SUPPLIMENTAL QUESTIONS FOR APPLICATION FOR A VARIANCE
1. Are there special circumstances or conditions applying to the property referred to in the
application including its size, shape, topography, location or surroundings which do not
apply to other properties in the district?
This currently appears to be the only piece of undeveloped R-4 property in the City of
Oro Valley. The long narrow configuration of the site has proven to be difficult to
develop. Once setbacks are shown the shape of the buildable area limits available
development options. The requirement of including full kitchens in each retirement
suite increases the overall mass and depth of the building to the point of exceeding these
limitations.
2. Are there special circumstances that exist that are not self imposed or created by the
owner/applicant?
The fire department requirement to have 2 points of access, combined with the large
drainage ditch running through the middle of the site creates the substantial expense of
building a vehicle bridge to span the drainage ditch.
Is the authorizing of a variance necessary for the preservation of enjoyment of substantial
property right?
The proposed development of our Congregate Retirement Residence is consistent with
the "Mature Adult Retirement Quarters" definition and is an allowed use in the R-4
district. Due to the constraints listed above we cannot develop this allowed use with the
inclusion of full kitchens. These same constraints contributed to the unsuccessful
development of a Town Home project on this site previously. Additionally the exclusion
of full kitchens from the retirement suites will reduce potential fire and safety issues.
4. If granted, will the variance impose such conditions as will assure that the authorizing of
the adjustment shall not constitute a grant of special privileges inconsistent with the
limitations upon other properties in the vicinity and zone in with such property is located?
This type of facility is an allowed use and is not inconsistent with other properties in the
vicinity. Because this development is the first of its kind in Oro Valley the Oro Valley
Zoning Code does not accommodate the specifics of our program i.e.: full meal
provision, which eliminates the need for full kitchens in every retirement suite.
(Please see the attached concept description of this proposed development)
5. If granted, will the variance be the minimum necessary to afford relief and will not
materially affect the health, safety, and welfare of the neighborhood or surrounding
properties.
Providing a variance that waives the requirement for full kitchens is the minimum
necessary to accomplish this development. The variance is a benefit to the
neighborhood and surrounding properties, due to its smaller mass and lesser impact to
utilities. An additional benefit is that this retirement residence cannot later be
converted to an apartment complex because there will not be full kitchens in the units.
Please feel free to contact myself of Mark Lowen if you have any questions or need any
additional information.

ORO VALLEY PLANNING AND ZONING DIVISION
BOARD OF ADJUSTMENT REPORT
CASE NO: OV 10-08-10
Hearing Date: January 27, 2009
Agenda Item No.: 1
Prepared By: Patty Hayes, Zoning Inspector
REQUEST:
Oro Valley Retirement Residence LLC represented by Curry Architecture LLC, has
filed an appeal of the Planning and Zoning Director's interpretation regarding whether
the proposed Oro Valley Retirement Residence meets the definition of Mature Adult
Retirement Quarters. Subject parcels #224-30-363A, 224-30-367G, 224-30-3620
located at West Lambert Lane and Highlands Drive, Oro Valley, AZ, 85737.
REQUEST SPECIFICS:
Oro Valley Retirement Residence LLC., proposes to build a retirement facility on the
subject property. The proposed development would consist of 14 independent living
units with full kitchens and a two-story building with 111 suites without full kitchens.
The sites R4 zone allows mature adult retirement quarters. The OVZCR defines mature
adult retirement quarters as having full kitchens. The property owner requests the Board
overturn the interpretation on Mature Adult Retirement Quarters.
The attached letter from Sarah More, the Planning and Zoning Director, to Mark Lowen,
Curry Architecture, LLC. describes the basis of her interpretation.
SITE LOCATION:
This site is located on the north side of Lambert Lane at Highlands Drive.
NOTIFICATION PUBLIC COMMENT:
All property owners within 300 feet of this property were notified of this hearing by mail.
The property is posted with a notice of hearing, posted online at www.orovalleyaz.gov
and was advertised in the Daily Territorial. At the time of this report preparation, staff
had received no comment in support or opposition to this case.
EXISTING LAND USE AND ZONING:
On -site: Vacant land zoned R4
South: Existing houses across Lambert Lane zoned R1-36
East: Existing houses zoned Vista Del Oro PAD
West: Existing houses zoned Melcor PAD
North: Highlands Mobile Home park zoned SDH 6
SITE ANALYSIS:
The subject properties are comprised of three contiguous parcels totaling 9.36 acres. The
two large parcels are undeveloped native desert. The center or third parcel contains the
Highlands Wash which divides the property. The land gradually slopes south towards
Lambert Lane.
FINDING OF FACTS:
■ The proposed development would provide communal dining and activities, but not
medical services. According to OVZCR, Section 23.3, table of permitted uses, this
use is a Mature Adult Retirement Quarters.
■ Mature Adult Retirement Quarters is an allowed use in an R4 zoning district with a
conditional use permit (CUP).
