I, Terri Powelson owner of 325 E. Four Horses Circle, along with my husband Mike Powelson
are hereby requesting an Oro Valley Zoning Variance on a rear setback of 7'0" to erect an
attached garage to our existing 1972 built Ranch Style home.
contacted Oro Valley prior to pouring a concrete slab for said garage and was informed of
their setback requirements over the phone. I was given the requirements of front 30', side 15',
rear 30' and thus poured our concrete slab according to stated requirements.
On April 9, 2013 we applied for a building permit with Oro Valley; we have passed all
requirements to obtain a permit to build with the exception of zoning. The town zoning
department has denied our plans as they are now stating their required setbacks are front 30',
side 15' rear 40'. Our current setbacks are 33'6" to surveyed rear property line. Subject property
Lot 84 Rancho Catalina Subdivision also backs a 15' utility easement 7'6" of our property and
7'6" of our neighbors property Lot 87 Rancho Catalina Subdivision.
Subject property sits on a 36,047 sq. ft. lot and we see no hardship to any surrounding
properties. If zoning variance of 7'0" is granted it shall not affect health, safety or welfare of
neighborhood or surrounding properties. If we are not granted a zoning variance of 7'0" we will be
forced to cut one corner of our garage off to allow for the 40' setback. This could affect property
value and will affect the physical appearance of our home. Should we choose a detached
accessory building we would move our garage the allowed 5' from our property line but would in
turn put our neighbors rear view directly into our rear garage which would dampen their property
value. We would like to preserve the flow and functionality of our property with an attached
garage to our existing home.
We have been provided misguided information in regards to Oro Valley zoning requirements
for attached and detached structures on subject property Lot 84 Rancho Catalina Subdivision. If
employees are unable to provide consistent and correct zoning information over the phone, at
their counter or on a user friendly website they should not be allowed to do so.
We continue to beautify our existing home and the added purposed attached garage for
storage and vehicles would continue this. If granted this 7'0" variance it will not grant any special
privileges and will be the minimum condition necessary to provide relief for our project to
commence as planned. Therefore, we are asking your review and approval of this requested
zoning variance.
Thank You,
Terri & Mike Powelson
