Town of Oro Valley Development Review Division 11000 N. La Canada Drive Oro Valley, AZ 85737 Re: OV12-05-17, Revision 1 to the Paving and Grading Plans for The Shoppes At Oracle Road T and T Engineering LLC Job # 060014-01-53 Dear David; Attached you will find a revision to the above referenced project. We have revised the alignment of the proposed channel north of the cross section call out for detail E/4 (see clouded area). The reason for this requested revision is to accommodate the existing structures off site to the east of this project. There is an existing fence, pool deck and pool equipment situated on the property line between these two parcels. The existing structures sit on a high point relative to the surrounding area. In an effort to avoid compromising the integrity of the existing structure we are proposing to shift the channel approximately 9' to the west. This has the effect of leaving a horizontal distance of 9' between the top of the proposed channel and the existing structures. I met with Jim Evanoff of Pattison/Evanoff, LLC in the field in regards to this matter. We both agreed that this was the best course of action for this situation. I have also added some inlet scuppers at two locations along the east top of bank of the channel to allow the off site drainage to enter the channel rather than undermine it as it had done to the previous channel. This issue was not addressed in the approved Drainage Report, but I feel it is necessary to. I have obtained a Type I grading permit from Pima County for the more southerly one and have obtained verbal consent from the property owner for the more northerly one. Please let me know what other supporting documentation you will require to facilitate these revisions and feel free to call our office with any questions or concerns. Sincerely, Thomas E. In accordance with the ORO VALLEY COMPREHENSIVE ZONING CODE (CZC) May 2005: SEC. 26.3-E.2, the technical accuracy and conformance to the current minimum design standards and requirements of the TOWN OF ORO VALLEY, and other applicable standards are the responsibility of the design engineer. A Type 2 grading permit is required for this project. There are two (2) conditions that must be met and will be tied to the Grading Permit. The conditions are as follows: 1) Design the section of sidewalk as a "ramp" at the top of the southern sidewalk ramp located at the top of Turnout I on Sheet #2. An alternative would be to lower the sidewalk proposed spot elevation of 32.50 to decrease the adjacent sidewalk grade to less than 5.0% eliminating a "ramp" design. 2) Reinstate the Cross -Sections E1-EI and E2-E2 on the Figure 3: Onsite Drainage Plan due to these cross -sections still being addressed in both the Drainage Report's "Proposed Conditions Drainage Design" on Sheet 4 and Sheet 5 and within the Figure 3: Onsite Drainage Plan. Similarly, Cross -Section E4-E4 is still being addressed in the Drainage Report and not shown on the Figure 3 Plan. Refer to the redlined Fig. 3: Onsite Drainage Plan. I have attached a Type 2 permit application, an ADEQ NOI form, a Floodplain Use Permit, and a Type 2 grading permit checklist. A Type 2 grading permit checklist has been prepared to show you all items that are needed prior to issuance of a grading permit. Assurances are required for this project and they are: a restoration bond, a landscape bond and construction bond. It is important that the bond estimate is submitted as soon as possible so that the bond amount can be established. Please refer to Sec. 26.6 of the CZC May 2005 for items that must be included in the bond estimates. If not already completed, submit the estimate to our Development Coordinator, Shirley Gay. If you wish to contact her regarding the assurances her phone number is 229-4849. A pre -grading meeting will be set when we have all of the items required by the Type 2 grading permit checklist. The outcome of the meeting will be the issuance of the grading permit. Please bring the permit and review fees to the meeting so that there will be no delay on issuing the permit. Arizona law currently provides that "satisfactory evidence of identity" for proposes of a notary's acknowledging signatures or performing jurats includes a "current form of identification issued by a federal, state or tribal government...." (A.R.S. 41 311.11.) Effective August 25, 2004, however. this provision has been amended to provided thar the current form of identification must be issued by "the United States government or a state or tribal government... " This change means that a current form of identification issued by a foreign government, such as a foreign driver's license, will NOT meet the statutory identification requirements. To avoid delays in closing transactions involving foreign citizens who may not have appropriate identification, you should determine as soon as possible what form(s) of identification your clients have. If dwy do not have appropriate identification, then you may wish to suggest, depending on their circumstances, that they apply for and obtain an appropriate form of U.S. or state identification. Alternatively, the Arizona notary statutes allow the following manner of identification: The oath or affirmation of a credible person who personally knows the individual and who (1) is personally known to the notary or (2) provides satisfactory evidence of hisftr own identity. 