Comments on Agenda Item 3,
Uses of ARPA Funds
Submitted by EL CONQUISTADOR RESORT PATIO HOMES ASSOCIATION, SHADOWS OF
THE RIDGE and SHADOWS OF THE RIDGE HOA #1
The following comments are submitted by the EI Conquistador Resort Patio Homes Association,
a Home Owners Association (HOA) representing 192 homeowners, Shadows of the Ridge,
representing 22 homeowners, and Shadows of the Ridge HOA#1, representing 13
homeowners, all within the Town of Oro Valley. We appreciate the opportunity to provide input
into the Council's discussion of the utilization of $5.4 million of funds from the American Rescue
Plan Act (ARPA).
As described in the materials provided for this Agenda Item, the $5.4 million ofARPA funds are
restricted and subject to certain qualified uses. The materials list the uses under discussion to:
• Capital projects associated with Tourism;
• Capital projects associated with Stormwater improvements;
• Capital projects associated with Reclaimed water improvements; and
• Capital projects associated with Potable water improvements.
Our HOAs believe a major pressing problem facing the region is the future availability of water.
The background of water availability and use are well known. Future growth within Oro Valley
and surrounding towns will only increase demand for water in this area. As such, it is ourjoint
recommendation that the Town's priority in use of these federal grant funds focus on enhancing
the availability and utilization of water in Oro Valley. To our mind, the most appropriate
utilization of the funds among those presented in the materials is the extension of the Town's
reclaimed water system.
The Council has already begun the process of compiling the cost estimates for expansion of the
reclaimed water system to Riverfront Park and the area near the Pusch Ridge 9 golf course.
Those estimates are expected to be developed towards the end of this fiscal year.
The reclaimed water project has the added benefit of enhancing the Tourism objective, because
of the proximity of the EI Conquistador Resort, and could also benefit water utilization in the
many homes in the area, including those that our HOAs represent. Further, the project would
help protect the property values of the homeowners affected by the expansion of the reclaimed
water system. We also believe the project might provide the areas involved with insights into
any possible opportunities for water harvesting or other steps that would further enhance the
availability and utilization of water in the area.
The Council is being presented with several options for use of these federal grant monies. We
trust the Council members will act to utilize them in a manner that is responsive to the future
needs of the people and neighborhoods they serve. Our Associations recommend the funds be
used for the expansion of the reclaimed water system and other means to protect the availability
of water for use in Oro Valley.

Dear Mayor and Council:
I have reviewed the proposed regulations for Vacation and Short Term Rentals prepared by your staff and agree that Oro
Valley should pass such an ordinance on the strictest terms possible (Path 2) with a long hard look to the legal
ramifications by competent counsel. Let's take a substantial bite but not bite off more than we can chew, ie. probability
of having to defend lawsuits by land owners claiming the city is usurping their rights as land owners beyond what is
reasonable/constitutional (5tn Amendment taking of property without just compensation, etc). I would expect owners of
substantial numbers of properties who bought for the express purpose of rental, vacation rental and short term rental
will fight this tooth and nail. It is incumbent upon you to thoroughly explore the pro and con experiences of Scottsdale,
Paradise Valley, Sedona and others in this regard.

Re: Case no. 2002978 OVCN request for rezoning December 6th, 2022
Good day. Please just a moment of your time here, It's Important concerning our town.
How are you today? Hope the holidays are going well for you and yours. Sadly for us, we have a
looming haunt that Is holding us back from the joy we should be experiencing. What Is that you say?
The ill proposed rezone request by the Oro Valley Church of the Nazarene and the corporate money
behind them.
Others have explained many valid facts to you as to why this rezone should be denied and it's easy to
understand. (As a Certified Lighting Consultant and electrical contractor, I could elaborate on new
local lighting glare despite Dark Sky code of which I was involved in development back in the day). My
family and our neighbors here in Shadow Mountain Estates are all sick to their stomachs over the
mistake that could be made ultimately leading to a mega -church so not suited for this quaint one -of -a-
-kind neighborhood.- (The corporate money behind this isn't expecting_a "religious sports park" to
succeed anyway, they just are in It for the long game and selling the property to any big bidder in the
future. Scary thought whom that could be right? We understand they've done it elsewhere beforel)
What a HUGE mistake It would be for the historic residential neighborhood if this were allowed to
happen I The town of Oro Valley has a variety of treasures, surely one of them is Calle Concordia/Calle
Buena Vista area. What a beautiful place, such a unique residential country -like area in the middle of
urban sprawl, Have you driven or walked around here? It's just wonderful and NOTHING else is like it
In the town and for that matter the overall Tucson valley)
Please, please we need our elected officials to protect and do what's right for the citizens, to save
them from the likes of the corporate machine behind the OVCN. They don't care for the neighborhood
and It's nothing to do with religion, one can bet on that)
