Raleigh Place Oro Valley, AZ 85737 OV1700049 Variance Jared, This letter is to formally close out the file for the variance request for 9450 N. Raleigh Place. The variance was withdrawn from the February 28th Board of Adjustment meeting per your request. The building attachment solution you and the Fire Marshall agreed to, eliminated the need for a variance. The new garage will have a structural attachment to the home which create one building and therefore eliminating the detached accessory building zoning standards. It was a pleasure working with you and we look forward to successful completion of your project. Please let me know if you have any additional questions or concerns. L OPOJ,ytEV g9O2 ♦ CAI., `..ycY► c Board of Adjustment Staff Report OW EO,g'I a CASE NUMBER: OV1700049 MEETING DATE: February 28, 2017 AGENDA ITEM: STAFF CONTACT: Patty Hayes, Senior Planning Technician Applicant: Jared Shaffer Request: Allow a detached garage to be built 25' closer to the front lot line than the main house. Location: 9450 N. Raleigh Place SUMMARY: The homeowner is requesting to build a garage on his property as shown in the application, Attachment 1. The garage would be built as a freestanding building, otherwise referred to as a detached garage. The detached garage is proposed to be placed approximately 25 feet in front of the main house as illustrated in Attachment 2. Zoning code section 23.6.A.3.b, requires that a detached accessory building, such as the proposed garage, not be located closer to the front property line than the main house. The purpose for this code requirement is to limit the location of detached accessory buildings to areas of less visibility such as beside or behind a house. In this specific case both the existing house and proposed detached garage are setback several hundred from the front lot line and will have nearly no view impact from the street. The area in front of the home was chosen as a suitable space for the proposed detached garage because the steep topography of the land and location of the existing house does not provide a buildable area behind or beside the home as the zoning code requires. Furthermore, the fire codes require the homeowner to build either a garage detached from the house due to lack of adequate water flow in the area or build an attached garage with new water lines for sprinklers and/or fire hydrants. In summary, the variance request meets many of the five findings but does not meet finding number one, special circumstances of the property. Although the steep topography and placement of the existing home creates challenges in locating the proposed garage, the situation could be resolved with new water lines to meet fire code requirements which would allow a garage to be attached to the house, thus eliminating the need for a variance. Based on the analysis provided in the discussion section of this report, staff recommends denial of the request unless the applicant can provide evidence that new water utilities cannot be installed due to lot constraints. OV1700049 Raleigh Place Variance Board of Adjustment Staff Report BACKGROUND: Existing Site Conditions • Property is located in the Rancho Verde subdivision (Attachment 3) • Lot size: 2.4 acres • Structures on the property include: o One-story home built in 1977 o Detached storage building built in 1977 o Detached carport built several years ago Related Approvals Page 2 of 6 Final plat was approved in 1971 while in Pima County and was originally zoned CR-1. Subdivision was annexed into the Town in 1984 and the zoning was translated to Oro Valley R1-43. The home and existing accessory structures were built prior to annexation. The existing land use and zoning for the subject site and surrounding properties: Location Zoning Land Use Subject site R1-43 Single family home, detached storage building and carport North Across Linda Vista Blvd, R1-43 Single Family Homes South R1-43 Single family Homes East R1-144 17 Vacant acres North/East R1-144 Water utility tank West R1-43 Single Family Homes DISCUSSION: State Law and the Oro Valley Zoning Code require the Board of Adjustment to determine that all of the following variance findings have been met in order to grant a variance. The required five findings are shown in italics below, followed by the applicant and staff comments in regards to the finding. The Applicant's complete findings are included in Attachment 1. 1. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; Applicant Comment: The applicant states the location of the house, utilities, including the septic system and the topography along with the shape of the lot does not leave a buildable area for a garage anywhere except the proposed location. Also, reference is made to the fire codes that will not allow the garage to be attached to the house due to lack of fire hydrants and sufficient water flow in the area. OV1700049 Raleigh Place Variance Board of Adjustment Staff Report Staff Comment: Page 3 of 6 The subject property is a long rectangular shaped lot generally larger than other lots located in the same subdivision. Although the lot is generally larger in size, it also contains a great deal of steep topography as demonstrated in Attachments 4 and 5. The existing home was placed on the highest flattest point of the property, several hundred feet from the