1 Jun-I5-2005 04:5Tpe From -Title Security Atency, Was Adobe +520T425666 T-T47 P.010/011 F-3T0 Exhibit A (Parcel ), -. Oracle Road Scenic Corridor Overlay District (ORSCOD) Development within the Oracle Road Scenic Corridor District shall be regulated by the provisions of this Section and the requirements of the Oro Valley Zoning Code Revised (OVZCR), including underlying district(s) and PADS, except that in the event of a conflict, the more restrictive shall prevail. The proposed site falls within the Oracle Road Scenic Corridor Overlay District (ORSCOD) and all development standards from ORSCOD shall apply. The following requirements are noteworthy: a) Oracle Road District Development Standards • Section 24.5 D 1 d: "Except for clearing necessary to provide utilities and access to the site, no significant vegetation shall be removed within a distance of 100 feet from the dedicated right-of-way line of Oracle Road without prior Development Review Board approval. No development, other than additional landscaping, is permitted within this 100 foot zone. " TOWN OF ORO VALLEY UNCIL Significant vegetation is located within forty feet (40') of the frontage along Oracle Road. The applicant is proposing that forty feet (40') of frontage be left undisturbed along Oracle Road, and the remaining sixty feet (60') be utilized for parking spaces. Additional landscaping, walls and berms, and pedestrian pathways are proposed to be located within the undisturbed zone, except in areas where significant vegetation exists, for further screening along Oracle Road. If areas of significant vegetation are to be mitigated, the ratios for mitigation shall be as set forth in the OVZCR Table 27-1. This requirement is listed in the Development Plan General Notes as #32. • Section 24.5 E 3 a: "Access to Oracle Road. Direct access to Oracle Road is to be spaced a minimum of 330 feet on center, except as hereinafter required or modified by Specific Plan variance. " The Development Plan meets this Commercial Development requirement of ORSCOD. The access drives are spaced 330 feet apart along Oracle Road. b) Setbacks and Maximum Building Height • Section 24.5 E 3 b: "Required Setbacks. Setback standards of the applicable zoning district classification are applied, except as provided below: i. "Front setback for multiple structure development: Average 120 feet. " =e Development Plan meets this Commercial Development requirement of ORSCOD. The average front setback for the multiple structure development in the proposed commercial complex is one hundred and thirty feet (130'). • Section 24.5 E 3 b iii. "Side setback distances of the applicable zoning district are to be provided. " According to Section 23.8 B 1 b i, the C-1 side setbacks are "50 feet where the lot abuts a single-family residential district or abuts an alley that is adjacent to the single-family residential district." The proposed development exceeds this standard, as the northern most proposed building pad is located two hundred and twenty (220') feet away from the adjacent single family residential district to the north. • Section 24.5 E 3 e ii: "The remaining buildable area heights shall be limited to 25 feet. " As specified on the Tentative Development Plan, the proposed building heights would be limited from eighteen to twenty-five feet (18'-25'). The Development Plan meets this requirement. The bell towers shown on the Development Plan are permitted under the OVZCR Section 23.5 Measurements and Exceptions B 2 Height exceptions c Architectural Elements: "Within nonresidential districts, architectural elements such as bell towers may exceed this limitation. " The proposed towers are approximately forty-two feet (42') and thirty- eight feet (38') in height. c) Walls and Berms Section 24.5 3 a: "Berms shall be designed in a manner to have natural shape and appearance, complementary to the existing topography and shall comply with the requirements of the Ordinance. " TOWN OF ORO VALLEY AFF REPORT TO TOWN COUNCIL Pa e 4 The proposed berms are designed to appear natural and do comply with the requirements of the Ordinance. Additional landscaping, walls and berms, and pedestrian pathways are proposed to be located within the undisturbed Oracle Road frontage zone, except in areas where significant vegetation exists, for further, screening along Oracle Road. • Section 24.5 3 b: "Walls shall not exceed in length thirty-three percent (33 %) of the Oracle Road frontage of each parcel. The Development Plan meets this wall specification. The total for the wall segments equals thirty-one percent (31 %). IL Section 25.1 Odor Abatement The new component of the OVZCR is Section 25.1 A 6 Odor Abatement plan. This plan is required for all restaurants and manufacturing uses at the time of Development Plan submittal. The plan is subject to Development Review Board (DRB) review and Town Council approval. The odor abatement plan must contain the following elements: • An inventory of potential or identified odor emission point sources associated with the industry or land use; • A plan detailing best available control technologies and appurtenances designed to eliminate or achieve the maximum reduction of odor emission from an emission point source inclusive of, but not necessarily limited to certain processes, procedures or operating methods intended to mitigate or control odor; • A specification of the documentation that will be made available for Town review which will verify the data produced by the monitoring equipment, and which will verify that processes and procedures are conducted consistent with the specifications in the facility's odor control study and plan; • A schedule for the implementation and installation of the control technologies, appurtenances and monitoring instrumentation; and • An acknowledgment of