Williams, AICP, Planning Division Manager From: Patty Hayes, Senior Planning Technician Re: Minor Plat Amendment to revise the side yard setback for Lot 17 in Naranja Ranch I, Parcel number 224-08-0200, Case number OV1213-11 Date: June 20, 2013 Applicant's Request: The applicant proposes reduce the side yard setback along the south property line from 10' to 7'. Zoning Conformance: As set forth in the Standard Operating Procedure (SOP) #24, the Planning and Zoning Administrator has the discretion to determine if the applicant's proposal is a minor amendment. If it is determined to be a minor amendment to the plat, it may be approved administratively. Minor Change Criteria: • meets all code requirements and plat/plan notes; • for plats, no increase in the number of lots, or for plans, less than a 10% increase in floor area of any single building and overall; • not controversial; • no increase in negative impacts on neighboring properties, sensitive lands, or views; and • approved by the neighborhood association, if appropriate. Summary: The subdivision, Naranja Ranch 1, is located in an R4 zoning district which is a Townhome Residential District that allows party walls. The subdivision was built with single family detached homes on large lots. The R4 zoning district does not require side yard setbacks; however the final plat for Naranja Ranch 1 requires a 10' side yard setback. A setback variance application to alter the general notes of a final plat is not a viable option for the homeowner since the Zoning Code does not require side yard setbacks for the R4 zoning district. Property owners adjacent to the subject lot were mailed notices of the applicant's intent to reduce the side yard setback from 10' to 7. No objections were filed with the Town within the time provided in the notice. Planning and Zoning Administrator's Decision: Applicant's request to amend the side yard setback on Lot 17, Naranja Ranch 1 is approved by the Planning and Zoning Administrator. 1., \ _ , AZ l- avid A. In order to authorize a variance request, the Board will be searching for sufficient evidence in accordance with the findings. Please answer the questions below in a narrative format 1. Are there special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district? 2. Are there special circumstances that exist that are not self imposed or created by the owner/applicant? 3. Is the authorizing of the variance necessary for the preservation and enjoyment of substantial property rights? 4. If granted, will the variance impose such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? 5. If granted, will the variance be the minimum necessary to afford relief and will not materially affect the health, safety, and welfare of the neighborhood or surrounding properties. CONTINUATION PAGE: SUPPLEMENTAL QUESTIONS FOR APPLICATION FOR A VARIANCE Re: Johnson Residence, Lot 17, Naranja Ranch 1. 1. The layout of this house was customized for a previous owner. The lay -out pushes the Master Bedroom area to the South side of the house, and the other bedrooms along the north side (See the attached Existing Floor Plan of Johnson Residence). The purpose of constructing an addition is to provide the Johnsons with some much needed storage space, and a home office. We investigated various alternate schemes to provide more storage space, but the optimal design we found is to build an addition off the Master Bedroom at the South side, to provide closet space, and an office for Mr. Johnson. Since this was a customized home, these issues do not apply to other homes in the district. The proposed addition to the South side of the house would replace an existing walled dog yard. The existing 5 ft. high wall of the dog yard is located 3'-8" from the South property line. The South wall of proposed addition would be located 7'-3" from the South property line, providing more open space between the Johnsons house and their neighbor. The Johnsons have discussed the design of the addition with Don and Karen Chatfield, the neighbors to the South, and they are in total support of the Johnsons' application. 2. Yes, see above. 3. Yes, the granting of the variance to allow the construction of the addition would substantially improve the quality of life for the Johnson family. The house presently does not provide enough storage for the Johnsons. They recently had a baby, and plan to have other children. The house presently does not provide adequate closet space in the Master Bedroom, nor space for storage. Eugene Johnson often works at home, and presently his office is set up in what would be a child's bedroom. The proposed addition provides space for both an Office for Eugene with a small storage room, and a large closet off the Master Bedroom. With the construction of the addition, the Johnsons feel this house would suit their family for years to come. 4. The need for the variance is unique to the Johnsons' house layout and their family needs. 5. We are requesting only a 3 foot change in the size of the side yard setback, from 10 ft. to 7 ft., and only for a length of 33 ft. along the South property line of 253.25 ft. This does not negatively affect the health, safety and welfare of the neighborhood. As previously stated, by removing the existing dog yard and its surrounding wall, we are providing more open space between the Johnsons' house and the neighbors to the South. Date APR 2 2 2013 StjAature q • i APPLICATION FOR A MINOR PLAT AMENDMENT Re: Johnson Residence, Lot 17, Naranja Ranch 1. 1. The existing house was built centered on the lot, with 17'-3" of distance to both the North and South property lines from the exterior walls of the house. With the required io ft. side yard setback, that leaves only 7'-3" of width for an addition to either the South or North side of the house. The layout of this house was customized for a previous owner. The existing lay -out pushes the Master Bedroom area to the South side of the house, and the other bedrooms along the north side. The purpose of constructing an addition is to provide us with some much needed storage space, and a home office. We investigated various alternate schemes to provide more storage space, but the optimal design we found is to build an addition off the Master Bedroom at the South side, to provide closet space, and an office for myself. Given the limitations of 7'-3" of width to the South, we felt our only solution was to ask for a side yard minor plat amendment to build a io'-o" wide addition, to create a home office and storage areas. The proposed addition to the South side of the house would replace an existing walled dog yard. The existing 5 ft. high wall of the dog yard is located 3'-8" from the South property line. The South wall of proposed addition would be located 7'-3" from the South property line, providing more open space between our house and our neighbor. We have discussed the design of the addition with Don and Karen Chatfield, the neighbors to the South, and they are in total support of our application. 2. As you may recall, my lot is in an R-4 Zone, which is a "Townhouse" zone, and there are no side yard setbacks. The side yard setback was created when the subdivision was created, and the side yard and other restrictions are recorded on the Subdivision Plat. Usually the Subdivision Plat matches the zoning requirements, but in our case they did not match. Patty and Chad's reading of the situation is that I do not need a zoning variance, but instead I would need to obtain a "minor Plat amendment" for my lot. 3. The granting of a minor plat amendment to allow the construction of the addition would substantially improve the quality of life for my family. The house presently does not provide enough storage for us. We recently had a baby, and plan to have other children. The house presently does not provide adequate closet space in the Master Bedroom, nor space for storage. I often work at home, and presently my office is set up in what would be a child's bedroom. The proposed addition provides space for both an Office for me with a small storage room, and a large closet off the Master Bedroom. With the construction of the addition, we feel this house would suit our family for years to come. 4. We are requesting only a 3 foot change in the size of the side yard setback, from io ft. to 7 ft., and only for a length of 33 ft. along the South property line of 253.25 ft. This does not negatively affect the health, safety and welfare of the neighborhood. As previously stated, by removing the existing dog yard and its surrounding wall, we are providing more open space between my house and the neighbors to the South. 11313 N Placita Alameda Dorada Zoning Variance OV1013-02 Engineering Comments, 1st Submittal David Laws, P.E.