front lot line which maximized the views and allowed the home to be built outside of areas of potential flooding. The remaining area of the lot behind and beside the house contains steep topography which also limits the space where a detached building would normally be built. One option most homeowners could use when considering this type of addition, would be to attach the garage to the house as most garages are commonly built. In this specific case, the garage is proposed to be built detached from the home as a result of fire code restrictions and lack of fire hydrants and low water flow in the area. Attaching a garage to this house would require the homeowner to install fire sprinklers throughout the existing home and the new garage or install a fire hydrant near the home. Installing the appropriate water lines to accommodate the fire requirements would require several hundred feet of enlarged water line. Building the garage detached from the home with the appropriate fire walls would alleviate the sprinkler or hydrant requirement. The lack of appropriate water flow on the property is not related to the topography and is not considered a special circumstance of the lot and therefore this finding is not met. 2. That special circumstances were not created by the owner or applicant; Applicant Comment: The applicant states that the topography, placement of the home and lack of sufficient fire hydrants and water lines in the area limit the structure type and location of the garage where he can build, as the challenges that were not created by himself. Staff Comment: The steep topography, washes and long narrow lot configuration limits building space to one area on the lot which is near where the current home is located. If the applicant was allowed to build the garage as an attached addition onto the home, then no variance would be needed since additions onto a home simply have to meet the standard front yard setback. However, the Fire Department will only allow a garage to be built on the property if it is detached from the house by at least 10' and built with special fire walls. The requirement to build the structure detached from the home triggered the code OV1700049 Raleigh Place Variance Board of Adjustment Staff Report Page 4 of 6 section that does not allow detached buildings in front of the main house, which has caused this variance request. The existing conditions of the lot and fire code requirements were not created by the owner, therefore this criteria has been met. 3. Variance is necessary for the preservation and enjoyment of substantial property rights; Applicant Comment: The homeowner states having an enclosed secured place to store his vehicles would enhance and preserve their use of the property. The exposed southern facing open carport is not providing protection from the weather or pack rats nor does is it provide safety from criminal activity. Staff Comment: Although many homes in the area contain carports, this property's carport is uniquely exposed to elements by being on top of a hill, therefore not providing much protection from the elements and none from the wildlife. An enclosed garage would greatly enhance the homeowner's enjoyment of the property in terms of safety and security. Allowing an enclosed garage on the property is important to the enjoyment of the property and is also a common feature in single family home development, therefore this criteria has been met. 4. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located, Applicant Comment: The applicant refers to many detached structures commonly found in his subdivision, some of which are used as garages and that asking to add another detached structure on his lot will not be out of place or a special privilege for the area. Staff Comment: The subdivision has many detached buildings used for various purposes. While many of the buildings are not closer to the front lot line than the main house, many of the other lots were built with the homes placed much closer to the front lot line, therefore allowing detached garages and other accessory buildings to be built beside or behind the house. This is not the case with the subject lot. The placement of the house on the subject lot is set back much further than other homes in the area therefore only leaving space for additions in front of the house. OV1700049 Raleigh Place Variance Board of Adjustment Staff Report Page 5 of 6 Garages, either detached or attached, are common in many single family home developments and is not a special privilege, therefore this criteria has been met. 5. