PUBLIC HEARING: DISCUSSION AND POSSIBLE ACTION ON A REQUEST FOR A CONDITIONAL USE PERMIT TO INSTALL AN OVERHEAD FIBER OPTIC CABLE LOCATED ON THE NORTH SIDE OF CALLE CONCORDIA, EAST SIDE OF CALLE BUENA VISTA, AND THE SOUTH SIDE OF HARDY ROAD RECOMMENDATION: The Planning and Zoning Commission recommends approval. EXECUTIVE SUMMARY: The purpose of this request is to consider a Conditional Use Permit (CUP) to install an overhead fiber optic cable on existing utility poles located in between the Canyon Del Oro High School and La Cafiada Drive. The new cable is intended to improve broadband services for local Amphi Schools. The applicant's request (Attachment 1) includes: Three-quarters of an inch (3/4) thick cable - Installed 12' above existing utility lines and between 17' 2' to 26' 1' above grade 8,132 linear feet of line attached to 35 existing utility poles located along 1) north side of Calle Concordia 2) east side of Calle Buena Vista and 3) south side of Hardy Road (Attachment 2) The Zoning Code requires applicants to obtain a CUP before Installation of new utility wires over 600' feet in length. The primary focus of the review is to ensure that the proposed overhead line does not significantly impact the existing views. On March 7, 2017, the Planning and Zoning Commission recommended approval of the request to the Town Council. BACKGROUND OR DETAILED INFORMATION: The applicant proposes to install a new overhead cable on 35 existing utility poles in the Town right-of-way. The utility poles are approximately 30-40 feet in height and contain several utility lines serving the area. The existing land uses, zoning for the site and the surrounding area are depicted in attachments 2 and 3, respectively. Aporovals to Date - 1974 and 1984: Annexation into the Town of Oro Valley Existing Site Details The subject property consists of multi -lane roadways with the following: 35 utility poles located in between CDO High School and La CaAada Drive 12 poles on north side of Calle Concordia 14 poles on east side of Calle Buena Vista 9 poles on south side of Hardy Road - Multiple above ground utility lines attached to existing utility poles Pr000sed Improvements Cable is approximately three-quarters (0.77) of an inch thick http://agenda.orovalleyaz.gov:8085/print ag memo.cfxn?seq=2232&rev num=0&mode=... 03/15/2017 Print Council Communication Page 2 of 2 10 • Installed 12" above existing utility lines and between 17' 2" to 26' 1" above grade • 8,132 linear feet of line attached to 35 existing utility poles Review Criteria The application was reviewed utilizing the policies established by the General Plan, Zoning Code, and Conditional Use Permit criteria. The overarching goal of the review criteria is to ensure the project is reviewed for compatibility and safety. A key objective expressed in the Zoning Code is to ensure the utility lines do not significantly impact views and are placed underground when appropriate. Given that the lines and poles are pre-existing and the views of the Catalina Mountains will not be substantially diminished, this objective is satisfied. A detailed analysis of the proposed overhead cable is provided in the Planning and Zoning Commission staff report (Attachment 4). Public Participation Notice to the public was provided consistent with Town -adopted noticing procedures, which included the following: • Letter to all property owners within 600 feet • Posting at Town Hall • All registered HOAs A neighborhood meeting was held on February 28, 2017, with two residents in attendance. The main topics discussed at the meeting included project cost, construction dates, other local jurisdictional approvals, and existing poles and wires. A copy of the neighborhood meeting summary is provided as Attachment 5. No additional correspondence has been received by staff. Planning and Zoning Commission Action The request was considered by the Planning and Zoning Commission at the March 7, 2017 meeting. No members of the public spoke in regard to the request. The Planning and Zoning Commission recommends approval of the proposed overhead cable, finding that the request satisfies the General Plan, Zoning Code and Conditional Use Permit review criteria. FISCAL IMPACT: N/A SUGGESTED MOTION: I MOVE to approve the Conditional Use Permit to install an overhead fiber optic cable based on the finding that the proposal is consistent with the General Plan and Conditional Use Permit review criteria. The proposed fiber optic cable is intended to improve broadband services for local Amphi Schools. The application (Attachment 1) includes stringing a line to 35 existing utility poles. The location map (Attachment 2) shows that the proposed overhead line will be installed along 1) north side of Calle Concordia 2) east side of Calle Buena Vista and 3) south side of Hardy Road. The