enjoyment of substantial property rights?

5. If granted, will the variance be the minimum necessary to afford relief and will
not materially affect the health, safety, and welfare of the neighborhood or

NATURE OF REQUEST:
We are requesting a zoning variance for a shade structure for an RV that is 11
inches taller (at the highest; a total of 11 feet, 11 inches at the tallest and it slopes to 10
feet, 8 inches) than our home (which is 11 feet tall) and 20 feet closer to the front
property line than the house. The house is 195 feet from the front property line and the
shade structure 175 feet. We also plan to use a portion of the shade structure for eating
out doors picnic -style.
1) Lot 67 of Suffolk Hills is located on 1.75 acres on a secluded cul de sac. It is one
of the largest properties in the subdivision and it features easements on all sides, a wash
on one side and a house that is set far back on the property. The size of the property
means that even a large shade structure will not be close to any property line of our
neighbors. Both the wash and the easements increase privacy on the property and reduce
proximity of the shade structure to neighboring properties. Placing the shade structure
near the wash would be detrimental to the wildlife as they utilize the wash as a corridor
for movement in the neighborhood. The property slopes upwards from the wash to the
southeast where it abuts our neighbors' properties. The difference in elevation also
makes placement of the shade structure further back on the property difficult as it would
potentially block views of our neighbors.
2) There was an existing, leveled parking area to one side of the house. This is
where the shade structure is located. The southeastern side of the property slopes upward
towards our neighbors who live on Chelsea Ct, Cambridge Dr & Sussex Ct. Placement
of the shade structure over the current, leveled area does provides the least disruption to
our neighbors' views of the Catalina Mountains. As the shade structure is also slightly
higher than the house to accommodate an RV, this is especially important.
3) Suffolk Hills is well known for its unaltered, natural desert surroundings. Most
houses do not have landscaped yards. As is demonstrated in every Suffolk Hills
newsletter, residents enjoy bobcats, javelina, coyotes, Harris hawks, and other abundant
forms of wildlife that live in the natural desert surroundings and have made their home in
this area. We see even more wildlife than many of our neighbors due to the wash that
provides a corridor along which animals travel. Building the shade structure anywhere
but over the current parking area would require destroying natural vegetation that
includes trees, saguaros and other cacti as well as rabbit and quail habitats. The intention
of the current location is to minimize change to the current landscape. Also, in this
location, the height of the shade structure is the least obtrusive to our neighbors and
ourselves, especially in regards to mountain views. As can be seen in the aerial
photograph, there is a retaining wall directly behind the house with an area of slightly
thinned -out vegetation. Building the shade structure here would completely destroy the
mountain views from our house. Also in the photograph, there is a cement slab. The
shade structure cannot be built over this as it is not large enough to accommodate an RV
and a leisure area together. We plan to utilize the cement slab for a small hobby
workshop in the future.
4) There are over a dozen detached shade structures (and more garages) of varying
heights in the Suffolk Hills subdivision. Some of them appear to be closer to the front
property line than the houses to which they belong.
5) Both the shade structure and the house are well removed from the front property
line and the shade structure is not easily viewable from the front property line due to
trees. (Please refer to the photograph as reference). If removed further from the front
property line than the house, the shade structure would then be at a slightly higher
elevation and it would require not only clearing natural desert, but a road to lead to it.
Also, this placement further back would potentially obstruct the views of our neighbors
(they are at a slightly higher elevation). The height of 11 feet 11 inches allows room for
an RV while providing a slight grade to the roof (sloping to 10 feet 8 inches at the back,
which is lower than the house height) to allow for draining of rain.

Hello Rosevelt,
Thank you for all of your time this afternoon. I will be revising my application to include more
information on questions 2, 3 & 4 that I hope will clarify my answers. I look forward to receiving the
documents/ other information you will send. I know I need to reread the questions so that I can properly
address them in detail with regards to what we discussed this afternoon.
I think that it might be best to ask for a continuance. While I feel confident that I can formulate more in-
depth answers shortly, I feel that I will need more time to research and prepare a presentation. Thank
you!

Hillary,
Thank you for the response. You may want to add an addendum to your application
stating why the carport shouldn't be attached to the main house. Please note that I
would need this addendum by 5 pm Thursday, November 8tn
I discussed the distance issue with my staff and we have determined that our main
focus will be on how far the carport projects in front of the house versus how far each
structure is from the front property line. As a result, we do not need you to re -measure
the buildings.

Hello Rosevelt,
Thank you for the email. I see where the suggestion was to have it as an
addition to the house. There is an enclosed, brick -walled area there currently
with artificial grass. As a family, we spend a lot of time in that area. We have
a mountain view and our kids play out there at least once a day. When we are
outside of the house, we let the kids play as we can keep a close eye on them
(there are lots of snakes, scorpions and other poisonous creatures in this area),
but mostly they play in the enclosed area as it is safe for them to play at will
without supervision. I personally exercise in the enclosure daily. Is this
something that I should bring up or add to the application?
I will remeasure the heights for the house. Have you had any word as to
whether we should attempt to remeasure the distance from the front property
line to the shade structure? Please let me know and I will immediately attempt
a remeasure. Thank you!

Hillary,
The above application has been scheduled for the Nov. 26th Board of
Adjustment meeting. Please attend this meeting and be prepared to
discuss your request.
Per our conversation, please review the attached map and verify the
existing distances and height of the accessory building. Please note that
the blue rectangle represents an attached accessory building, and the
yellow rectangle represents the current location (approximate).
If you have any questions, please contact me.
