Zoning Variance
OV1013-04
Engineering Comments, 1st Submittal
Mike Todnem, P.E.
May 3, 2013
The Town of Oro Valley Permitting Division has no Engineering comments regarding
the proposed zoning variance. The rear yard setback has been reviewed to verify that
its reduction will not create a drainage issue. Verification of engineering code
requirements for items such as the conveyance of drainage along the addition will take
place during review of the Building/Grading Plan submittal for permit.

Board of Adjustment Staff Report
- J
CASE NUMBER: OV1013-04
MEETING DATE: May 28, 2013
AGENDA ITEM: 4
STAFF CONTACT: Patty Hayes, Zoning Plans Examiner
phayes _orovalleyaz.gov (520) 229-4819
Applicant: Richmond American Homes, Paula Hinman (520) 877-5085
Request: Rear yard setback reduction from 10' to 5'.
Location: 1078 West Redlands Drive
SUMMARY:
The property owner and home builder, Richmond American Homes, is requesting to
reduce the rear yard setback from 10' to 5' to build one of their model homes which
includes an attached covered rear patio.
BACKGROUND:
Existing Site Conditions
• The subject lot is currently vacant. The subdivision is a mass graded
development.
Proposed Improvements
• Build a 1,720 square foot home with a two car garage and covered rear patio.
Related Approvals
• Rancho Vistoso NH 10 Parcel S final plat approved in 2005
• Richmond American Models approved by CDRB July 2012
The existing zoning for the property and the surrounding area is Planned Area Development —
Medium Density Residential.
ANALYSIS:
The subdivision where the subject lot is located is a 215 lot development located north of
Moore Road and bisected by La Canada Drive. A majority of the homes were built by K.
OV 1013-04 Richmond Anum—an
Board of Adjustment Staff Report
Hovnanian, Great American Homes and Stone West Construction during the early years
of the subdivision. In 2012 Richmond American Homes obtained approval by the CDRB
to build eight (8) model homes on 65 of the remaining vacant lots. Model T16F was
approved as part of those models. The lot fit analysis submitted to CDRB for the
architectural review in 2012 listed lot 1 as not having enough length for their models. The
location of lot 1 is shown in Attachment 2.
FINDINGS OF FACT:
• Model T16F is 74' long and 35' wide.
• Lot 1 is 110' long along the west property line but starts to reduce in length because of
the front and rear lot line curve as shown in Attachment 4.
• The required front yard setback is 20' and side yard is 5'.
• The final plat for lot 1 requires the driveway to be placed near the west property line
away from the curve of the street as shown in Attachment 4. This required.driveway
location prevents flipping the layout of the home on the lot.
• The floor plan for this model is designed for the rear patio to provide shade over the
great room exit door.
• Model T16F is the smallest model plan on file at the Town for Richmond American
Homes.
DISCUSION:
The Board of Adjustment should consider the following findings in making its decision for
each variance request:
1. That there are special circumstances or conditions applying to the property referred to
in the application including its size, shape, topography, location or surroundings which
do not apply to other properties in the district;
The applicant states that their smallest model will not fit on this lot due to the curvature
of the lot. The curvature of the lot is unique to lot 1 when compared to other corner
lots located near street entries as shown in Attachment 3. Model T16F is the smallest
of the eight (8) models approved in this subdivision.
2. That special circumstances were not created by the owner or applicant;
The applicant refers to the dimensions and shape of the lot as the restricting factor for
building one of their models on lot 1. The unique shape of the lot is demonstrated in
Attachments 1 and 4. Most of the home and patio cover will comply with the rear yard
setback. Only a small portion of the patio cover will encroach into the required
setback due to the curvature of the road.
3. That the authorizing of the variance is necessary for the. preservation and enjoyment
of substantial property rights;
OV 1013-04 Richmond Am an
Board of Adjustment Staff Report
The applicant references compliance with the home owners association and Town
guidelines for building a single story home on the subject lot. The Rancho Vistoso
PAD requires single story homes on corner lots for Neighborhood 10.
4. That any variance granted imposes such conditions as will assure that the authorizing
of the adjustment shall not constitute a grant of special privileges inconsistent with the
limitations upon other properties in the vicinity and zone in which such property is
located;
The applicant states they are asking for no other variances and the setback reduction
would not be noticeable to the neighbors. There is an existing site wall around two
sides of the lot. Specifically the 5' to 6' site wall and mature landscaping provides
some screening of the area of the home that is the subject of this variance request.
5. That the authorizing of the variance will not be materially detrimental to persons
residing in the vicinity, to adjacent property, to the neighborhood or the public welfare
in general.
The applicant proposes to build their smallest model they have on file with the Town.
PUBLIC PARTICIPATION
All property owners within 300 feet of the subject property were notified of this hearing
by mail. The property is posted with a notice of hearing, was posted online at
www.orovalievaz.gov and was advertised in the Daily Territorial. To date, there have
been no objections to this case.
SUGGESTED MOTIONS:
I move to approve OV1013-04, a Variance to reduce the rear yard setback from 10' to 5'
based on the finding that the five criteria have been met.
•;
I move to deny OV1013-04, a Variance to reduce the rear yard setback from 10' to 5'
based on the finding that the five criteria have not been met.

SUPPLEMENTAL QUESTIONS FOR APPLICATION FOR A VARIANCE
Please provide the following information addressing 1 — 5 in the Findings from
Section 21.6 1 of the Oro Valley Zoning Code Revised (OVZCR). In order to
authorize a variance request, the Board will be searching for sufficient evidence in
accordance with the findings. Please answer the questions below in a narrative
format.
1. Are there special circumstances or conditions applying to the property referred
to in the application including its size, shape, topography, location or
surroundings which do not apply to other properties in the district?
Because of the curviture of the lot and the 10' rear setback, there is only
approximately 70' in length in which to build and our shortest plan within this
community is 74' in lenqth.
2. Are there special circumstances that exist that are not self imposed or created
by the owner/applicant?
Yes, the dimensions and shape that exist for this lot are different than the other
lots in the community due to it's location, a corner at the entry of the community.
3. Is the authorizing of the variance necessary for the preservation and
enjoyment of substantial property rights?
Yes, it will help us stay within both HOA and Town guidelines by placing a
single story on the lot, allowing a view for traffic entering and turning at the
corner and a view for existinq homeowners.
4. If granted, will the variance impose such conditions as will assure that the
authorizing of the adjustment shall not constitute a grant of special privileges
inconsistent with the limitations upon other properties in the vicinity and zone
in which such property is located?
Yes, other than entering the setbacks no other zoning/building variances
are being asked for and this variance may not be noticeable within the
community.
5. If granted, will the variance be the minimum necessary to afford relief and will
not materially affect the health, safety, and welfare of the neighborhood or
surrounding properties.
Yes, it allows us to maintain the visibility for traffic while still buildinq a home
on this lot.