■ The OVZCR Chapter 31, definition 207, defines Mature Adult Retirement Quarters
as: One (1) or more residential buildings containing multiple dwelling
units, each of which has sleeping quarters, a full kitchen, and bath. Mature adult
retirement quarters are intended for, and shall be limited to, occupancy by adults
who are able to live independently and do not require skilled medical care, nor
routine/ongoing assistance with the activities of daily living. A mature adult
retirement facility must include areas for communal dining and group activities.
■ The applicant proposes to build a retirement community without individual kitchens
in some of dwelling units.
■ This use also does not fit in other land uses defined in the Oro Valley Zoning Code,
such as skilled nursing facility or community residence. A community residence is a
single household and the nursing care facility provides a higher level of service.
■ An interpretation of Mature Adult Retirement Quarters was requested by the property
owner. See attached letter dated November 19, 2008.
■ If the definition of Mature Adult Retirement Quarters didn't specifically mention
"full kitchen", the proposed use would be determined to be in this land us category.
■ A full kitchen has been considered to be an area that is wired with a 220 volt or gas
line for an oven/stove. The OVZCR does not define a full kitchen.
■ Site History: In May, 2005, another applicant applied for a reduction of setbacks for
their proposed development. The variance was denied.
BASIS FOR REVIEW OF APPEALS:
The Board of Adjustment Primer provides the following standard for favorable review of an
appeal:
1. The decision, which is being appealed, was an abuse of discretion (violates the
intent and policy of the statute or is unreasonable, arbitrary, capricious, unfair,
or discriminatory; or
2. It exceeded the Planning and Zoning Administrator's power or authority; or
3. It is in error; or
4. It involved fraud or bad faith; or
5. It lacks evidence to support it.
2
SUGGESTED MOTION:
The Board may wish to consider the following motions:
I move to uphold the decision of the Planning and Zoning Director.
OR
I move to reverse the decision of the Planning and Zoning Director, thus allowing the Oro
Valley Retirement Residence to be developed as proposed, subject to a CUP and
development plan approval.
Board members, please state the reason for either decision.

Re: Letter of Explanation and Congregate Care Definitions,
Dear Sarah:
Holiday Retirement has been in the business of providing seniors housing for the past 30 years.
Bill Colson, the founder of Holiday Retirement, saw a huge need for the active seniors in our
communities. Through Holiday Development, Mr. Colson developed a legacy we call a "catered
lifestyle" for the active seniors in the communities we serve. His goal was to keep the cost of this
"catered lifestyle" affordable enough that even the retired school teacher could enjoy it.
Over the past 30 years it has been our goal and our success to design facilities that appeal to the
active ambulatory seniors that desire a slower pace of a catered lifestyle and social atmosphere. Our
facility is geared to accommodate those seniors in their mid 70's through their mid 80's. A few residents
live with their spouses, but most live alone. Due to their age and or medical reasons they can no longer
maintain a private residence and the upkeep of that lifestyle.
The catered lifestyle our residents enjoy includes all meals, laundry service, housekeeping, and
transportation as well as a wide variety of social activities. All of these services are included as a part of
their monthly rent. This is what makes our facility unique compared to other senior living facilities.
About 80 percent of our residence have lived within a 10 to 15 mile radius of the facility or have
a close family member within the same radius. Our residents are all ambulatory and we do not offer any
on site medical services.
Our facilities attract many seniors who have lost a spouse or just desire the company of other
residence their same age and background along with a slower paced lifestyle. Yet they are not ready for a
live in facility that provides medical services and the expense that come with that level of care.
The proposed retirement campus consists of a two story Retirement Facility along with seven one
story duplex cottages (14 units). The 111 suite retirement residence (main building) is composed of
studio, one bedroom and two bedroom suites. The suites differ from a common apartment dwelling by
not having full kitchens or laundry hookups. The one story duplex cottages do include full kitchens and
garages to appeal to an even more independent senior resident.
The main building is divided into two major areas, the central core or center of the building is the
social area. The core includes the central dining room where all three meals are provided and served.
Separate activity rooms include a craft and exercise room, TV room, a card room, multipurpose room,
beauty shop, and library. Multiple activities are schedules daily to assist in fulfilling our residences need
for social interaction and personal independence. We strive to create a facility that is open and inviting
and an atmosphere that resembles their own home.
The private suites include studio, one and two bedroom floor plans the kitchenettes in each suite
consists of a refrigerator, sink and microwave with a small countertop and cabinet. A kitchen equipped
with an oven and range top is available to all residents of the facility in the craft/exercise room located on
the first floor in the event a resident desires to prepare food for special occasions or if they choose to
prepare their own food beyond the 3 daily meals and other snacks provided by the facility. All meals and
snacks are prepared on site in the 4000+ square foot commercial kitchen and served in a common dining
area within the main facility.
