The response to each of his comments is as follows: Item 1 Lot closure calculation for parcel B. This has been changed per the request. Item 2. The Point of Beginning for easement B has been shown on the drawing. Item 3. Docket and page numbers for the 1 foot No access easements and 10 foot wide water easement. Docket 11759, page 883 is for a l foot access control easement along Como Drive and on the North line of the former right-of-way of way on Tangerine Road when it was a 50 foot right-of-way. Date: Signature of Seller/Borrower Print Name Date: Signature of Seller/Borrower Print Name DISCLOSURE NOTICES Good Funds Law Arizona Revised Statutes Section 6-843 regulates the disbursement of escrow funds by an escrow agent. The law requires that funds be deposited in the escrow agent's escrow account and available for withdrawal prior to disbursement. Funds deposited with the Company by wire transfer may be disbursed upon receipt. Funds deposited with the Company in the form of cashier's checks, certified checks or teller's checks, or checks which are made by an affiliate of a state or federally regulated depository institution when the check is drawn on that institution, may be disbursed the same day as deposited. If funds are deposited with the Company by other methods, recording and/or disbursement may be delayed. PURCHASER DWELLING ACTIONS NOTICE Pursuant to Arizona Revised Statutes Section 12-1363.N, notice is hereby provided to the purchaser of a dwelling of the provisions of Arizona Revised Statutes Sections 12-1361, 1362 and 1363. These statutory sections set forth the requirements to be met by a purchaser prior to bringing an action against the seller of a dwelling arising out of or related to the design, construction, condition or sale of the dwelling. "Dwelling" means a single or multifamily unit designed for residential 'use and common areas and improvements owned or maintained by an association or its members. "Seller" means any person, firm, partnership, corporation, association or other organization engaged in the business of designing, constructing or selling dwellings. The complete statutory sections can be viewed on the Arizona State Legislature's web site: www.azieg.state.az.us/ars/ars.htm. NOTICE• Pursuant to Arizona Revised Statutes 11-480, effective January 1, 1991, the County Recorder may not accept documents for recording that do not comply with the following: a Print must be ten -point type (pica) or larger. b Margins of at least one-half inch along the left and right sides one-half inch across the bottom and at least two inches on top for recording and return address information. c Each instrument shall be no larger than 8 1/2 inches in width and 14 inches in length. NOTICE OF IMPORTANT CHANGE TO ARIZONA NOTARY LAWS If your client is a foreign citizen, you will want to be aware of this change. Arizona law currently provides that "satisfactory evidence of identity" for purposes of a notary's acknowledging signatures or performing jurats includes a "current form of identification issued by a federal, state or tribal government...." (A.R.S. 41-311.11.) Effective August 25, 2004, however, this provision has been amended to provided that the current form of identification must be issued by "the United States government or a state or tribal government...." This change means that a current form of identification issued by a foreign government, such as a foreign driver's license, will NOT meet the statutory identification requirements. To avoid delays in closing transactions involving foreign citizens who may not have appropriate identification, you should determine as soon as possible what form(s) of identification your clients have. If they do not have appropriate identification, then you may wish to suggest, depending on their circumstances, that they apply for and obtain an appropriate form of U.S. or state identification. The premium you are charged for your title insurance policy is based upon the purchase price for the property you are purchasing/selling. To better understand the approval process for the Town's Minor Land Division applications, please refer to the table below. Table of Authority Submittal Type Staff Authority Planning and Zoning Administrator Minor Land Division Review Final Decision Process Overview: The Minor Land Division review process is established for land divisions, other than subdivisions as defined in Chapter 31 of the Oro Valley Zoning Code, by which owners and prospective purchasers can be advised whether a proposed division of land complies with Town regulations. The review is intended to: • Protect and promote the public health, safety, convenience, and welfare. • Assure that newly created lots are of sufficient size to meet the requirements of the applicable zoning classification. • Assure that all lots resulting from a minor land division will have adequate public street access. • Assure adequate easements are available for utility services. • Assure adequate access is available for emergency vehicles. The Minor Land Division process requires a general application (Section 1.2) and formal submittal. The formal application requires the submittal of all items listed in Section 1.3. The formal submittal is reviewed administratively after which the Planning and Zoning Administrator will issue a final decision. Zoning Code Chapter 31 Definitions: Minor Land