Dear Mr. Nodine:
This office represents Owners of Westward Look Guest Ranch No.
1, Inc., which is an Association of property owners who own townhomes within
Westward Look Guest Ranch No. 1. My client requested that I contact you
concerning the proposed re -zoning request made by Westward Look Guest
Ranch in conjunction with its request for annexation into the Town of Oro
Valley.
Generally, the Association does not have an objection to the
annexation of this property. However, I want to bring to your attention the
Notice of Enforcement of Agreement Restricting Use of Property recorded on
November 13, 1984 in Docket 7408 at Page i310 which pertains to ail
agreement made by the resort as to the preservation of 23 acres of its property
as open space which can only be used for recreational purposes. I have
included a copy of that recorded document with this letter.
My client needs assurances from the Town that annexation of the
resort property into the Town of Oro Valley will not, in any manner, invalidate
this agreement. Since the Town will be the successor in interest to Pima
County and Pima County recorded this notice to ensure that the terms of the
agreement would be public information, my client is fearful that the resort may
be seeking annexation in an effort to negate this agreement and in an attempt
to try to develop this property. My client would strongly object to any such
development.

NOTICE OF ENFORCEMENT OF AGREEMENT
RESTRICTING USE OF PROPERTY
WHEREAS Pima County, Arizona, a body politic and corporate, has
in its possession a copy of a document entitled Agreement of Settlement
and Compromise, executed April 17, 1.972 (hereinafter r(-forrpd to as
"the 1972 Agreement") entered into by and between Westward Lvok
Development Company, Inc., an Arizona corporation ("Westward Look"),
A. Dryden Eberhart and. Wilholmina K. Eberhart, huriband and wife, I,otti:
Fuhn and Edith Fuhn, husband and rife, Pima County,.nnd the Board of
Supervisors of Pima County, relating to restrictions to be placed on
the property indicated on the map which is attached to this Notice as
Exhibit A;
WHEREAS the 1972 Agreement was entered into in settlement of a
lawsuit in the Superior Court of Pima County, Arizona, cause number
127778, said litigation arising as the result of the rezoning of
property then owned by Westward Look situated on the northwest corner
of Ina Road and Christie Drive in Tucson, Pima County, Arizona;
WHEREAS the rezoning matter referred to above is commonly known
as Pima County Planning and Zoning Commission file number C09-70-70,
Westward Look -Ina Road Rezoning;
WHEREAS the 1972 Agreement has been relied upon by all successors
in interest to Westward Look from 1972 to the present date for purposes
of property tax valuation;
WHEREAS, in conformance with the 1972 Agreement, no development
has been undertaken on the subject property by Westward Look or the

successors in interest of Westward Look;
WHEREAS Pima County, being the body charged with enforcing zoning
within the boundaries of Pima County, Arizona, desires to make the
zoning and use status of the subject property clear both to subsequent
purchasers of the property and to neighboring property owners,
NOW THEREFORE Pima County gives notice to the public that the
following is a verbatim r.Ppetition of the terms of the 1972 Agreement:
AGREEMENT OF SETTLEMENT AND COMPROMISE
THIS AGREEMENT, entered into by and between WESTWARD
LOOK DEVELOPMENT CO., INC., an Arizona corporation, herein-
after designated WESTWARD LOOK; A. DRYDEN EBERHART and
WILHELMINA K. EBERHART, husband and wife, hereinafter called
EBERHART; LOUIS 'FURN and EDITH FUHN, husband and wife,
hereinafter called FUHN; PIMA COUNTY, a Body Politic,
hereinafter called PIMA COUNTY; and THE BOARD OF SUPERVISORS
OF PIMA COUNTY, hereinafter called BOARD OF. SUPERVISORS;
W I T N E S S E T H:
WHEREAS, EBERHART and FUHN were heretofore plaintiffs
and the remaining parties hereto were defendants in Pima
County Cause No. 127778, viz., litigation which arose
because of the rezoning of WESTWARD LOOK property situated
on the Northwest corner of Ina Road and Christy Drive, 245
East Ina Road, Tucson, Pima County, Arizona; and
WHEREAS, said rezoning matter is known commonly as
Planning and Zoning Commission File No. Co-9-70-70, Westward
Look -Ina Road; and
WHEREAS, in said matter, the WESTWARD LOOK property in
question was rezoned from CR-1 to CR-4, which rezoning was
sought to be rescinded in Pima County Cause No. 127778; and
WHEREAS, Cause No. 127778 came on regularly for trial
before the HONORABLE .TACK G. MARKS, Judge of the Superior
Court of Pima County, on Tuesday, March 14, 1972; and the
proceedings having normally commenced, evidence having been
adduced, testimony given and various legal arguments made to
the Court; and
WHEREAS, ARTHUR M. SIMS and EDITH SIMS, husband and
wife, having been by mutual agreement, with the parties
hereto, dismissed as plaintiffs in said litigation] and

