Subject: Parcel #224-40-0360 located'at 1721 W. Placita Caracol, Oro Valley, AZ, 85737. REQUEST SPECIFICS: The owner of the subject parcel proposes to remodel the existing 1,404 square foot single story home into a two story 3,990 square foot home. The Oro Valley Zoning district R1-36 limits the building height to 18'. The applicant requests to increase the height to 22' for the new addition. NOTIFICATION: All property owners within 300 feet of this property were notified of this hearing by mail. The property is posted with a notice of hearing, posted online at www.orovalleyaz.gov and was advertised in the Daily Territorial. At the time of this report, staff had received no comments in support or opposition for this case. One caller left a message stating concern that this case may set precedence for future remodels in the neighborhood. EXISTING LAND USE AND ZONING: Subject property — Existing single family residential zoned RI -36 North —Existing single family residential zoned R1-36 West- Vacant land zoned R1-144 East- Existing single family residential zoned R1-36 South - Existing single family residential zoned R1-36 SITE INFORMATION: Subject property is lot 447 of the Rancho Feliz subdivision near the southwest corner of La Canada Drive and Lambert Lane. The lot is a .99 acre (42,990 square foot) pie shaped parcel that slopes downward from the existing house to the front, side and rear of the property. Most likely the top of a hill was cut to create a flat building pad and yard for the original construction. i SUMMARY: Finding of Facts • The property was built in 1983 while under Pima County's jurisdiction. The house and subdivision were annexed into Oro Valley in 1989. • The former CR-1 Pima County zoning would have allowed for a 34' building height. After annexation the CR-1 zoning was translated to Oro Valley's R1-36 zoning limiting building height to 18'. • Current house is 11'4" in height. • Building height will be measured from grade to the highest point of the house excluding chimney. The applicant states there will be no fill dirt used; therefore building height is all structure. • This variance is for building height only. New construction will have to comply with the current building setbacks of 30' front yard, 15' side yard and 40' rear yard. • Two story houses must be reviewed by the Development Review Board. The applicant will have to submit an application for DRB if the building height increase is approved. • Additional plan review will be required during the permitting phases because the final plat requires that this lot comply with hillside development standards and requires a flood plain use permit. ■ This variance request is for an attached addition, but the applicant makes reference to other detached buildings in the neighborhood. The Oro Valley Zoning Code requires the building height of detached accessory buildings not exceed the height of the main house. This subdivision does have detached buildings that may exceed the height of the main house, most likely built prior to current code requirements. • Most houses immediately surrounding the subject property have maintained their original building heights. ■ There have been several variance cases for setback reductions in the Rancho Feliz subdivision and one case for building height increase. The building height variance was denied in 1993 by the Board of Adjustment for the adjacent house next door at 1720 W. Placita Caracol. • Applicant states she has reduced the proposed mass of the two story structure from the entire length of the house down to the northern half (right side) of the house due to neighbors' concerns. The Board of Adjustment should consider the following findings in making its decision for each variance request: A. There are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; and B. Special circumstances were not created by the owner or applicant; and C. The authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; and N D. Any variance granted imposes such conditions, as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and E. The authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. SUGGESTED MOTIONS: The Board may wish to consider the following motions: I move to [approve, approve with conditions, or deny) OV 10-10-04 variance request to increase the building height from 18' to 22'. In order to authorize a variance request, the Board will be searching for sufficient evidence in accordance with the findings. Please answer the questions below in a narrative format. 1. Are there special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district? 2. Are there special circumstances that exist that are not self imposed or created by the owner/applicant? VC 3. Is the authorizing of the variance necessary for the preservation and enjoyment of substantial property rights? t4 N-AW--A 7UC 4. If granted, will the variance impose such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? 5. If granted, will the variance be the minimum necessary to afford relief and will not materially affect the health, safety, and welfare of the neighborhood or surrounding properties. Revised 11-20-08 AA NATURE OF THE REQUEST: Due to the steep topography, location of the house, and irregularly shaped lot, the applicant requests a variance from the required 18' building height, up to 22', when measured from natural grade on a lot with a greater than 6 percent slope, to build an addition. The subject property, 1721 W. Placita Caracol, Oro Valley, AZ 85737 (parcel 224-40-0360) is located in the Hillside Development Zone. 1. Are there special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district? There are special circumstances that apply to the subject property which do not apply to other properties in the district. These special circumstances include a steep topography (greater than 24% slope beneath current residence), irregularly shaped lot, and the position of the house on the lot. [See attached pages 1-3] 2. Are there special circumstances that exist that are not self imposed or created by the owner/applicant? The topography, position of the house, and irregularly shaped lot was not created by the homeowner. Due to the steep topography constraints of the lot, the original house was built to the rear (west) of the lot. [See attached page 2] 3. Is the authorizing of the variance necessary for the preservation and enjoyment of substantial property rights? The proposed addition is necessary for the preservation and enjoyment of substantial property rights. The current residence has 1,404 livable square feet and contains one master bedroom, one small bedroom, two full bathrooms, and a small kitchen/living/dining area. The applicant is requesting an addition to update the current residence to accommodate a family of five and a grandparent. The current residence cannot accommodate a family of five and a grandparent. The addition will include two bedrooms, one and a half bathrooms, den/sitting room, and a bonus room (game/media room). The addition will also expand the existing great room which includes a kitchen, dining room, and living room. [See attached pages 5-7] The existing great room is very small. It cannot accommodate six people. The living area can only accommodate seating for four people and not comfortably. The size of the kitchen will only