Zoning Code requires applicants to obtain a CUP before installation of new utility wires over 600' feet in length. The primary focus of the review is to ensure that the proposed overhead line does not significantly impact the existing views. A CUP requires a recommendation by the Planning and Zoning Commission and a Town Council decision. BACKGROUND/DETAILED INFORMATION: The project site is the established right-of-way located within the Town boundaries. The existing land uses, and zoning for the site and the surrounding area are depicted in Attachments 2 and 3, respectively. CUP's may be granted based on consideration of the following criteria shown in italics, followed by staff commentary: That the granting of such conditional use permit will not be materially detrimental to public health, safety, or welfare. In arriving at this determination, the factors which shall be considered shall include the following: 1. Damage or nuisance arising from noise, smoke, odor, dust, vibration or illumination; The proposed fiber optic cable does not create noise, smoke, odor, dust, vibration or illumination. 2. Hazard to persons and property from possible explosion, contamination, fire or flood, The proposed cable line does not produce explosions or cause fire or flood. 3. Hazard occasioned by unusual volume or character of traffic. The proposed cable line does not increase or affect the volume of traffic in the area. 4. That the characteristics of the proposed use are reasonably compatible with the types of use permitted in the surrounding area and sufficient mitigation measures are employed to minimize impact on adjoining properties. OV1700311 Amphi Overhead Fiber Optic Cable Planning and Zoning Commission Staff Report Page 3 of 5 The proposed fiber optic cable is compatible with the surrounding area because it blends in with several overhead lines found on the existing utility poles. Photo simulations of the proposed fiber optic cable are provided in Attachment 4. 5. That the proposed use is consistent with the goals and policies of the General Plan. The proposed cable blends in with the existing utility lines and therefore is consistent with the applicable goals and policies of the general plan related to view preservation and utility services. The following is staffs analysis of the applicant's request with the applicable goals and policies in italics, followed by staff commentary. • Policy SD.6. Protect scenic corridors, public park and trail view sheds, and the distinctive visual character and visual appeal of Oro Valley. • Policy 1.2. Consider aesthetics and visual impacts of utilities and infrastructure during the planning, design or upgrade process, to the extent reasonably possible. The addition of this one line will not create a discernable impact on the existing views of the Catalina Mountains to the east. It is worth noting that most of the adjacent properties (e.g., homes along Calle Concordia and Hardy Road) do not have an easterly view of the Catalina Mountains, and those with an easterly view have limited visibility of the proposed line because their homes are at least 200-plus feet away from the project site. Policy 1.1. Accommodate community services and utilities that meet the larger community needs and goals. • Policy 1.5. Provide opportunities for high -quality telecommunication and broadband services to be located within the Town in order to support economic development, residential and business needs and community -wide goals. The proposed fiber optic cable is intended to improve broadband services for local Amphi Schools. 6. That the hours of operation of the proposed use will not adversely impact neighboring properties. The criterion is not applicable to an overhead line. In summary, the applicant's proposal is consistent with the Conditional Use Permit evaluation criteria. A detailed Zoning Code analysis about standards specific to the CUP requirements for utility wires is in Attachment 5. Engineering The Engineering Division does not have concerns with the proposal. OV1700311 Amphi Overhead Fiber Optic Cable Planning and Zoning Commission Staff Report PUBLIC PARTICIPATION: Summary of Public Notice Page 4 of 5 Notice to the public was provided consistent with Town -adopted noticing procedures, which includes the following: • Letter to all property owners within 600 feet • Posting at Town Hall • All registered HOAs Neighborhood Meetings This report was drafted before the February 28, 2017, neighborhood meeting. The planning staff will provide the Planning and Zoning Commission with a neighborhood meeting summary at their March 7 meeting. RECOMMENDATION: Based on the following findings: • The proposed fiber optic cable will not be materially detrimental to the public health, safety or welfare. • The proposed cable line is consistent with the