RE: Rear yard variance request for Stone Canyon lot 166, 1055 W. Tortolita Mountain Circle, OV1015-
03
Dear Mr. McMahon,
Thank you for submitting the application for a rear yard setback variance at the property referenced
above.
The Planning Division has had the opportunity to review your request with the standards of the Rancho
Vistoso PAD and the Town's Zoning Code (ZC). The ZC section 23.5.C.1.e. provides setback
measurement standards for irregular shaped lots. Lot 166 is an irregularly shaped lot therefore this
section of the code can be applied to define the rear and side yard setbacks. The rear yard setback
would be measured from the rear lot line, which as an irregularly shaped lot, the rear lot line is a line at
least 10' long and parallel and most distance from the front lot line. Therefore the rear yard setback
would be measured from that line. I have included a hand sketch of how this applies to lot 166. Please
note the sketch is for illustrative purposes and is not drawn to scale.
Staff has determined that a rear yard setback variance is not needed for this lot. The request for a
variance has been cancelled. You may proceed with submitting a building and/or grading plan for the
home. Please ensure the site plan reflects the setbacks as discussed in this letter and reference the
code section shown in this letter for irregular shaped lots.
A full refund of your Board of Adjustment submittal fee will be returned to you soon.
Please contact me if you have any questions or concerns.
Sincerely,,
r:

iii. Authorizing the variance will preserve my clients' substantial property rights by maintaining their view of
Pusch Ridge while allowing them to enjoy the flood plain and its mature vegetation
iv. We do not feel a granted variance will constitute special privileges inconsistent with the limitations on the
property because the design of the house and patio walls intentionally creates a "saw tooth" pattern that will
hopefully create interest along its south elevation where the encroachment is being proposed.
v. We do not feel the granted variance will be materially detrimental because the parapet wall of the
encroaching portion of the house is only 13'-0" tall and, since it is set within the limits of a small
topographical depression, it will not likely interfere with views to and from other adjacent properties.
Thank you for considering our variance request. We look forward to answering any questions you may have.
Respectfully,

the proposed zoning variance. The rear yard has been reviewed to verify that is
reduction will not create a drainage issue. Verification of engineering code requirements

The general nature of the variance request being made on the subject property is due to the lot's irregular shape
and the existence of a flood plain easement. The lot's "wedge" shape results in its tapering to a point at its eastern
end where the rear and front property lines converge to form a point. As the lot "opens" toward the west, the
buildable area on the lot is further limited by the existence of flood plain easement that takes up approximately 35%
of the lot's buildable area.
At the lot's logical building location, there is approximately 100', running approximately north to south, available for
the placement of the house. It is along this axis the client desires to maintain a view toward Pusch Ridge by
orienting the living spaces toward that east -facing view. There is also a good amount of well -developed vegetation
along the flood plain easement my client would like to preserve.
My clients have requested the design of a relatively small, 2,973 square foot, home for this property. And though
the home's limited footprint does barely fit into the 100' north/south dimension, a problem occurs with the placement
and orientation of the driveway. Specifically, the subdivision's requirement of a 16' maximum driveway width within
the 30' front yard setback does not provide enough room to maneuver a vehicle to access the garage.
Please keep in mind, my client does not want to orient the driveway in an east/west fashion along the boundary of
the flood plain easement because they believe it will only serve to damage the vegetation as well as add more
concrete to the driveway.
After several hours of schematic design and design development with my clients, we feel the least obtrusive way to
orient the house toward the view, while limiting the negative effects of a large driveway is to make this variance
request to allow the home's southern -most corner intrude into the 40' rear yard setback a total of 11'-4", reducing
the setback to 28'-8". While this solution will result in the minimum amount of driveway concrete and disruption to
the flood plain vegetation, it projects only 70 square feet of the home into the 40' setback. Incidentally, the home's
southern fagade has been designed in a "stepped" fashion to increase the interest along this elevation.
This solution allows my clients to preserve the two most important reasons for their purchase of this lot; accessibility
to the Pusch Ridge view and the preservation of the vegetation adjacent to the flood plain easement.
My clients and I do not feel the approval of this variance and the resulting 1 V-4" encroachment into the rear building
setback will constitute the granting of special privileges inconsistent with limitations on other properties. The
home's footprint is relatively small and has an efficient layout with little wasted space. And though there is a pool
and patio area, there are no additional functions that might otherwise be considered opulent. Nor would the
granting of this variance seem to detrimentally affect persons residing in the vicinity since there are no homes
located directly south of the property where the encroachment is proposed.
