May 3, 2013 The Town of Oro Valley Permitting Division has reviewed the proposed variance for the modified rear setback. Engineering has the following condition of approval: The edge of the constructed metal ramada appears to extend to the edge of the wall and property line. This results in a change to the drainage characteristics of the site as rainwater runoff will now come off the roof and directly into the common area behind the subject property. Please provide verification from the HOA accepting this change which may result in additional maintenance resulting from potential erosion along the new roof edge. Verification of other code requirements will take place during review of the Building Plan submittal for permit. If you have any questions, please call David Laws at (520)229-4808. Building Permit Application Fire Code Review Comments — The documents submitted for permit review are in compliance with the fire code. Approved as noted: • The submittal is approved for the setback variance, but a full building permit is required to comply with the requirements of the associated building and fire codes. Please be aware that the construction of walls less than 5' from the property line will be required to meet the requirements of the 2006 International Residential Code (IRC) Section 302 (i.e. 1-hour fire rated construction with no openings and rated penetrations, projection limitations, etc). In addition, I will need a narration regarding the work that is being done under the patio cover in order to verify compliance with the International Fire Code (IFC) (i.e. use of a kiln, other gas fire appliances, other heat producing appliances, processes that produce dust or vapors, etc.)_ This is not intended to be an exhaustive listing of the items necessary for the building permit review, but is intended to aid the designer in some of the submittal requirements. It is suggested that an architect or engineer be consulted to aid in the preparation of the submittal documents to ensure compliance with the associated codes. U, Board of Adjustment Staff Report \ENDED 49p CASE NUMBER: MEETING DATE: AGENDA ITEM: STAFF CONTACT: Applicant: Request: Location: SUMMARY: OV 1013-05 May 28, 2013 5 Patty Hayes, Zoning Plans Examiner phayes a(.orovalle ay z.gov (520) 229-4819 Brian Beamish ( Rear yard setback reduction from 10' to 0' and to reduce the required minimum distance between buildings from 10' to 0'. 8335 North Verde Catalina Drive The property owner, Mr. Bemish, requests a rear yard setback reduction and a reduction of the minimum distance required between buildings in order to bring his built ramada into compliance with the Town's Zoning Codes. The property is located in an R1-144 zoning district that was built as a townhome subdivision. In an R1-144 zoning district the rear yard setback for a detached covered patio is 10' and the minimum distance required between buildings on the same lot is 10' when the structure is detached from the main house. The covered patio is not structurally attached to the main house as shown in the applicant's submittal Attachment 1. BACKGROUND: Existing Site Conditions • The subject property is the second townhome in a row of four (4) attached townhomes as shown on Attachment 2. Proposed Improvements • Build a 26' x 15' detached patio cover in the back yard. This patio cover was built prior to obtaining building permits and this variance request is the applicant's first step to bring the previously constructed rear patio cover into code compliance. Related Approvals • Verde Catalina Townhouses final plat approved in 1972 • Townhome built in 1973 Annexed by the Town of Oro Valley in 2003 The existing zoning for the property and the surrounding area is R1-144 and is developed as a townhome subdivision. OV 1013-05 Verde Catalina - Bemish Page 2 of 3 Board of Adjustment Staff Report ANALYSIS: The Verde Catalina Townhouse subdivision where the subject property is located was zoned SR by Pima County during its development in 1972. When a property is annexed into the Town the Town is required to translate the zoning into an equivalent zoning district. The Town's zoning equivalent to Pima County's SR district is R1-144. The R1- 144 zoning district primarily allows one home per 3.3 acres of property. The setback requirements for an R1-144 zoning district are a 50' front yard, 20' side yard and a 50' rear yard, 10' rear yard for covered patios and 10' between buildings. These types of zoning requirements do not fit into a Townhome development since townhomes are typically built with shared walls, smaller lots and zero foot setbacks for individual lots. FINDINGS OF FACT: • The subject lot is 40' x 85' in size which is a 3,400 square foot lot. • The existing house has 1,400 square feet of living space with a two car carport. • The rear yard space prior to the construction of this covered patio was 724 square feet of yard space. • The covered patio is 390 square feet is size which leaves 334 square feet of open yard space on the subject lot. DISCUSION: The Board of Adjustment should consider the following findings in making its decision for each variance request: 1. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; The applicant refers to the unusual zoning designation of the subdivision as not allowing for his covered patio. As discussed previously in this report, the zoning for Verde Catalina is R1-144 which is not designed for a townhome subdivision. 2. That special circumstances were not created by the owner or applicant, The subdivision was zoned Suburban Ranch (SR) in Pima County and later translated to R1-144 by the Town. 3. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; The applicant states that the reduced setbacks are the only way to allow the patio cover to remain so he can continue using the covered area. Without a setback reduction the covered patio does not comply with the R1-144 setback standards. OV 1013-05 Verde Catalina - Bemish Board of Adjustment Staff Report Page 3 of 3 4. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; The applicant mentions that the townhomes have shared walls and that a 0' setback is not unusual. Some of the properties appear to have attached covered patios added to the rear of the home, in violation of the R1-144 zoning setbacks. 5. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. The applicant states that the covered patio provides sun and rain protection for his kiln. Mr. Bemish has an Oro Valley Business license for a Type I Home Occupation which allows for the use of one kiln for his art studio. This covered patio is his preferred location of the kiln. PUBLIC PARTICIPATION All property owners within 300 feet of the subject property were notified of this hearing by mail. The property is posted with a notice of hearing, was posted online at www.orovalleyaz.gov and was advertised in the Daily Territorial. One neighbor voiced his objection to the variance at the time of this report. SUGGESTED MOTIONS: I move to approve OV1013-05, a Variance to reduce the rear yard setback from 10' to 0' and to reduce the minimum distance between buildings from 10' to 0' based on the finding that the five criteria have been met. •' I move to deny OV1013-05, a Variance to reduce the rear yard setback from 10' to 0' and to reduce the minimum distance between buildings from 10' to 0' based on the finding that the five criteria have not been met.
