The 80' was originally enforced by Pima County in 1993 for future widening of Tangerine Road. Now that the road has been widened and there is no danger of future condemning by Oro Valley on this property for widening, I would like to install a swimming pool and have room for future expansion of a guest house and garage. The new 40' will match the front and rear property setbacks. The south side setback is 10'. If necessary attached written narrative. APPLICANT: PHONE: ( ADDRESS: City Oro Valley. MBH 34, TZ1 APPLICABLE FEE: $150.00 ATTACH- N1ENTS: SIGNATURE OF Steven C. Noble Revised 11-20-08 DATE 1/15/2010 SUPPLEMENTAL QUESTIONS FOR APPLICATION FOR A VARIANCE Please provide the following information addressing 1— 5 in the Findings from Section 21.6 I of the Oro Valley Zoning Code Revised (OVZCR). In order to authorize a variance request, the Board will be searching for sufficient evidence in accordance with the findings. Please answer the questions below in a narrative format. 1. Are there special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district? The major challenge with any future building expansion or addition of a pool is the topography. Directly south of the existing home is the septic tank, so any building on the south end of the home is not possible. Directly south of the homes backyard wall is a 35' drop to a wash bed and all of the land is unbuildable all the way to the lot line. The size of the buildable area(per setbacks) was extremely difficult to fit this home in the beginning, now we are looking into the addition of a pool and possible expansion of a guest house, our only option is the north end of the property. 2. Are there special circumstances that exist that are not self imposed or created by the owner/applicant? As mentioned in question #1 the special circumstance is the topography of the land and the imposed setbacks. We adjusted our home when we built it to fit these setbacks and we could not take full advantage of the views out of our back windows due to the difficult requirements. 3. Is the authorizing of the variance necessary for the preservation and enjoyment of substantial property rights? If the request for this variance was not granted, there are no other options for the addition of a swimming pool for the enjoyment of our family. The investment of our purchasing 1.1 acres in Oro Valley and not being able to utilize our acreage to expand our home as our family has expanded would be an unnecessary hardship on our family as well as hindering our desires for our children. 4. If granted, will the variance impose such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? To the best of my knowledge, it would not in any way grant any special privileges. I have spoken with the town of OroValley Engineers and they also do not see any problems with the future additions or expansion. Even if I were to add the pool, guest house and garage, I still will be approximately 30'- 40' further setback from Tangerine road than my neighbor is, who just finished multiple additions to his home. 5. If granted, will the variance be the minimum necessary to afford relief and will not materially affect the health, safety, and welfare of the neighborhood or surrounding properties. The 40' setback would be the minimum needed if all additions were to come to fruition. The pool would need approximately 15'-18' to complete the project. It would be the future addition of a guest house and garage that would need the full 40' and would also match the current 40' buffer that is set per the plat. The pool is slated to start construction as soon as possible, while the garage is undecided as to whether it will be constructed at the same time as the pool. Guest house to follow.
