This would allow the construction of a larger addition to my house. This addition would not significantly alter the appearance of the neighborhood or block the sightline from any nearby house. If Sun City were to approve this variance, then I would proceed to Oro Valley and seek their approval of the same variance for a building permit. SUMMARY: The applicant is requesting front and side yard setback variances from the Rancho Vistoso Planned Area Development (PAD) Sun City development standards. Specifically, the applicant requests variances to reduce the front yard setback from 20' to 16' and the side yard setback from 7.5' to 5' to permit construction of an addition to the living area of the home. EXISTING LAND USE AND ZONING: The subject property, Lot 29, is located in the Sun City Vistoso Unit 2 subdivision and is zoned Rancho Vistoso P.A.D. The zoning and adjacent land use to the subject property is provided on the following table. Zoning Land Use North P.A.D. Single Family Home West P.A.D. Single Family Home East P.A.D. Golf Course South I P.A.D. Golf Course SITE INFORMATION: Lot 29 is located at the end of Copperstone Drive which intersects with Pennystone Drive as shown on the Location Map, (Attachment 4). The property is a flat 6,835 square foot lot with an existing house built in 1987 and an attached covered patio on the east side of the home built in 1988. The subdivision has no vacant lots and it is mostly surrounded by golf course. NOTIFICATION: All property owners within 300 feet of the subject property were notified of this hearing by mail. The property is posted with a notice of hearing, was posted online at www.orovalleyaz.gov and was advertised in the Daily Territorial. To date there have been no objections submitted to the Town. ANALYSIS: The applicant proposes to build a 500 square foot addition attached to the east side of the house. The existing residence is 2,446 square feet in area, which includes a 762 square foot living space/covered patio addition on the east side of the home (Attachment 1). The size of the home is larger than the average size of other homes in the subdivision. A corner of the proposed addition encroaches slightly into the front yard and 2.5' into the side yard as shown in Attachment 1. The required setbacks for this subdivision are: • Front 20' • Side 7.5' 0 Rear 10' TOWN OF ORO VALLEY CONCEPTUAL DESIGN REVIEW BOARD Page 2 of 3 Findings of Fact: • The current house is built 20' from the front lot line, 13' from the rear lot line, 0' from the west side yard property line. • A 164 square foot covered patio was added to the east side of the home in 1988. • The covered patio is allowed to be built 3' into the required side yard and is compliant with the Zoning Code. • The zero set back on the western property line was approved by the County prior to annexation. • The east side of the house faces the golf course with no adjacent neighbors. • The Town's Engineering Division reviewed the proposed variance and does not have a sight visibility concern. The Board of Adjustment should consider the following findings in making its decision for each variance request: 1. Are there special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district, The applicant refers to the location of his lot in the subdivision on a street radius (curve) and the lot size as the restricting factors justifying the variance. Staff has provided the following information after researching the Sun City Vistoso Unit 2 subdivision: • The subdivision consists of 92 lots. • The front setback for the subject property is impacted by the flare of the front lot line due to the location of a street knuckle (Attachment 3). The proposed addition sets back several feet from the garage. • The subject lot is a 6,835 square foot lot mostly of rectangular shape as shown on Attachment 3. • Lots in the subdivision range from 5,500 square feet to 11,758 square feet. The subject lot is of average size for the subdivision. • Many of the lots surrounding the subject lot are 55' wide and 100' long. The subject lot is 70' wide with a western property line of 100' long. The eastern property line is 85.37' long due to the location of the street knuckle. 2. That special circumstances were not created by the owner or applicant, The applicant refers to the smaller lot size as impacting his ability to construct his preferred 20' x 25' sculpture studio. The western property line is 100' long from front to back. The eastern property line, where the addition is proposed, is 85.37 from front to back. The street radius knuckle reduces the eastern property line by 14.63'. The setback follows the street radius and therefore a minor portion of the proposed addition encroaches into the front setback. 3. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; The applicant wishes to build his studio on the lot's available space and proposes to match the size and setback line of the existing covered patio on the east side of the home. TOWN OF ORO VALLEY CONCEPTUAL DESIGN REVIEW BOARD Pa-ge 3 of 3 The proposed addition does not abut the existing covered porch but has a gap between the new addition and the existing house. 4. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located, The applicant states he has reviewed the project with the Home Owners Association and there was no objection. The street radius reduces buildable space in the front yard of this lot while other interior lots without the street radius would not have this situation. 5. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. The applicant indicates that the location of the proposed addition is adjacent to the golf course and will not impact any adjacent neighbors due to this fact. As shown on Attachment 2, the proposed addition is on an area of the lot which is not adjacent to other homes. The closest property lines from the proposed addition are 16' from the street and 5' from the golf course. SUGGESTED MOTIONS: The Board may wish to consider the following motions: I move to [approve or approve with conditions] OV1012-06 a variance request to reduce the front yard setback to 16' and the side yard setback to 5', with the finding that criteria have been met. I move to deny OV1012-06 a variance request to reduce the front yard setback to 16' and the side yard setback to 5', with the finding that the criteria have not been met. Attachments: 1. Layout of a typical urban street network This manual recognizes two types of collectors: residential collectors and major collectors. Descriptions of the attributes of local streets and of each collector type are presented in the following sections. Those descriptions are intended to guide the designer in the selection of the appropriate type of street. Table 3.1 characterizes the types of streets discussed here based on traffic volume, design speed, access to property, roadway terminus, access density, system continuity and segment length. Segment length is the distance between consecutive breaks in the roadway alignment. The following elements create breaks in the alignment: • Knuckles. All knuckles shall have an intersection angle (A) between 600 and 1200 and shall conform to the criteria presented in Details 3.1-1 and 3.1-2. • Sharp horizontal curves. Curves with an intersection angle (A) greater than 600 and a radius not exceeding 300 feet are considered sharp curves. • Traffic circles. I was focused on the front yard setback issues but realized you have a side yard setback issue as well. Your subdivision requires a 7.5' side setback. I know the older addition is 5' from the side property line but that would have been allowed because that portion is an open porch. The new addition is an enclosed room which must be 7.5' from the side property line. It's not too late, I can add the side yard variance also. Two things I'll need from you. A revised application, again, to include the 2.5' encroachment into the side yard setback and a new site plan showing 2.5'. I would be happy to meet with you about these changes. Do you have time available tomorrow the 25th after 1:00pm? Thank you, Patty Hayes Zoning Plans Examiner Development & Infrastructure Services Department Town of Oro Valley 520-229-4819 (office) 520-742-1022 (fax) 09/24/2012 Page 1 of 1 Hayes, Patty Subject: Variance case Mr. Haug, I am reviewing your variance application for the Board of Adjustment. I will be the staff member presenting your case before the Board. In looking at the supplemental question portion of the application I feel that questions 3 and 5 are not answered with a full description of the project. The answer to question 3 appears to repeat the question and answer 4 is very short. Your answers to these questions will help the Board decide your case. The Board members must be able to determine that all of these questions can be substantiated. The more detailed your answers the better the Board understands the issue. Please call me when you have a chance and we will go over the questions. Our office if open from 8:O0am to 5:OOpm Monday through Friday. Thank you very much.
