April 5, 2012 The Town of Oro Valley Permitting Division has no Engineering comments regarding the proposed zoning variance. The requested variance for the side and front yard setbacks will not in itself result in hazard to persons or property if granted. The front yard setback has been reviewed to verify that it's reduction will not encroach into the sight visibility triangle. Other engineering code requirements such as drainage conveyance have already taken place during previous review of the Building/Grading Plan submittal for permit. If you have any questions, please call David Laws at (520)229-4808. I do not recall having been told that I needed to request a reimbursement of my $150. I am requesting that those funds be reimbursed to me. In speaking to the Liason that was assigned to me for the variance, he expressed to me that the likelyhood of my variance being granted was slim and at that time I decided to withdraw the application. I sent an email to rarellano@orovalleyaz.gov as instructed to me by the gentleman that was assigned as my liason, sorry, I do not remember his name. I was under the impression that the funds would just be reimbursed, at this time I make this formal request of fund reimbursement. Thank you for you consideration in this matter. In order to authorize a variance request, the Board will be searching for sufficient evidence in accordance with the findings. Please answer the questions below in a narrative format 1. Are there special circumstances•or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district? 2. Are there special circumstances that exist that are not self imposed or created by the owner/applicant? 3. Is the authorizing of the variance necessary for the preservation and enjoyment of substantial property rights? 4. If granted, will the variance impose such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? 5. If granted, will the variance be the minimum necessary to afford relief and will not materially affect the health, safety, and welfare of the neighborhood or surrounding properties. 03/28/2012 10:00 5205742264 STATION 19 PAGE 01/02 NATURE OF REQUEST: I, Raymond Contreras, the owner of the property at 590 w. Kidd Pl. am requesting a variance at the said property for the .following reasons. The restrictions imposed on the property limit the size of a decent single story home to be built. I am in the third review of these house plans, the house itself has been approved and the issue of setbacks has impeded approval to start building. This particular lot has created some challenges in the approval process. There is a line of site triangle that caused the house on the origiunal plans to be reduced in square footage and be shifted to the west in order for the house to meet the required setbacks. Upon shifting the house west, I am requesting a 3 foot setback on the west wall as opposed to the 5 foot setback, axis would help keep the line of site triangle that has already been approved by zoning and would allow the home to fit within the building envelope. I wn also requesting a 6 foot setback on the radius curve at N. Fair Mountain Dr. and W. Kidd Place, the 17.5 foot setback would encroach to far into the building envelope of the approved house plan. Because there is an existing utility setback of 6 feet at that location, I would request the same setback for the home, this would also allow the home to fit within the building envelope. If granted, I believe the construction of the new home will do much for the neighborhood of Lambert Lane and the Town of Oro Valley: 1) the lot has been vacant for 20 or so years and the construction of the new home has been approved by the Lambert Lane HOA 2) the home would generate revenue for Oro Valley. This process of approval has been over 3 months in the making and my budget to build is quickly being affected, also, building a two story home would put me out of budget because of the increase of cost for materials, etc., this would not be an option for me. I thank you for your time in reviewing my request and taking my situation into consideration. I would be grateful should the request be granted. Sincerely, RCO Below are the answers to questions 1-5 from Section 21.6 I of the Oro Valley Zoning Code Revised (OVZCR). Questions attached. 1. Yes, the line of site triangle on the East side of the Property limits the distance that the house can be moved to the West. 2. My intentions are to build a single story home to keep my cost at a minimum, building a two story home would increase my building cost and take me out of budget. 3. Yes, the properly has been vacant for approximately 20 years and if the'variance is not granted, we will not be able to enjoy the property we purchased and build a single story dwelling. 2012-03-28 10:21 5205742264 Paee 1 bIjI ztII Lbl'L 117: f U n2Ub /42Zb4 51 A I ILH 11 F'AUL M/ by 4. No, all the other lots/properties in the subdivision have been built on and no Special privileges would have to be granted to anyone else, this would not be setting a precedence for a new home build. 5. Yes, if granted, the variance will be the minimum to allow construction of the home. Because of the restrictions the lot has, it has not been developed. Approval of the variance will allow the lot to be improved and in my opinion, increase the value of the homes in the area. The Lambert Lane HOA hias reviewed the house plans and given approval as a home suitable for the subdivision. 2012-03-28 1022 5205742264 Page 2/2 t 3 5(DE 5 ETBA 4-4670 50G ;O - -- . , TRIANGLE FE A55NTO REQUIREMENT5