the authority of the Town and/or County and its agents to enter into the facility and its property to investigate complaints and to verify the facility's adherence to the compliance plan. At this time, the tenant of proposed restaurant is unknown. The applicant has submitted an odor abatement plan for a general restaurant use. The current odor abatement plan does not address the above listed concerns, as the proposed use is as of yet undetermined. Building permit plans will be submitted when the tenant for the restaurant space is known. At that time, a more specific odor abatement plan shall be submitted (see Condition #1 of Exhibit "A"). III. Lighting. Concerns • While Section 27.5 addresses outdoor lighting requirements per the OVZCR, additional lighting concerns need to be addressed in order to mitigate neighboring residential development concerns. n order to achieve compatibility with the adjacent residential developments, the height of wall mounted lights r light poles shall be limited. Lighting elements shall be limited to the height of the five feet (5') screen wall running parallel to the rear facades of the buildings. This requirement is listed in the Development Plan General Notes as #34. TOWN OF ORO VALLEY T TO TOWN CO IV. Vehicular Parking PaLye 5 The required number of parking spaces for this development is 264. The provided number of parking spaces is 255 and is below the required parking spaces and the applicant requested that an "Alternative Parking Analysis" be approved by the Development Review Board. The proposed project is under -parked by 9 spaces or approximately 3.4%. The applicant proposes that the development will have less than anticipated usage for the Art galleries and studios than required under the General Retail category. Additionally, the applicant proposes that the General Office category would likely be closed prior to the peak demands for the adjoining Restaurant usage after 6:00pm, thereby making more parking spaces available for other uses. The proposed development will provide 96.6% of the required parking spaces as required by the OVZCR without reducing any mobility -impaired parking spaces or bicycle parking requirements. The Development Review Board approved the "Alternative Parking Analysis" as apart of their motion to recommend approval to Town Council. V. OVZCR Design Guidelines: a) ORSCOD Design Guidelines Commercial Development Guidelines Section 24.5 F 4 a is "Rear and side setbacks adjacent to residential districts shall include berms or walls with heavy landscaping augmenting such opaque screening to a height of not less than eight (8) feet. " The intent of the Tentative Development Plan was to have a continuous overlapping tree canopy along the rear building for screening purposes. The proposed Development Plan meets this intent through the use of a continuous tree canopy, dense understory vegetation, and a screen wall. The screen wall varies in height from five feet (5') to eight feet (8'). The wall height varies due to additional screening for loading zones along the rear of the buildings. A staggered height provides functional screening and interrupts the potential monotony of a tall and horizontal wall. Furthermore, a densely vegetated buffer yard continues along the western side of the wall in the side setbacks of the proposed Development Plan. As shown on the attached aerial photograph, there is an existing drainage channel running the length of the eastern portion of the property. This drainage channel provides a thirty-eight feet wide additional buffer distance from the adjacent residential development. The Development Plan meets this guideline of ORSCOD. b) Loading Zones • Addendum A 6 c: "Loading and service areas should be screened from public view. " Specifically, Addendum A 6 c ii: "Screen loading and service areas from the street and design as an integral part of the building architecture. " The Development Plan proposes to utilize loading zones located in to the rear of the buildings. Furthermore, these loading zones shall be screened by an eight foot (8') high screening wall and dense vegetation. Passenger drop-off zones and delivery drop-offs are proposed to be located in the front of the buildings. TOWN OF ORO VALLEY AFF REPORT TO T c) Pedestrian Sidewalks • Addendum A 6 f ii: "Design all parking areas to allow safe and attractive pedestrian circulation. " A meandering sidewalk along the frontage of Oracle Road was proposed; however, Arizona Department of Transportation (ADOT) is planning to install a pedestrian path along Oracle as part of the SR77 project. An in - lieu of fee may be utilized in place of requiring said meandering sidewalk along Oracle Road (Condition #2 in Exhibit "A"). • Section 24.5 F 4 b v: "Incorporation of natural elements such as boulders, native rock or designing to blend structures with natural washes or existing copses of vegetation is highly desirable. " The existing drainage channel will be rebuilt to accommodate the run-off associated with this site. The Development Plan includes a proposal to utilize thick grouted riprap and earth -tone colored concrete in the drainage channel to blend the drainage channel into the natural landscape. DRAINAGE: The off -site drainage to this site currently flows from east to west and is mostly captured in an existing channel leng the eastern property line and flows northward. The channel then turns to the west around the north end of e property and passes under Oracle Road through five existing box culverts. On -site flow is currently to the west where it is captured in an existing channel adjacent