Division Shall mean any division of improved or unimproved land for the purpose of financing sale or lease, whether immediate or future, into one or more lots. A Minor Land Division shall not include any division of land defined as a "subdivision." Subdivision Shall mean improved or unimproved land or lands divided for the purpose of financing sale or lease, whether immediate or future, into four (4) or more lots, tracts or parcels of land or, if a new street is involved, any such property which is divided into two (2) or more lots, tracts or parcels of land or any such property, the boundaries of which have been fixed by recorded plat which is divided into more than two (2) parts. Minor Land Division — Process Description Step 1 — Pre -application Conference It is strongly recommended that applicants attend a pre -application meeting with the Development Review Committee (DRC) for a preliminary review of their proposed minor land division to discuss the required process and broad issues related to the proposal. The DRC is comprised of Town staff responsible for reviewing and commenting on an application. To initiate a pre -application meeting, applicants must submit a written request and preliminary drawings 10 working days prior to the expected meeting date. (Applicants should refer to the "Pre - application Conference Process Guide" for additional details). The Development Review Committee will send a review letter identifying any broad concerns with the application and the project's development process within 3 working days following the meeting. Step 2 — Formal Submittal Applicants may submit a formal Minor Land Division package that includes those requirements listed on the Minor Land Division Submittal Checklist (Section 1.3). To ensure timely review, applicants should review the applicable provisions of the Zoning Code. Step 3 — Staff Review After receiving a complete application, staff will review the Minor Land Division in accordance with the applicable provisions of the Zoning Code, engineering standards or other areas of review authority. A review letter will be sent to the applicant within 15 working days of the submission. The plans may need to be revised and re -submitted for additional reviews to address comments on the application. When all review comments have been addressed, the application will be forwarded to the Planning and Zoning Administrator for final decision. a] 1.3 MINOR LAND DIVISION - SUBMITTAL CHECKLIST All applications for Minor Land Division must include the following materials to be accepted for processing: ❑ Fees $515.00 (Pima County Recoding Fee: $15.00) CfA completed General Application Form GLHN/TC ©'Site Plan of Minor Land Division— Size 24" x 36" (signed and sealed by a Registered Land Surveyor) (5 copies) Hawkeye Hawkeye 51" All required items included in the Minor Land Division Content List (Section 2.0) (5 copies) i31Legal descriptions of the new lot lines — Size 8'/2" X 11" (signed and sealed by a Registered Land Surveyor) (5 copies) Hawkeye Boundary closure calculations (1 copy) Hawkeye l" Lot closure calculations (1 copy) Hawkeye 3""Letter from the parcel owners approving the change TCNictory/AOG Conveyance deeds, with grantors and grantees. An i-entory of the native plant moving the tree difficult without significant damage material, a summary and a calsvlation of the requirement, under the Selective Plant TOS - Transplanted on Site Preservation Method have been included. GENERALNOTES J I. NI areas designated to be preserved u natural open space or within utility easements, shall be fenced or tapped off for protection during construction. Grading shall not encroach into natural open space and within the drip line oft preserved native plant _ The developer is responsible for maintaining a'no-disturbarre' standard in all natural open space areas 2. Before the issuing of grading permit,, all viable inventoried Plants proposed for preservation-m-pl-, salvaged and transplamixi-site, and removed from it,, Shan H be tagged with their assigned numbers, and color coded as recommended by this preservation plan (white=P[P, blue--TOS, yellow-RFS) 3. The north side of all saguaro and barrel cacti programmed for transplanting shall be marked prior to removal to ensure proper orientation in their new location 4. Any changes in grading limits or development layout will require the submittal of a revised preservation plan for review and approval 5 Transplanted plant material shall be irrigated by a drip system while it the to nporary G holding nursery. This system shall be operated by a temporary batteryopeated irrigation controller 6. Maintenance of salvaged plains in the temporary holding nursery shot[ be performed weekly by the contractor Maintenance shall include inspection and repair of the irrigation system, adjustment of the irrigation system, pruning, examination and treatment for dishes and pests, and any other work required by the plant monitor 7. Contractor shall also comply with all requirsnnents other Federal Endangered Species F Ad and the Arizona Native Plant LAw 8. On site monitoring of all aspects of site'wnstruction and grading shall be provided u the apense of the developer, during construction and at one year afler final inspection to ensure the protection ofpreserved plants and sal ,aide areas Monitoring shall be performed by TMHS Associates, Inc. 882-9655. 9.