WHEREAS, FREDERICK . SCHAUSS and ADELE SCHAi1SS, husband
and wife, having been dismissed as parties plaintiff in said
litigation, supra, over their objection, by virtue of a
Court Order declaring that said parties lacked standipg as
plaintiffs by reason of the Court declaring that the. THERMAL
BELT AREA PLAN was nugatory, having been illegally adopted;
and the Court further deciding that if said THERMAL DELI
AREA PLAN were nugatory, then and in that invent, the said
plaintiffs SCHAUSS were not within -an atom that gave thom
standing, they likewise not being within three hundred (300)
feet of the WESTWARD LOOK property in question; and
WHEREAS, the remaining parties plaintiff, 1EBERHART and
FU11N, and WESTWARD LOOK, PIMA COUNTY and THE HOARD OF
SUPERVISORS, being desirous of composing their differences
in this matter;
NOW, THF.RL',FORE, in consideration of the: foregoing and
of the mutual covenants herein contained,
IT IS AGREED AS FOLLOWS:
1. That WESTWARD LOOK may construct one hundred
thirty-two'(132) condominium units on the 37.1 acree horato-
fore rezoned CR-4 by the [BOARD OF SUPERVISORS.
2. That TESTWARD LOOK may construct not more than two
hundred (200) hotel Bluest units on the land presently zoned
CR-1, where WESTWARD LOOK heretofore has constructed approx-
imately seventy (70j of such units.
3. That WESTWARD LOOK does hereby covenant and promise
-.to. keep the. remaining twenty-three (23) acres of land,
heretofore intended to be. used as a golf course, as open
space, .usable. only for recreational purposes, with no
-habitable buildings constructed thereupon,. Ay separate
document, extrinsic to this Agreement, WESTWARD LOOK will
implement this provision by a covenant that shall run with
the land for:,_ ninety-nine (99) years with respect to said
twenty-three (23) acres.
4. The Counterclaim filed by WESTWARD LOOK in Pima
County Cause No. 127778 shall he forthwith dismissed an to
EI313RHART and FUHN.
5. WESTWARD LOOK agrees to operate its business on the
property, which was originally known as a Guest Ranch or. a
Resort, in full And strict compliance with the laws, statutes,
rules and regulations in such cases made and provided.
6. The. condominiums, supra, shall not exceed four (4)
units per single structure.
7. WESTWARD LOOK will forthwith pay to EBERHART and
FUHN the sum of TWO THOUSAND TWO HU14DRED SIXTY-NINE ($2 , 2fi9. 00)
DOLLARS, representing an. agreed -upon amount of compensation
for costs and attorney fees incurred in connection with Case
No. 127778.

S. This Agreement shall be binding upon the heirs,
executors, administrators, assigns and successors in interest
of the parties hereto.
9. This Agreement shall be severable in its parts and
if any provision is deemed nugatory and ineffectual by
virtue of being contrary to law or public policy, then and
in that event, the remaining provisions shall be in full
force and effect.
IN WITNESS WHEREOF, the parties have affixed their
signatures this 17th day of April , 1972.

Hearing regarding the Westward Look Resort Translational Zoning
Dear Neighbor,
On July 20, 1 sent you a letter informing you that the Town was considering the
annexation of the Westward Look Resort property. The letter also noted, as a
follow-up to a notice we sent you, that if the annexation of Westward Look is
successful, the zoning would be translated from Pima County zoning to the
equivalent Oro Valley zoning.
The translational zoning was scheduled for consideration and recommendation
by the Planning and Zoning Commission on August 2. However, we have
rescheduled the translation to be presented to the Commission after the
annexation is complete. Accordingly, the August 2 public hearing before the
Planning and Zoning Commission has been cancelled.