to Oracle Road and conveyed northward to the five box culverts. Developed conditions drainage patterns will remain the same for off -site flow with improvements to the existing channel along the east property line. The improvements will ensure complete capture of off -site flow and more efficient conveyance of flow to the existing box culverts. Developed on -site flow will be to the north for capture in a proposed detention basin at the north end of the property. First flush treatment will be provided as runoff enters the basin. The basin will then drain to the improved channel to the north and through the existing box culverts. On -site runoff will be routed through the basin to maintain flow rates at or less than pre developed -conditions. GRADING: A Type 2 Grading Permit will be required to construct the building pad, parking lot, drainage structures, and utilities. TRAFFIC: Access to the facility will be from two driveways off the northbound lane of Oracle Road. One access to the site will be located at the existing median opening on Oracle Road at Camino Greenfield. The second driveway, cated approximately 355 feet south of the Camino Greenfield driveway, will allow right -in, right -out movements only. In order to accommodate the anticipated traffic volume, the existing northbound and southbound left -turn lanes at the Oracle Road/Camino Greenfield intersection will be lengthened to 200 feet with a gap length of 140 feet. TOWN OF ORO VALLEY TO DEVELOPMENT REVIEW BOARD ACTION: At the special session held on December 19`h, 2005 at 6:00 pm. The Development Review Board motioned 5 to 1 to recommend approval of the Development Plan with the Conditions listed in Exhibit "A", with an additional condition added by the DRB members. The additional condition was to add as a General Note the following condition from the Rezoning cases, "Restrict the hours of left hand turns onto Oracle Road to off-peak morning and evening hours only". The applicants addressed this concern through the addition of General Note #34 (see Condition #3 of Exhibit "A"). The specifics of this rezoning condition are enforceable under the authority of the Arizona Department of Transportation (ADOT). Therefore, a condition has been added requiring that the applicant provide ADOT approval for the traffic mitigation measures regarding this Rezoning condition (see Condition #4 of Exhibit GENERAL PLAN COMPLIANCE: This proposed. project is held to the standards of the 1996 General Plan, as the project began prior to the adoption of the General Plan Update 2020. • Policy 3.1 M: "Specialty commercial development, similar to St. Phillips Plaza in Tucson, is encouraged in appropriate locations. " The proposed Development Plan proposes a design -oriented development concept. That is, the proposed uses for the development range from a restaurant, general retail, general office, and art galleries and studios. The applicant would like to encourage design -related professional firms to locate in the general office component of the complex. Additionally, the applicant would like to encourage that the art studios be utilized by artists or other designers, who in turn, utilize the art gallery as a place to show their work. • Policy 9.1 D: "All development proposals should attempt to arrange buildings, massing of buildings, and/or arrangements of lots to preserve views from adjacent properties and streets while providing privacy for residents. " Neighborhood compatibility is a key component of this proposed development. The proposed Development Plan utilizes the following mechanisms to mitigate the effects of a commercial development adjoining residential developments: • Building pads are arranged in such a manner as to preserving views to and from the site along Oracle Road; • Building heights are limited as to not block views from properties across Oracle Road; • Proposed uses as specified in the Rezoning cases are limited in additional to the C-1 Commercial District permitted uses in order to further accommodate neighborhood needs and desires; • A continuous tree canopy, dense understory vegetation, and a screen wall will further mitigate 'undesirable commercial development aspects; • The lighting along the rear facades of the buildings shall be limited in height to that of the screen wall running parallel to the buildings; • Dumpster location are both landscaped and screened to help with odor abetment issues; and TOWN OF ORO VALLEY COUNCIL Pate 8 • Views to and from the site are preserved and provide privacy for the neighboring residential developments. PUBLIC NOTIFICATION AND COMMENT: The surrounding property owners have been noticed in accordance with the Town notification requirements. To date, no comments have been received. DEVELOPMENT REVIEW BOARD ACTION: At the Development Review Board meeting held December 19`h, 2005, the Board voted 5-0 with the conditions listed in Exhibit A to forward the applicant's request to the Town Council. SUMMARY OF FACTORS: 1. The proposed development meets all applicable zoning code requirements. 2. Staff finds that the proposed development, with the conditions listed in Exhibit "A" of the Development Plan, would have no adverse impacts to the surrounding land uses. 3. Substantive conformance with the General Plan 1996. 4. Substantive conformance with all Design Guidelines. 5. Development Review Board recommended approval. 