Location: 9860 North Calle Solano SUMMARY: The applicant, Mr. and Mrs. Stout, proposes to enclose their existing carport into a garage and extend the enclosed garage into the front yard setback. The property is located in an R1-36 zoning district which requires a 30' front yard setback. The proposed garage will extend into the 30' front yard setback by 4'. BACKGROUND: Existing Site Conditions • The property is .83 of an acre which contains a detached single-family home landscaped with native vegetation. Proposed Improvements • Enclose carport into a garage with 4' of the garage extending into the front yard setback. Related Approvals • Rancho Feliz subdivision approved in 1979 • Annexed by the Town of Oro Valley in 1989 The existing zoning for the property and the surrounding area is R1-36 and is developed as a single family detached subdivision. OV 1013-03 Stout Variance Board of Adjustment Staff Report ANALYSIS: Page 2 of 3 The subject lot contains a 1,500 square foot home and two car carport built in 1981. The proposed project will enclose the existing carport into a garage which will provide space for a workshop area and parking for two full size pickup trucks. The proposed garage will extend 12' in front of the house toward the front lot line. Four (4) feet of the enclosed garage is proposed to extend into the 30' front yard setback thus reducing the front yard setback to 26'. There is an additional 7' of land from the edge of the pavement to the front lot line as shown in Attachment 2. This will allow for 33' of driveway length with the proposed garage. FINDINGS OF FACT: The right-of-way width for Calle Solano, a public street, is 40' with only 25' of pavement. Homes in the area include a variety of attached and detached open carports and enclosed garages. Many of the homes near the subject property are built 40' to 50' away from their front lot line as shown in Attachment 3. DISCUSION: The Board of Adjustment should consider the following findings in making its decision for each variance request: 1. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; The applicant refers to the location of the house as originally being built too close to the front lot line without utilizing more of the yard in the rear portion of the lot. The applicant proposes to enclose the existing carport into a garage with enough space for their vehicles, a work bench and hobby equipment storage. 2. That special circumstances were not created by the owner or applicant; The applicant indicates that the home builder chose to build the home more forward on the lot without consideration for future expansion. As previously indicated, many of the homes are setback 40-50 feet from the front property line which can accommodate future expansions similar to the applicant's request. 3. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights, - The homeowners prefer to drive full size pickup trucks and wish to build a garage enclosure with enough depth to store these vehicles while also providing a workshop area. Their preference is to keep their hobby equipment and vehicles in a secured enclosed space. O'%;V13-03 Stout Variance Page 3 of 3 Bogard of Adjustment Staff Report 4. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; The applicant reiterates their desire to keep their vehicles in an enclosed secure garage. They prefer not to display their storage items in an open carport as is common in homes without garages. They have determined 30' is a length that will provide a functional garage space for their needs. 5. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. The applicant indicates that converting the open carport into an enclosed garage will enhance the neighborhood and not create safety problems. Their application states that they will have 26' of driveway remaining. With the 7' of unpaved right-of-way, the driveway space will be approximately 33' as shown on Attachment 2. The propertyis not located on a curve or near a street intersection so therefore the garage extension should not create a sight visibility problem for vehicles driving on Calle Solano. PUBLIC PARTICIPATION All property owners within 300 feet of the subject property were notified of this hearing by mail. The property is posted with a notice of hearing, was posted online at www.oroval[eVaz.gov and was advertised in the Daily Territorial. No inquires into this case were made at the time of this report. SUGGESTED MOTIONS: I move to approve OV1013-03, A Variance for a Front Yard Setback reduction from 30' to 26' based on the finding that the five criteria have been met. I move to deny OV1013-03, A Variance for a Front Yard Setback reduction from 30' to 26' based on the finding that the five criteria have not been met. ATTACHMENTS: 1. Applicant's Proposal 2.