Conditional Use Permit Review Criteria and Zoning Code requirements for utility lines. • The proposal will not be visually impactful as it will utilize existing utility poles which contain a number of similar lines. It is recommended that the Planning and Zoning Commission take the following action: Recommend approval to the Town Council of the requested Conditional Use Permit OV1700311. SUGGESTED MOTIONS: I move to recommend approval of the Conditional Use Permit to allow the Amphi School District to install a fiber optic cable on the existing utility poles located on the north side of Calle Concordia, east side Calle Buena Vista, and the south side of Hardy Road, based on the finding that the proposal is consistent with the Conditional Use Permit Review Criteria. m move to recommend denial of the Conditional Use Permit to allow the Amphi School District to install a fiber optic cable on the existing utility poles located on the north side of Calle Concordia, east side Calle Buena Vista, and the south side of Hardy Road, finding that OV1700311 Amphi Overhead Fiber Optic Cable Planning and Zoning Commission Staff Report ATTACHMENTS: 1. These provisions provide guidance for evaluating new overhead lines. The following is staffs analysis of the applicants request with the criteria in italics, followed by staff commentary. 1. The location and height of such poles and wires and the relation to the present or potential roads. There are no new poles installed with the proposed new cable line. The cable will be attached to existing poles which are located in the right-of-way outside of the paved road as shown in Attachments 1 and 2. 2. The crossing of such lines over much traveled highways and streets. The proposed fiber optic cable will cross over Calle Concordia to the south and Hardy Road to the west, similar to other overhead lines on the existing poles. 3. Proximity of such lines to schools, religious institutions and other places where people . may congregate. The proposed fiber optic cable will be installed along 1) the east and south property lines of the CDO High School (Calle Concordia) 2) the south property lines of both the Oro Valley Church of the Nazarene and the Pusch Ridge Christian Church (Calle Concordia) and 3) the north property line of the Sheperd of the Hills Lutheran Church (Hardy Road). The proposed cable should not create a discernable impact to the surrounding area because it blends in with the existing utility lines and poles. 4. Fire or other accidental hazards from the presence of such poles and wires and the effect, if any, of the same upon the effectiveness of firefighting equipment. The applicant states a minor amount of electricity flows through the cable line. 5. The availability of a suitable right-of-way installation. The existing right-of-way provides adequate space for installation and the Town will ensure the applicant uses prescribed traffic safety measures during installation. 6. Future conditions which may be reasonably anticipated in the area in view of a normal course of development If the existing utility poles were required to be relocated due to future road projects, it would be the applicant's responsibility to arrange to move the line onto new poles. The Town would assume no costs for the relocation. 7. The type of terrain. The area where the cable will be attached to existing poles is relatively flat and does not pose any type of challenges to the proposed installation. 8. The practicality and feasibility of underground installation of such poles and wires with the due regard for the comparative costs between underground and over ground installations (provided, however, that a mere showing that an underground installation shall cost more than an over ground installation shall not, in itself, necessarily require issuance of a permit). The applicant states that cost of the proposed overhead work is approximately $36,505 and the estimated costs to install the cable underground would be $124,129. Installing this one section of cable line underground would be inconsistent with the overall project for the area. 9. In the event such poles and wires are for the sole purpose of carrying electricity or power or for transmitting of telephone, telegraph, or television communication through or beyond the Town's boundaries or from one major facility to another, the practicality or feasibility of alternative or other routes shall also be considered. This 5,132-foot section of line is a small part of an overall larger project that travels several miles through Pima County and into Oro Valley. The applicant states this is the best route for the new line since the poles are already existing. ivililIextm ilIll2==0 WI1[01ov_\:A_ Neighborhood Meeting Summary Amphi Overhead Fiber Optic Cable February 28, 2017 6:00 — 7:30 PM Council Chambers 1.