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. Applicant Comment: The applicant provided explanation about how the existing properties are situation and how the proposed garage would not interfere with the views of those homes. The large lots, vegetation, topography and placement of existing homes and the proposed garage were considered when planning the structure location. Staff Comment: This property is unique as it is generally larger than adjacent lots which means that adjacent homes are located significantly farther away and also obstructed by large hills and mature vegetation. The home and the existing detached storage building on the property cannot be seen from the street and cannot be seen by most other properties. The proposed garage should not have a visible impact to the area. The unique location and topography of this lot and the neighbor's lots would allow a garage to be built without negative impacts to the surrounding area, therefore this criteria has been met. PUBLIC PARTICIPATION Public Notice has been provided as follows: • Notice sent to all property owners within 300 feet of the subject properties. • Notice posted on the property. • Notice posted online at www.orovallevaz.gov • Notice advertised in the Daily Territorial. • Staff has received no comments regarding this request. STAFF RECOMMENDATION In summary, the variance request meets many of the five findings but does not meet finding number one, special circumstances of the property. OV1700049 Raleigh Place Variance Board of Adjustment Staff Report SUGGESTED MOTIONS: Page 6 of 6 I move to approve OV1700049 a variance to allow a detached garage to be placed 25' feet closer to the front lot line than the main house, based on the finding that the five criteria have been met. NO I move to deny OV1700049, a variance to allow a detached garage closer to the front lot line than the main house, based on the finding that the five criteria have not been met. ATTACHMENTS: 1. Attached in the following packet are the contents requested for consideration of a variance in reference to the zoning requirement that my proposed detached garage plans (Permit #131602787) are in violation of. The setback of the proposed detached garage construction is closer to the frontline of my property than the house is as defined by Oro Valley Zoning Code 23.5.C.1.c "for flag' lots, the driveway, or'pole,'portion of the lot shall not be used to satisfy front setback requirements. The front setback shall be measured within the area the flag' portion of the lot closest to any public or private street. " The property front line and topography of the land make meeting this code difficult based on multiple circumstances describe within the packet. I appreciate the time and consideration in reviewing this proposal for the variance and am hopeful this can be resolved in order for my family's early spring project to get kicked off. 044 IWIDAW9 1.3 VARIANCE- SUBMITTAL CHECKLIST All applications for a Variance must include the following materials to be accepted for processing: ❑ Fees ❑ A completed General Application Form, ❑ A Site Plan- 8.5"x.11" or 1.1" x 177, (6 copies) ❑ Narrative (6 copies) ❑ All items in Section 2.0 of this Process Guide. In order to authorize the Variance request, the Board will be searching for sufficient evidence in accordance with the follow findings: i. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district. ii. That special circumstances were not created by the owner or applicant. iii. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights. iv. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? v. That the authorizing of the variance be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. In your submittal, provide the list of questions above with specific responses to each question. 11 4.. The Town of Oro Valley acknowledges that private covenants, conditions, and restrictions (CC&R's) agreements exist between property owners in many homeowners associations: Nothing in Section 25.2.C. of the Town of Oro Valley Zoning Code shall be interpreted to void the provisions of those agreements. 12 ,? JAN 09 1011 GI 1. See attached packet for requested attachments. a. Aerial photo b. Site Plan BY: ... i ................... 2. Requesting a variance be considered to the zoning standard that my project (detached garage) currently doesn't meet. The SE corner of the detached garage is approximately 51' feet closer to the front on my lot line than the nearest corner of the original structure. The natural topography of the property and awkward shape of the lot, present several barriers in order to satisfy the zoning restriction. The house is not parallel to the front line of the lot, rather nearly perpendicular. There is no other part of the property this detached garage fits without incurring additional significant financial burden, to simply erect a garage on my property. 3. i. The orientation of the house and the front line of the property render only the west side of the house as being available to meet the zoning requirement, a couple of major issues is that there is not adequate space to fit the structure on the west side and the topography challenges are even more challenging. Additionally, all of the utilities enter the property from that side and would need to be relocated. The driveway would need to redirected with additional surveys required to not disturb the natural drainage of the of the wash running at the base of the driveway. The topography of the property is not forgiving and this was taken into consideration when deciding on the placement of the structure. The current topography where the NW corner of the detached structure will go is nearly four feet higher than the SE corner and moving the detached garage any further north would put the structure over the edge of a steep slope leading down to Linda Vista Rd. The shape of the property in relation to the orientation of the house presents a challenge, as spatially the eastern side of the house is the only cardinal direction that has enough semi -level foundation to place