6. The channel then turns to the west around the north end of the property and passes under Oracle Road through five existing box culverts. On -site flow is currently to the west where it is captured in an existing channel adjacent to Oracle Road and conveyed northward to the five box culverts. . First flush treatment will be provided as runoff enters the basin The basin will then drain to the improved channel to the north and through the existing box culverts. The second driveway, located approximately 355 feet south of the Camino Greenfield driveway, will allow right -in, right -out movements only. In order to accommodate the anticipated traffic volume, the existing northbound and southbound left -turn lanes at the Oracle Road/Camino Greenfield intersection will be lengthened to 200 feet with a gap length of 140 feet. La Canada Drive Oro Valley, AZ 85737 RE: Shops at Oracle Road (OV12-05-17) Dear Fritz: This letter and the revised report attached with it are being provided to you in response to comments given in Exhibit A (copy attached). The response to those comments is as follows: 11. The detention basin design has been revised to show the minimum top -of -bank and the basin bottom elevations. These elevations are shown on several cross sections in Figure 3 of the report. The 6-inch bleeder pipe that drains the detention basin will be set at basin bottom elevation, so there will not be any retained storage within the basin (see cross section C-C on Figure 3). The detention basin design has been revised to include the first flush treatment at catch basins located in the pavement driveway. These catch basins adjoin the proposed inlet spillways and will consist of a City of Tucson Type IV catch basin (double) with filter inserts. A detail for these catch basins and first flush treatment filters is given on cross section A -A and Detail B, Figure 3, of the drainage report. 12. The existing 404 jurisdictional limits have been shown on Figures 3 as requested. 13. A cross section detail for each HEC-RAS cross section has not been provided. Instead, I have added a table to Figure 3 (Table 3) that provides the referenced elevation at each of the cross section locations. These elevations are shown on cross sections El -El through E3-E3 on Figure 3. 'Table 3 gives the corresponding elevation for each of the cross section locations. Table 3 includes the 100-year water surface elevations, freeboard, 100-year flow depth, and top -of -bank protection elevations for both sides of the wash. 14. The offsite 100-year runoff will not be contained within the trapezoidal bank protection along the reach defined by cross section El -El. At this location, the 100-year water surface elevation will overtop the left bank of the channel by depths Letter to Fritz Laos Page 2 January 18, 2006 ranging from 0.9 to 1.2 feet. The perimeter wall adjoining this reach of the channel will be solid grouted for a height of 2 feet above top -of -bank protection elevation to contain the flow and prevent it from breaking out into the project site. Cross section El -El will occur only along the southerly 120 feet of the proposed interceptor channel along the east property line. 15. Appendix dividers have been provided as requested. 16. The correct Figure number for the developed conditions drainage map is Figure 3. 17. A note stating that the grouted riprap will be earth tone has been added to Figure 3. The Oro Valley method has been used for all hydrologic computations as requested. 2. The discharge rates for the offsite watershed draining to CP-I and CP-2 have been determined using the HEC-1 model as required by the Town of Oro Valley method. The revised discharge rates are 1849 cfs and 1853 cfs for CP-1 and CP-2. These discharge rates are lower than the previously used results from the Upper Carmack Wash Study. Channel improvements are based on these discharge rates. The existing Oracle Road culverts are adequate to pass the 100-year discharge for CP-2 (see HEC-RAS model). 3. A discussion of first flush methods is provided in the drainage report. The placement of the Flo - Gard filter is shown on Detail A on Figure 3. 4. An HEC-RAS model has been prepared and is discussed in the drainage report. Water surface elevations decrease for post -project conditions (see Table 2 in revised drainage report). Cross- section locations are the same for pre- and post -project conditions. Limits of the channel modifications (where topography will change) are shown on Figure 3. existing and proposed water surface elevations are shown on Figure 3 and on Table 2 in the drainage report. Cross -Section E3 has been added to avoid using E2 twice. Previous E3 is now E4. 6. The drainage report has been revised to eliminate references to retention. The storage in the basin below the spillway elevation will be for first flush storage. This storm water will pass through a catch basin containing the Flo -Gard filter, then to a 24-inch outlet pipe to the channel along the north property line. Letter to Larry McGlone November 8, 2005 Page 2 7. The 404 jurisdictional limits are shown on Figure 2B as requested. If you have any questions please feel free to contact me at (520) 882-4244. The Oro Valley method has been used for all hydrologic computations as requested. 2. The discharge rates for the offsite watershed draining to CP-1 and CP-2 have been determined using the HEC-1 model as required by the Town of Oro Valley method. 