TC Regular Session Date: 06/02/2010 Requested by: Paul Popelka, Acting Planning and Zoning Director Submitted By: David Ronquillo, Planning and Zoning Department: Planning and Zoning Information SUBJECT: OV1205-23C Approval of a one year time extension for the Bighorn Commerce Center development plan to May 20, 2011. Property is located on the northeast corner of Oracle Road and Rams Field Pass. SUMMARY: The applicant is requesting a one-year extension of the development plan for this commercial project of retail and restaurant uses. The development plan was originally approved in 2006 and was envisioned to be developed in two phases. To date, there has been no development of the site. The development plan expired May 20, 2010. • 2005: Town Council approved rezoning from Technological Park to C-1 • 2006: Town Council approved development plan • 2007: Town Council approved development plan extension • 2008: Town Council approved development plan extension • 2009: Town Council approved development plan extension DISCUSSION: Per the Oro valley Zoning Code Revised (OVZCR) Section 22.9 F 8 b, if improvements have not been started within two years of the date of approval of the development plan, the plan shall be deemed to have been abandoned. A request to extend the time beyond two years must be submitted in writing to the Town Council within two years of the date of approval. This development plan has been extended each year since its original expiration in 2007. There is no limit on the number of extensions that may be granted to a development project. The applicant requested the extension in advance of the expiration date. Current economic conditions, including a challenging commercial credit market, have delayed this and other projects in the area. The Public Works Department has approved improvement plans for the project and construction will commence as market conditions improve. FISCAL IMPACT: None CONCLUSION/RECOMMENDATION: The development plan meets all applicable OVZCR requirements and there have been no recent OVZCR changes that would impose additional standards on the plan. Staff recommends approval of a one-year development plan extension to May 20, 2011. SUGGESTED MOTION: The Town Council may wish to consider one of the following motions: I move to [approve, approve with conditions or deny] OV1205-23C, BigHorn Commerce Center development plan extension to May 20, 2011. La Canada Drive Oro Valley, Arizona 85737 OV12-05-23 , Robert Solfisburg, representing BigHorn Commerce Center LLC, requests a twelve month extension for the Development Plan of Bighorn Commerce Center located at North Oracle Road and Rams Field Pass. Mr. Mayor and Council: The owners of Bighorn Commerce LLC request a 12 month extension of the above referenced Development Plan and allow additional time to complete financing reguirements and tenant negotiations. The overall economic climate is causing tenants and commercial users to delay decisions. I remain hopeful this changes in the near term. Thank you for your support. The following comments are to be addressed and are meant to protect the public's health, safety, and general welfare: 1. DRAINAGE A drainage report was previously prepared and approved for the Big Horn Commerce Center under Oro Valley project number OV12-05-23. The originally approved drainage report was prepared by JE Fuller Hydrology & Geomorphology, Inc., stamped 11/16/2005. - A drainage report addendum shall be required to substantiate the proposed Phase 1 design. A scoping meeting can be arranged with The Town of Oro Valley prior to preparing the drainage report if the engineer desires. The drainage report shall address the following: a. The drainage report addendum shall outline what portions of the drainage improvements will be constructed with Phase 1 of this project. It is to provide back up information and calculations to support proposed phasing (e.g., decreased detention, revised watersheds, etc). b. The drainage report addendum shall describe how the proposed site will function in the interim condition. It must clearly demonstrate how stormwater will be conveyed and contained within intended areas if only a portion of the originally approved drainage improvements (e.g., flood wall along ADOT R/W, detention basin, etc) are constructed. c. Within the improvement plans, show the 100-yr peak flow values at all points of concentration and all points where drainage enters or exits the site. d. The applicant has indicated that this project will propose a minor land division to split this development from the remainder of the commercial center.