the new detached structure. This is complicated by the angle of what is being considered the frontline of the property. Due to the orientation and angle of the line, any point east of the original structure will violate the zoning restriction, which is the purpose of this variance approval application. Attaching the structure to the house would require the entire structure to have a fire suppression system installed throughout the new addition as well as the original structure. The current 400ft water line running from the main to the point of entry into the house would need to be upgraded to the appropriate diameter to achieve the water pressure necessary. Unfortunately, there is only one fire hydrant in the subdivision, which is nearly 1800 feet away. Per the Golder Ranch Fire Chief, there were no immediate plans from the city of Oro Valley to install these hydrants. In light of these limitations, the Fire Marshall and I negotiated to separate the house and detached garage by approximately 10 feet and installing a one -hour rated firewall on the side that faces the house. ii. None of the current obstacles described above were created by me, the owner of the property. According to the Golder Ranch Fire Chief there are many neighborhoods throughout the Golder Ranch District and that while much of my property presents challenges, not having a fire hydrant within the required distance was not unique. He stated the lack of the hydrants is a big issue. The topography of the land, while sometimes is a nuisance during monsoon season, it is the reason I was drawn to the property in the first place and I work hard not to disturb that natural elevations that mother nature has carved. The home was originally built in 1977 and my wife and I are only the second owners. My guess is that they, like me, faced several challenges in orienting the house to maximize the property while navigating its unforgiving topography. Honestly, I'm not sure that if the tables were turned to me in 1977 that I would have oriented it any other way. The house is set at the perfect angle to maximize the views of the property. iii. As a homebuyer in 2010, it was not apparent this property needed a garage, but overtime living on the property it became clear that having an enclosed structure would ease anxiety of several D-1% 1100D'i9 things. We are at the crest of a hill overlooking CDO wash and the town of Oro Valley, during monsoon season, winds are unobstructed and have caused damage to our vehicles. Additionally, vehicles left outside are magnets for desert rodents (pack rats) to find shelter in during some of the winter months. Over the past two years there have been a couple of cars in the neighborhood broken into, both times in residences with car ports and not garages. By allowing this variance to occur would definitely increase the ability to enjoy the property and to some extent the security of it. iv. Our sub division is a large lot sub -division as well as zoned for horses, thus detached buildings from the main home are common. My neighbors to the west have to detached building as stables for their horses. Throughout the neighborhood there is a pretty even split of detached garages and storage sheds as there are attached additions. By allowing the variance, it would not seem out of place when strolling through the neighborhood. The original owners built a detached shed sometime after the home was built and prior to the implementation of the zoning requirement. While I can understand the intent of the requirement, in close quartered smaller parcel sizes, one of the benefits of having large lots it to be able to expand building for the enjoyment of the property and to improve the overall value of the property. The design style of the garage as compared to the adobe structure of the house will pair well. We are planning exterior upgrades to the east facing side of the house to allow for an even more welcoming feel to our property. This addition would serve as a great improvement to this property. v. Considering the location of my house is nearly 400 feet from the cul-de-sac an even further from the location of my immediate neighbors to the south, the granting of this variance would have no impact on their enjoyment of their property. The topography of the land renders the eastern view ideal towards the mountains, thus my southern neighbors view of the mountains will remain unobstructed. The topography of the land as it pertains to my western neighbors, only allows them to see the tip of the western facing side of my house. There is a section of 22 acres between my property and the closest residence to the east, but my property is not visible from their driveway due to the plush desert flora. The properties to the North are nearly 50-80 feet below the elevation my residence is at, thus it will not be visible until you are nearly two city blocks into that neighborhood. If any view is in jeopardy it would be the view from any easterly facing window from our house on the southern half of the house. This is something that my wife and I discussed at length, either way attached or detached we'd face the same. loss and we both felt the pros outweighed the cons as our entire North facing view is well of 180 degrees of spectacular views. w U Q r.Ln V w J ry NOTES: 1) THIS IS NOT A BOUNDARY SURVEY.