5. Motion carried, 7 — 0. fr t k15_ TOWN OF ORO VALLEY 6 STAFF REPORT TO DEVELOPMENT REVIEW BOARD MEETING DATE: December 19, 2005 TO: DEVELOPMENT REVIEW BOARD FROM: Pamela J. Holt, Planner SUBJECT: OV12-05-17. LARRY MCGLONE. REPRESENTING SKYLINE RIDGE LLC REQUESTS APPROVAL OF THE DEVELOPMENT PLAN FOR A COMMERCIAL SITE TO BE KNOWN AS "THE SHOPPES AT ORACLE ROAD"; LOCATED AT 8600 N. ORACLE ROAD, JUST SOUTH OF HARDY ROAD; PARCEL # 225-13-005C AND PARCEL # 225-13-006B. BACKGROUND: The 6.22 acre site is currently undeveloped and designated C-1, Commercial District. The site is accessed off Oracle Road and southeast of Hardy Road. Each parcel was rezoned separately and approved by Town Council in May of 2001. Specific Rezoning conditions were applied to the approved Tentative Development Plan concept. These specific Rezoning conditions that are applicable are found in the General Notes section of the Tentative Development Plan. A few specific Rezoning conditions include: • Record a covenant to remove only that vegetation that is necessary for building pads and accessory uses and the necessary roads and driveways; and to salvage all healthy Palo Verde, Mesquite, Ironwood, Saguaros, and barrel cacti for on -site landscaping purposes; • The Oracle Road Scenic Corridor Overlay District (ORSCOD) shall apply to this development; • The following C-1 uses shall be prohibited: automotive parts store; furniture store; grocery store; hardware store; appliance repair store; clothes cleaning and Laundromats; clinic with urgent care facilities; motel or hotel; convenience uses; major communication facilities; car washes; car rental establishments; and auto detailing; and • Restrict the hours of left hand turns onto Oracle Road to off-peak morning and evening hours only. These rezoning conditions, as found in OV9-01-02 and OV9-01-03, along with the design concept associated with the Tentative Development Plan, have been applied to this Development Plan (see the attached Tentative Development Plan associated with the Rezoning cases: OV 9-01-02 and OV9-01-03). SUMMARY OF THE PROPOSED PROJECT: The proposal entails a commercial complex comprised of three separate buildings with a combined square footage of 52,455, with proposed uses ranging from a restaurant, general retail, general office, and art galleries and studios. The C-1 Commercial District is intended to provide for large scale office complexes and small indoor retail centers, located on a major arterial. The intent of this zoning district is to attain compatibility with adjoining residential neighborhoods, while satisfying commercial and service business needs of nearby neighborhoods. The proposed project meets the intent of the C-1 Commercial District through the use of the following elements: • Restaurant: 10,054 Square Feet, with outside patio; • General Retail: 10,888 Square Feet; • General Office: 7,800 Square Feet; • Art Galleries and Studios: 23,713 Square Feet; TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 2 of 9 • Passenger drop off area and loading zones; • Pedestrian connections within the site and to the adjacent properties; • Landscaped buffer yards and other mitigation elements to achieve compatibility with adjacent residential developments to the east. Surrounding Land Uses: North: R1-144; Single Family Residential; adjacent parcel is undeveloped vacant land. South: R-6; Multi -Family Residential; adjacent site is the Teen Challenge facility. West: R-4; Townhouse Residential; the complex is the Casitas Del Oro Vistas (directly across Ora Road from the site). East: R1-36; Single Family Residential; adjacent neighborhood is the Rancho Catalina Subdivisi and R-6, Multi -Family Residential is also adjacent to site; Sunnyslope Townhouses. DEVELOPMENT PLAN: Rezoning Compliance The proposed Development Plan addresses the Rezoning conditions through the use of General Notes. For example, the proposed uses for this development are listed ion General Note #2: "The existing zoning is C-1. The proposed use of this property is Business and Professional Offices, Retail Sales and Services subject to the Rezoning conditions found in Case numbers OV9-01-02 and OV9-01-03. OVZCR Compliance Oracle Road Scenic Corridor Overlay District (ORSCOD) Development within the Oracle Road Scenic Corridor District shall -be regulated by the provisions of this Section and the requirements of the Oro Valley Zoning Code Revised (OVZCR), including underlying district(s) and PADS, except that in the event of a conflict, the more restrictive shall prevail. The proposed site falls within the Oracle Road Scenic Corridor Overlay District (ORSCOD) and all development standards from ORSCOD shall apply. Oracle Road District Development Standards and Guidelines ORSCOD Standards • Section 24.5 D 1 d: "Except for clearing necessary to provide utilities and access to the site, no significant vegetation shall be removed within a distance of 100 feet from the dedicated right-of-way line of Oracle Road without prior Development Review Board approval. No development, other than additional landscaping, is permitted within this 100 foot zone. " Significant vegetation is located within forty feet (40') of the frontage along Oracle Road. The applicant is proposing that forty feet (40') of frontage be left undisturbed along Oracle Road, and the remaining sixty feet (60') be utilized for parking spaces. Additional landscaping, walls and berms, and pedestrian pathways are proposed to be located within the undisturbed zone, except in areas where significant vegetation exists, for TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Pau 3 of 9 further screening along Oracle Road. If areas of significant vegetation are to be mitigated, the ratios for mitigation shall be as set forth in the OVZCR Table 27-1 (Condition #1). Setbacks and Maximum Building Height • Section 24.5 E 3 b: "Required Setbacks. Setback standards of the applicable zoning district classification are applied, except as provided below: