LA CANADA DRIVE CALL TO ORDER ROLL CALL PRESENT: Paul Parisi, Chair Bob Swope, Vice Chair Jimmy Fields John Hickey, Member EXCUSED: Jeremy Christopher, Member MINUTES Approval of the Minutes of August 26, 2008 MOTION: A motion was made by Member Hickey and seconded by Member Fields to approve the minutes of the August 26, 2008 meeting. MOTION carried, 4-0. 1. CASE NO: OV10-08-09, Dino Maniquis and Esperanza Montesclaros request a variance from the required 40' rear yard setback to 22. Subject (parcel #224-27-1690) located at 10922 N. Poinsettia Drive, Oro Valley, AZ, 85737. Chair Parisi swore in the applicant Dino Maniquis and contractor Harry Terry. Mr. Maniquis requested a variance to build a garage. He noted that his home was built in 1987 prior to annexation into Oro Valley. Vice Chair Swope questioned whether the garage could be placed on the opposite side of the house. Mr. Terry stated that it would add an additional cost of $50,000 - $60,000 for the driveway to be extended and cut across the front of the house. It was noted that the air conditioning unit would be moved behind the garage. Zoning Inspector Patty Hayes stated that mechanical equipment was exempt from setback requirements. Ms. Hayes presented the Staff report. She reported that: • The variance was for a garage to encroach 18 feet into the required 40 foot setback. - • Reduce the rear yard setback to 22 feet. 12/23/08 MINUTES, BOARD OF ADJUSTMENT 2 • A notice of this hearing was posted on the property and online. • Property owners within 300 feet of the property were notified by mail. • The applicant submitted 5 letters of approval from neighbors. • 2 adjacent neighbors came to review the plans and expressed concerns regarding drainage and retaining walls. • The house was built in 1987 under the jurisdiction of Pima County • The proposal would: o Utilize the existing driveway. o Comply with the 20 foot side yard setback and the 18 foot maximum building height. Chair Parisi opened the public hearing at 3:10 p.m. There being no speakers, he closed the hearing. MOTION: A motion was made by Member Hickey and seconded by Member Fields to approve OV10-08-09, a request to reduce rear setback from 40' to 22'. Member Hickey stated that all criteria were met. He noted that though technically feasible, it was not reasonable to move the garage to the south side of the property. Vice Chair Swope stated that he had some hesitation regarding the retaining wall and the required fill and drainage but noted that these issues will be addressed during the building and grading. Chair Parisi stated that the criteria had been met due to topography and that the request was consistent with the neighborhood. MOTION carried, 4-0. 2. Planning and Zoning update An update was not available. ADJOURNMENT MOTION: A motion was made by Member Hickey and seconded by Vice Chair Swope to adjourn at 3:14 p.m. MOTION carried, 4-0. MINUTES ORO VALLEY BOARD OF ADJUSTMENT REGULAR SESSION August 26, 2008 ORO VALLEY COUNCIL CHAMBERS 11000 N. LA CANADA DRIVE CALL TO ORDER - at 3:00 p.m. ROLL CALL PRESENT: Colleen Kessler, Member Paul Parisi, Member Bart Schannep, Member EXCUSED: John Hickey, Member Minutes: Approval of the Minutes of July 23, 2008 MOTION: A motion was made by Member Parisi and seconded by Member Schannep to approve the Minutes of the July 23, 2008 meeting. MOTION carried, 3-0. 1. CASE NO: OV10-08-08, Harvey and Jewel Prendeville request a variance from the required 10' rear yard setback to 4'. Subject (parcel #223-07- 2770) located at 13870 N. Engle Hill Drive, Oro Valley, AZ, 85755. Chair Kessler swore in the applicants Harvey and Jewel Prendeville requested a variance to build a ramada to shade the rear of the house due to the amount of sun the east side of the house receives. It was noted that the house was 10' 4" from the property line and therefore the 10' ramada would be within the setback. It was stated that there were no neighbors behind the house. It was clarified that in order to provide the amount of desired shade to cool the home, the builder said that anything less that ten feet would fall short of their goal. Zoning Inspector Patty Hayes presented the Staff report. She stated that: • The proposal would reduce the setback to 4". • The homeowners association approved the ramada. • The neighbor to the north of the property sent an email in favor of the variance. 