. The previous owners had enclosed the original garage into a living area. We had anticipated building a garage in the future when we purchased the residence. iii. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights. Attachment 1 The addition of a garage would improve our enjoyment of our property. There would not be any truck, trailers, or miscellaneous items visible on our property. The new garage will provide safe and proper storage of our vehicles. The location of the garage would prevent damage to existing vegetation and trees. Any alteration or relocation of the garage would greatly increase this. This would also bring us into compliance with the CCR's. We are also removing a metal storage building (inside pad of garage) with a structure that architecturally matches the existing residence. Thus removed, the visual aspect of our truck and trailers out in the open is illuminated for us as well as our neighbors. iv. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? As is typical, requests for variances differ for each applicant. Adjoining neighbors have been shown the plan and layout of the proposed new garage and do not oppose or have any issues with construction as indicated their signatures are on the master plan sheet. There are several other properties in the area with detached garages and guest houses on the property as well as original garages. The property addresses are as listed: 9655 N Calle El Milagro 9635 N Calle El Milagro 925 W Valle Del Oro Rd. 800 W Linda Vista Blvd. This property in particular has a second floor/ viewing deck that we were able to locate and it did receive a variance approval. The location of residence is 642 E Windy Peak PI. Oro Valley, AZ. Additional properties in the area as listed: v. That the authorizing of the variance be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. • The proposed garage height and location has been approved by the adjoining neighbors and also approved by Oro Valley Country Club Home Owners Association (See attached letter). The construction will be architecturally matching the existing house. Street side views of the proposed garage to be augmented with vegetation to enhance the street view of the completed new garage. Ancona, Jeanna From: Sent: Wednesday, February 15, 2017 4:49 PM To: Hayes, Patty Subject: Variance for garage 720 W. Linda Vista Blvd Please be informed that we formally object to a variance for a proposed garage @ 720 W Linda Vista Blvd. The variance would be in violation of the Rules and Regulations of the Oro Valley Country Club Estates Association Article 1 Paragraph 9 e: No structure shall be erected, altered, placed or permitted on said lots which exceeds in height sixteen (16) feet from the highest grade line immediately adjoining the foundation of the structure. We feel that this variance would be in violation of and detrimental to the "view protection" property rights for our home @ 750 W. Linda Vista Blvd. Oro Valley. Our home has a direct line of site to this proposed garage and would significantly affect the real estate value of our property. Attached please review photographs demonstrating our objection. Reasons for variance is we would like to build a detached garage that is taller than the house. The house height to the top of the roof is 10'x 6" and we would like the proposed garage height to be 17' x 2". The difference would be a slight 6' x 6" between the house and the proposed garage. The house being built in 1970 provides an unfair height restriction as compared to current residential building heights of 15' to 20'. The location of the existing septic system and (which was verified) would have been the logical location for the garage. This necessitated the garage to be located as per plan. 5 Question response i. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district. • To construct a garage that is 17' x 2" in height and will be matching to the existing house in materials and design, for truck, trailer, and personal car storage . Oro Valley restrictions state buildings must be of equal height to the existing house of 10' x 2" which does not accommodate our current vehicles. Have had some complaints about vehicles not being garaged. ii. That special circumstances were not created by the owner or applicant. Existing garage was enclosed and internally remodeled by the previous owners to create a habitable living area. It is not cost effective to reverse it to the original state due to size and width needed to accept the current truck heights/trailer and car. To accommodate our current needs the new garage needs to be 40 x 40 and 17' x 2" tall. iii. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights. New garage building will have a higher door opening of 12' to accommodate current truck with ladders and trailer. Truck, trailer, and personal cars will be secured inside of new garage building every night as vehicles are susceptible to rodent damage and are currently visible from the street. Having a garage to park our vehicles in is a necessity we believe to be an enjoyment of the property. - Co. , 1 Co. Page 1 of 2 a °¢4 BAN 18 201 4i N: ....................... iv.