i. "Front setback for multiple structure development: Average 120 feet. " The Development Plan meets this Commercial Development requirement of ORSCOD. The average front setback for the multiple structure development in the proposed commercial complex is one hundred and thirty feet (130'). • Section 24.5 E 3 b iii. "Side setback distances of the applicable zoning district are to be provided. " According to Section 23.8 B 1 b i, the C-1 side setbacks are "50 feet where the lot abuts a single-family residential district or abuts an alley that is adjacent to the single-family residential district. " The proposed development exceeds this standard, as the northern most proposed building pad is located two hundred and twenty (220') feet away from the adjacent single family residential district to the north. • Section 24.5 E 3 e ii: "The remaining buildable area heights shall be limited to 25 feet. " As specified on the Tentative Development Plan; the proposed building heights would be limited from eighteen to twenty-five feet (18'-25'). Walls and Berms Section 24.5 3 a: `Berms shall be designed in a manner to have natural shape and appearance, complementary to the existing topography and shall comply with the requirements of the Ordinance. The proposed berms are designed to appear natural and do comply with the requirements of the Ordinance. Additional landscaping, walls and berms, and pedestrian pathways are proposed to be located within the undisturbed Oracle Road frontage zone, except in areas where significant vegetation exists, for further screening along Oracle Road. • Section 24.5 3 b: "Walls shall not exceed in length thirty-three percent (33 %) of the Oracle Road frontage of each parcel. " TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Paae 4 of 9 The Development Plan meets this wall specification. The total for the wall segments equals thirty-one percent (31 %). ORSCOD Design Guidelines Conunercial Development Guidelines • Section 24.5 F 4 a is "Rear and side setbacks adjacent to residential districts shall include berms or walls with heavy landscaping augmenting such opaque screening to a height of not less than eight (8) feet. General Code Compliance: Lighting Concerns • While Section 27.5 addresses outdoor lighting requirements per the OVZCR, additional lighting concerns need to be addressed in order to mitigate neighboring residential development concerns. In order to achieve compatibility with the adjacent residential developments, the height of light poles at the rear of buildings and projective to the sides shall be limited to a height of no higher than the height of the five feet (5') screen wall running parallel to the rear facades of the buildings (Condition #3). Vehicular Parking The required number of parking spaces for this development is 264. The provided number of parking spaces is 255 and is below the required parking spaces and the applicant is requesting that an "Alternative Parking TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD _ Pate 5 of 9 Analysis" be utilized by the Development Review Board for consideration when reviewing the required number of parking spaces (see attachment "Alternative Parking Analysis'). Staff feels the proposed alternative parking analysis would be appropriate for this development. OVZCR Design Guidelines: Loading Zones • Addendum A 6 c: "Loading and service areas should be screened from public view. Pedestrian Sidewalks • Addendum A 6 f ii: "Design all parking areas to allow safe and attractive pedestrian circulation. " A meandering sidewalk along the frontage of Oracle Road was proposed; however, Arizona Department of Transportation (ADOT) is planning to install a pedestrian path along Oracle as part of the SR77 project. An in - lieu of fee may be utilized in place of requiring said meandering sidewalk along Oracle Road. Drainage: The off -site drainage to this site currently flows from east to west and is mostly captured in an existing channel along the eastern property line running northward. The channel then turns to the west around the north end of the property and passes under Oracle Road through five existing box culverts. On -site flow is currently to the west where it is captured in an existing channel adjacent to Oracle Road and conveyed northward to the five box culverts. TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Pa e 6 of 9 Grading: A Type 2 Grading Permit will be required to construct the building pad, parking lot, drainage structures, and utilities. Traffic: Access to the facility will be from two driveways off the northbound lane of Oracle Road. One access to the site will be located at the existing median opening on Oracle Road at Camino Greenfield. COMPLIANCE ANALYSIS GENERAL PLAN COMPLIANCE: • Policy 3.1 M: "Specialty commercial development, similar to St. Additionally, the applicant would like to encourage that the art studios be utilized by artists or other designs, who in turn, utilize the art gallery as a place to show their work. Policy 9.1 D: "All development proposals should attempt to arrange buildings, massing of buildings, and/or arrangements of lots to preserve views from adjacent properties and streets while providing privacy for residents. " Neighborhood compatibility is a key component of this proposed development. The proposed Development Plan utilizes the following mechanisms to mitigate the effects of a commercial development adjoining residential developments: • Building pads are arranged in such a manner as to preserving views to and from the site along Oracle Road; • Building heights are limited as to not block views