The initial filings for the split of the Trust Property have been made and are awaiting final approval as of the execution of the Declaration. The Trust is under contract to convey Parcel 1 to a third party, but at the time of the execution of this Declaration, the Trust remains the owner of Parcel 1. S. Right to Use Well for Residential and Equestrian Purposes. The Declarant desires that Parcel 1 and Parcel 2 shall both have the right to use or take water from the Well for residential and equestrian purposes, which right shall not include the right of either party to provide any water from the Well to or for the use of property other than Parcel 1 or Parcel 2.