Our proposed development of a congregate retirement residence is consistent with the "Mature
Adult Retirement Quarters" definition (Ch. 31 4207) and is an allowed use in the R-4 district. The long
narrow configuration of the site has proven to be difficult to develop. The setback requirements
substantially limit the buildable footprint which further limits the development options for the site. The
zoning requirement of including full kitchens in each retirement suite increases the overall mass and
depth of the building, and further complicates the fire department requirements. The exclusion of full
kitchens from the retirement suites will further reduce potential fire and safety issues. This type of
facility is an allowed use and is not inconsistent with other properties in the vicinity. Because this
development is the first of its kind in Oro Valley, the Zoning Code does not accommodate the specifics
of our program i.e.: full meal provision, which eliminates the need for full kitchens in each of our
retirement suites.
In conclusion we would like to appeal the administrative decision that supports the requirement
for "full kitchens". Waiving the requirement for full kitchens for our retirement suites is the minimum
necessary to accomplish this development. Granting this appeal would also be a benefit to the
neighborhood and surrounding properties, due to its smaller mass and lesser impact to utilities in the
nearby community. An additional benefit is that this retirement residence cannot later be converted to an
apartment complex because there are not full kitchens in the residential suites.
The attached exhibit includes definitions from various jurisdictions for this type of use
("Congregate Care"). These definitions further supports our assertion that "full kitchens" are not
required or in some cases not allowed for this type of use.
Please feel free to contact myself if you have any questions or need any additional information.

CONCEPT
The Retirement Residence is a 115-suite facility for seniors. Our concept is designed for
those who are still ambulatory, but in need of some support. Private rooms afford the
advantages of independent living while the services included provide support, security
and friendship. The private suites include studio, one and two bedroom versions. Each
is similar to a conventional dwelling unit except a kitchen is not included.
Services include three prepared meals daily, housekeeping, laundering, private bus
transportation and various activities. Staff is "in house" 24 hours a day. The monthly
rent payment covers the private room, all services and utilities.
Typically our resident will be a single person in their late 70's or 80's. Approximately
10% of the rooms will be rented by couples making a total building population of 150.
Fewer than 25 % of the residents will be driving their own cars.
TRAFFIC
The Retirement Residence will generate approximately 250 trips per day with less than
30 peak hour trips.
These numbers are based upon the "Congregate Care Facility (253)" classification from
the Institute of Transportation Engineers "Trip Generation" report, which states a 2.02
average Trip Generation per suite per day. This report concludes that the Retirement
Residence would generate only 7 weekday morning and 20 weekday afternoon peak
hour trips. This is significantly lower than a conventional residential or commercial
development.
To help you understand the traffic loadings, we have provided examples of the types of
traffic existing facilities generate:
service trips 5 deliveries per day
van trips 3 or 4 excursions with around 20 residents each time
resident trips only 15% may have cars
resident visitors approximately 20% have visitors per day
staff trips 18 staff members to and from work
471 High Street SE, Suite 10 --Salem, Oregon 97301 --Phone 503.399.1090 --Fax 503.399.0565
PARKING
Because most of our residents do not drive, we provide private van transportation for
their use. The van is available to take the residents to places they need to visit, such as
banks, medical offices, shopping areas, etc.
Normally we request a parking ratio of .60, or one parking space per two suites. The
principals of Harvest Development LLC have developed over 300 retirement
residences. Experience from this extensive portfolio has shown that .60 parking space
per suite is adequate for our residents, staff and visitors.
The parking ratio allows us to increase landscaping and open space to create a better
residential environment for our residents and adjacent property owners.
SITE DESIGN
Neighborhood compatibility is achieved in the site planning and building design. The
wing ends and building center step down from two to one story. This arrangement
provides for privacy and a gentle change of scale. Care is taken to minimize the impact
to the existing community.

Re: Request for Code Interpretation
Dear Sarah:
Chapter 31 (Definitions) item #207 ofthe Oro Valley Zoning Ordinances defines "Mature Adult Retirement Quarters as
follows:
"Shall meet one ff) or more residential buildings containing multiple dwelling units, of which has sleeping quarters, a
full kitchen, and bath. Mature Adult retirement quarters are intended for, and shall be limited to, occupancy by adults
who are able to live independently and do not require skilled medical care, nor routinelongoing assistance with the
activities of daily living. A mature adult retirement facility must include areas of communal dining and group
activities "
The retirement residence we proposed at 30 West Lambert Lane consists of a I I I -suite facility with 7 duplex cottages
for seniors. The duplex cottages have full kitchens. The private suites include studio, one and two bedroom
versions. Each suite is similar to a conventional dwelling unit. The kitchen in each suite consists of . a
refrigerator, sink and microwave for cooking. In addition a kitchen equipped with an oven and range top is
available to all residents of the facility in the craft/exercise room located on the first floor. This is in the event
the resident desires to prepare food for special occasions or if they choose to prepare their own food beyond the
3 daily meals and other snacks provided by the facility. The meals and snacks are prepared and served on site in
the 4000+ square foot commercial kitchen and common dining area.
It is our desire to receive an interpretation as to the acceptability of the kitchen facilities provided on our
retirement residence building in fulfilling the kitchen requirement under definition #207 for Mature Adult
Retirement Quarters.
Sincerely,
Mark D. Lowen