from properties across Oracle Road; • Proposed uses as specified in the Rezoning cases are limited in additional to the C-1 Commercial District permitted uses in order to further accommodate neighborhood needs and desires; • A continuous tree canopy, dense understory vegetation, and a screen wall will further mitigate undesirable commercial development aspects; • The lighting along the rear facades of the buildings shall be limited in height to that of the screen wall running parallel to the buildings; • Dumpster location are both landscaped and screened to help with odor abetment issues; and TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 7 of 9 • Views to and from the site are preserved and provide privacy for the neighboring residential developments. PUBLIC NOTIFICATION AND COMMENT: The surrounding property owners have been noticed in accordance with the Town notification requirements. To date, no comments have been received. PUBLIC PRESENTATION: Pursuant to Resolution (R) 98-31, "all presentations before Boards, Commissions and Council of rezonings, subdivision plats, development plans, and planned area developments must be formatted to be shown on the Town's projection system or overhead system. The Planning and Zoning Administrator, however, may exempt certain projects." The Applicant is responsible for all aspects of the presentation. If an applicant does not conform to the aforementioned resolution, the item may be continued due to non-compliance. The following is offered as guidance for applicant presentations: • A presentation must be designed to ensure that the audience, staff, and voting body can view the graphics • Presentations should include a location map, project history, site layout, and'a depiction of all pertinent design elements. If color chips or samples of materials are needed,12 sets of samples must be provided. • Examples of acceptable formats are PowerPoint, a videotape presentation, presentation boards and/or items suitable for overhead projection. The Applicant is welcome to schedule an appointment to ensure the presentation materials display as intended on the Town's equipment. Staff finds that the proposed development, with the conditions listed in Exhibit "A" of the Development Plan, would have no adverse impacts to the surrounding land uses. A Tentative Development Plan was approved by Town Council in May of 2001. The Development Plan closely follows the intent of the Tentative Development Plan design concept, through the use of rear buffer yards, walls, exceeding setbacks from adjacent residential districts, and screening unsightly views, such as loading zones and rubbish containers from adjacent residential districts. The Development Plan proposes building setbacks that far exceeds the setbacks required in the Commercial Development section of ORSCOD, which in turn, protects the views from and along Oracle Road. Therefore, staff recommends approval of the applicant's request for a Development Plan, provided that the Project incorporates all the conditions listed in Exhibit "A". SUGGESTED MOTION: I move to recommend approval of OV12-05-17, "The Shoppes at Oracle" request for approval of the Development Plan, subject to the conditions described in Exhibit A. X . TOWN OF ORO VALLEY STAFF REPORT TO THE DEVELOPMENT REVIEW BOARD Page 8 of 9 I move to recommend approval of OV12-05-17, "The Shoppes at Oracle" request for approval of the Development Plan, subject to the conditions described in Exhibit A and the following additional conditions: •S I move to recommend denial of OV 12-05-17, "The Shoppes at Oracle" request for approval of the Development Plan, finding that: Attachments: 1. HoIt, Planner Community Development Department Town of Oro Valley 11000 N. La Canada Drive Oro Valley, Arizona 85737 RE: Shoppes at Oracle Road, OV 12-05-17 Alternative Parking Analysis Dear Ms. Holt, We are requesting that the Development Review Board consider an alternative parking ratio for the above referenced development based on the following parking analysis: Use Required Parkin e/ Buildin , Area Parkins Required Parking Provided Square Foot Restaurant 10/1000 Sq. Ft. 10,054 Sq. Ft. 101 101 General Retail 4/1000 Sq. Ft. 10,888 Sq. Ft. 44 44 General Office 3/1000 Sq. Ft. 7,800 Sq. Ft. 24 24 Art Galleries 4/1000 Sq. Ft. 23,713 Sq. Ft. 95 86 & Studios Based on the General Development Standards, Chapter 27.7 Off -Street Parking, this development is under parked by 9 spaces or approximately 3.4% utilizing the "General Retail" criteria for determining the parking required for the Art Galleries & Studios usage as depicted above and noted on the Development Plan for this project. ry McGlo 520 0-1206 p.3 We propose a reduction in the parking ratio for the Art Galleries & Studios only. The proposed ratio is 3.6 parking spaces per 1,000 square feet of floor space. It is anticipated that the number of customers/clients will be less for the planned usage than would be expected for General Retail. Another consideration is that this proposed development will have nixed uses with staggered peak periods of parking demands. The General Office usage wrill piobably be closed before the peak parking demand for the Restaurant usage after 6:00 PM. This development will provide 96.6% of the parking required by the Development Standards as indicated above without any reduction of the mobility -impaired parking ratios or the required bicycle parking. Thank you for considering this alternative parking ratio analysis. If you have any questions or require any additional information please call. Sincerely, 13 w LVGlone GENERAL TES: 1.
