Chair Hickey swore in Robert Staples of Pima County. Mr. Staples spoke
on the applicant's behalf. He stated that the intent was to build an in -ground
spa. He explained that the setbacks were three feet from the side yard and

five feet from the rear yard. He stated that the request was for a three
foot variance in the setback as the backyard was 15 feet deep. He noted
that in order to maintain the required five foot setback, it would bring the
spa within two feet of the back porch column. He explained that the in -
ground spa would need to be further from the porch due to the weight of the
home that the column bore and the instability that would be created by the
spa if it were located too close to the column.
Zoning Inspector Patty Hayes presented the staff report:
—The request was to build an in -ground spa with a decreased rear yard
setback of three feet.
—The rear yard setback for the River's Edge subdivision is ten feet.
—The Oro Valley Zoning Code provided an exception for swimming pools
and spas to be as close as five feet to the rear property line.
—The request would decrease the rear yard pool setback an additional two
feet.
—The lot was surrounded on 3 sides by common area.
—One adjacent neighbor on the side opposite to the proposed spa.
—All property owners within 300 feet of the property were notified by mail.
—The property was posted with a Notice of Hearing.
—The hearing was posted online and advertised in the Daily Territorial
—No comments of support or protest were submitted regarding this case.
Chair Hickey opened the public hearing.
He swore in Oro Valley resident Bill Adler. Mr. Adler stated that he wanted
the Town to discourage citizens from filing for variances. He stated that he
did not feel that the applicant was aware of the five criteria that must be met
in order to receive a variance. He noted that the property was not
responsible for the difficulty, but rather the layout of the house was the
problem.
Chair Hickey closed the hearing.
Mr. Staples stated that the side yard setback was three feet. He
explained that moving the spa back 24 inches and placing it below
ground would not cause neighbors undue harm. He stated that it was a
safety issue as room was needed to move around the spa.
Discussion noted the following:
Should the spa be moved further than three feet from the side wall, it
would not eliminate the problem with the column
*The spa was positioned in the largest area of the yard.
*The porch column was placed in the ground at a 45 degree angle and
would put weight on the spa.

—The plans as presented were considered by Mr. Staples to be the best
use of space and took into consideration engineering and safety issues.
—The pool setback was measured three feet from the wall to water's edge.
MOTION: A motion was made by Member Fields and seconded by Vice
Chair Parisi to approve the variance.
Member Fields stated that he felt the criteria were met in order to approve
the variance. Member Parisi concurred.
MOTION carried, 3-0.

welcoming the board's newest member, Sandra Hoy -Johnson; however Ms.
Hoy -Johnson was unable to attend today's meeting.

BOARD OF ADJUSTMENT REPORT
CASE NO: OV10-09-03
Hearing Date:
Agenda Item No.:
Prepared By:
REQUEST
October 27, 2009
1
Patty Hayes, Zoning Inspector
Cimarron Circle Construction representing Manas Jain and Sirisha Maddipoti requests a variance
from the required 5' rear yard setback to 3' for an inground spa. Subject: (parcel #224-28-3190)
located at 10750 N. Chapin Ct, Oro Valley, AZ, 85737.
REQUEST SPECIFICS
Manas Jain and Sirisha Maddipoti requests approval to build an inground spa in their back yard with a
decreased rear yard set back of 3'. The rear yard setback for the River's Edge subdivision is 10'. The
OVZCR section 25.3.d provides an exception for swimming pools to be as close as 5' to the rear
property line. This request is to decrease the pool set back and additional 2'.
Spa requirements are the same as a swimming pool, per the OVZCR definition of swimming pool.
The OVZCR defines a swimming pool as an inground or above ground body of water of more than
18" in depth and an area more than 38 square feet.
SITE LOCATION
This property is located in the Rivers Edge II subdivision on the north side of Lambert Lane.
NOTIFICATION
All property owners within 300 feet of this property were notified of this hearing by mail. The
property is posted with a notice of hearing, posted online at www.orovalleyaz.gov and was
advertised in the Daily Territorial. At the time of this report preparation staff had received no
comment in support or opposition for this case.
EXISTING LAND USE AND ZONING
Subject property — Existing house zoned Planned Area Development (PAD)
North — Common area owned by Rivers Edge II zoned PAD
West - Across common area is the Highlands Mobile Home Park zoned SDH
East - Existing home zoned PAD
South - Common area owned by Rivers Edge II zoned PAD
SITE INFORMATION
This lot is located in the Rivers Edge II subdivision. Rivers Edge is a 50 lot subdivision recorded in
Oro Valley in 2005. Rivers Edge II is part of the Melcor Planned Area Development zoned PAD.
Lots in Rivers Edge II are mass graded by the developer. Subject property is a 6,277 square foot lot.
SUMMARY
Finding of Facts
• This subject lot is surrounded by common area on three sides. The fourth or north side
of the lot has one adjacent neighbor. This neighbor is located on the opposite side of
the yard where the proposed spa will be built.
• The proposed spa is located in the largest section of the back yard.
• The back yard is 15'wide at the proposed spa location. The proposed spa is 8' wide
plus the required 5' rear yard setback would leave 2' of walking space between the
porch column and the spa's waters edge.
• The requested 2' setback reduction will allow a 4' walkway between the porch column
and the spa's waters edge.
• Setbacks are measured from property line to spa's waters edge. Cool decking
surrounding the spa can be built into the setbacks.
• The proposed spa will meet the required 3' side yard setback as required by the
River's Edge II final plat.
The Board of Adjustment should consider the following findings in making its decision:
A. There are special circumstances or conditions applying to the property referred to in
the application including its size, shape, topography, location or surroundings which
do not apply to other properties in the district; and
B. special circumstances were not created by the owner or applicant; and
C. the authorizing of the variance is necessary for the preservation and enjoyment of
substantial property rights; and
D. any variance granted imposes such conditions as will assure that the authorizing of
the adjustment shall not constitute a grant of special privileges inconsistent with the
limitations upon other properties in the vicinity and zone in which such property is
located; and
E. the authorizing of the variance will not be materially detrimental to persons residing
in the vicinity, to adjacent property, to the neighborhood or the public welfare in
general.