08/26/2008 MIr 1es, Board of Adjustment 2 Discussion clarified that at present there lots behind the property were not buildable. Ms. Hayes noted that in order to make the lots buildable, the area would have to be completely re -platted which was highly unlikely. Chair Kessler opened the public hearing at 3:05 p.m. There being no speakers, she closed the hearing. MOTION: A motion was made by Member Schannep and seconded by Member Parisi to approve OV10-08-08, a request to reduce the rear yard setback from 10' to 4". Member Schannep stated that due to the peculiarity of the lot, the only usable space was on the sides of the house. Vice Chair Parisi concurred that the lot was different from others in the neighborhood. Chair Kessler stated that the applicant had met the five criteria for a variance. MOTION carried, 3-0. ADJOURNMENT MOTION: A motion was made by Member Schannep and seconded by Member Parisi to adjourn the meeting at 3:08 p.m. MOTION carried, 3-0. Subject parcel #224-27-1690, located at 10922 N. Poinsettia Drive, Oro Valley, AZ, 85737. REQUEST SPECIFICS: Dino Maniquis and Esperanza Montesclaros request approval to build an attached garage to the east side of their house with an 18' encroachment into the rear yard setback. The required rear yard setback in the Monte Del Oro subdivision is 40'. The proposed garage addition would reduce the rear yard setback to 22' at the closest point. SITE LOCATION: This property is lot 57 of the Monte Del Oro subdivision located south of Naranja Road, two thirds of a mile east of La Canada Drive. NOTIFICATION: All property owners within 300 feet of this property were notified of this hearing by mail. The property is posted with a notice of hearing, posted online at www.orovalleyaz.gov and was advertised in the Daily Territorial. At the time of this report preparation, staff had received five letters submitted by the applicant in support of the variance request, one telephone inquiry from a neighbor with no comment. The two adjacent neighbors south and southeast of the subject property came in to the Town offices to review the plans. They did not have an objection to the proposed garage, but did express concerns regarding retaining walls and drainage. EXISTING LAND USE AND ZONING: Subject property — Existing house R1-43 North - Existing house zoned R1-43 West -Existing house zoned R1-43 East - Existing house zoned R1-43 South - Existing house zoned R1-43 SITE INFORMATION: Monte Del Oro is a 187 lot subdivision recorded in Pima County in 1976. The neighborhood was annexed by Oro Valley in 1987. Subject property is a 1 acre pie shaped lot. The existing house was built on the highest. point of the property at 12' above the wash that crosses the front of the property and 16' above the rear southeastern corner. I W 10117100ye) 2-WW W3 • The house was built in 1987 while under Pima County's jurisdiction. The original placement of the house was reviewed and approved through Pima County. • There is a 100 year flood -prone area in front of the house that effected the placement of the original house. • The applicant proposes to locate the garage so that it may be accessed using the existing driveway. • A temporary construction access has been graded in front of the house to allow concrete truck access for construction of retaining walls. The homeowners plan to revegetate the area after construction is complete. • The proposed garage will meet the required 20' side yard setback and will comply with the 18' maximum building height. • The Pubic Works department has reviewed the variance application and has no objection to the location of the proposed garage. A grading plan will be required showing specific criteria for engineering. See attached comment letter. • Surrounding houses as well as the subject property were built on the highest point of their lots with the remainder of the lot sloping downward toward the property lines. • The three adjacent lots located northeast, east and southeast would be able to see the proposed garage from the side and rear of their houses. The views of the Santa Catalina Mountains from those houses are east and not west toward the subject property. The Board of Adjustment should consider the following findings in making its decision: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; and B. That special circumstances were not created by the owner or applicant; and C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; and D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and E. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. 2 SUGGESTED MOTION: The Board may wish to consider the following motions: I move to [approve, approve with conditions, or deny] OV 10-08-09, a request to reduce the rear yard setback from 40' to 22'. We concur that this project will enhance the appearance as well as increase property value. The proximity of the garage being 20 feet from the property line will be of no disturbance to our home or view. Furthermore, we agree that this project will solve the problem of having two vehicles parked outside which will present a neater appearance for our neighborhood.