accommodate two people in it at one time. The amenities being added with the addition is not out of the ordinary for the neighborhood or the town of Oro Valley. With the addition, the entryway to the current garage will be relocated from the front of the property (east) to the side of the property (north). Two additional garage spaces will also be added. The current location of the entryway to the garage makes it almost impossible to maneuver in and out of the garage. There is only approximately 18 feet before the lot slopes downward at a rate between 25 and 99.9 percent to maneuver in and out of the garage (turnaround area). [See attached pages 2 and 3] In comparison, the standard distance required to maneuver in and out of the garage is 25 to 28 feet. The north side of the property is the best location to accommodate the turnaround area for the garage. By relocating the entryway of the garage from the east side of the residence to the north side, two garage spaces can be added without encroaching into the rear setback or relocating the circle driveway. A four car garage is not unusual for the neighborhood. There are several four car garages in the neighborhood as well as five and six car garages. A four car garage is necessary to prevent the pack rats from chewing the electrical wires in vehicles. An entryway from the garage into the residence, which currently does not exist, will also be included with the addition. [See attached page 5] 4. If granted, will the variance impose such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? Granting the variance will not be granting a special privilege. Everything included in the proposed addition is already present in the neighborhood. There are several houses in the neighborhood with four car garages and some with five and six car garages. There are also buildings in the neighborhood' that exceed the maximum building height of 18 feet. The applicant spoke with a homeowner in the neighborhood who has a detached building behind their residence. The roof of the detached building was higher than the roof on the residence. When the applicant asked the homeowner how tall the detached building was the homeowner said approximately 21 to 22 feet tall. [See attached page 10] This detached buildings doe not stand out in the neighborhood because there are several houses in the neighborhood with the height of 18 feet. The size of the home including the proposed addition is not inappropriately large for the lot, neighborhood, or the Town of Oro Valley. Since the majority of the lots are not restricted by the topography of their lots, houses were able 'to be built with varying grades and setbacks (maximizing views) with a large amount of buildable area behind the houses. The varying grades and setbacks allow each lot to have views as well as preserve the natural open space between the lots. The natural open space between the lots provides privacy for the homeowners and eliminates the feeling of being surrounded by houses that are, figuratively speaking, built on top of each other. Without the topography restraints and regularly shaped lots, the homeowners are able to utilize more of their lot. There are numerous houses in the neighborhood that have built additions and/or detached buildings (guest houses and garages) without having to address setback and/or topography restrictions. This has allowed homeowners to have houses in excess of 3,000 with detached buildings including six car garages. The applicant is asking for the same out of built space, but utilizing it differently. 5. If granted, will the variance be the minimum necessary to afford relief and will not materially affect the health, safety, and welfare of the neighborhood or surrounding properties. If granted, the variance will be the minimum. necessary to afford relief and will not materially affect the health, safety, and welfare of the neighborhood or surrounding properties. The addition was designed to have the least impact on the neighbors and ground (vegetation and slope), thus preserving and most likely increasing everyone's property values. Nobody's views will be obstructed by the proposed addition. In locating the buildable area that had the least impact on the neighbors and ground for the addition, all directions of the existing residence were analyzed and the applicant spoke with all of the neighbors within 300 feet regarding the addition. When the applicant presented the proposed addition to the neighbors, all of the neighbors except for two did not have any concerns with the proposed addition. [See attached i pages 12-1 ZJ The proposed addition presented to the neighbors had a proposed height from 19 feet to 22 feet 7 inches tall. [See attached page 11] The concerns raised by the two neighbors were valid concerns the applicant would not have been aware of without speaking with the neighbors. The original plans were redesigned to accommodate the neighbor's concerns. Each direction of the residence along with the neighbor's concerns will be addressed below: WEST: The steep topography constraints of the lot required the original house to be built to the rear of the south end of the lot. For this reason, the buildable area to the west (rear) of the residence is minimal. There is only approximately seven to nine feet of buildable *area to the west before one starts to encroach into the rear setback. Since it is more detrimental to the adjacent properties to build in the front (east) of the residence (discussed later) and there is minimal buildable area in the front, the addition will utilize - the majority of buildable area to the west (rear) of the property. Where there is approximately nine feet of buildable area to the west, the addition will utilize eight feet. Where there is approximately seven feet of buildable area to the west, the addition will utilize four feet. The difference allows for a setback which reduces the massiveness look of the length of the rear wall of the proposed residence. [See attached pages 2 and s] SOUTH: The south end of the residence/lot is where the two neighbors had concerns. The neighbor located at 1707 W. Placita Caracol informed the applicant their master bedroom looks at the south end of the applicant's residence/lot. In the applicant's original plan, the south end of the residence had a proposed height of 19 feet. The neighbor was concerned the height would prevent them from seeing the sky at night. For this reason, the applicant modified the original plan by reducing the proposed height from 19 feet to 13 feet. [See attached pages 4 and 11 ] The neighbor located at 1711 W. Placita Caracol was concerned with the addition infringing upon their privacy. In the applicant's original plan, the addition extended four and a third feet south with a 15 foot patio beyond the four and a third foot extension. [See attached page I I] Due to the varied grades in the cul-de-sac and the position of the applicant's house and 1711 W. Placita Caracol, it would be difficult (without encroaching into the rear setback) to build to the south of the residence without infringing upon the neighbor's privacy. With the varied grades in the cul-de-sac, 1711 W. Placita Caracol is lower than the applicant's residence. There is currently a bank on the south end of the applicant's residence preventing the applicant from seeing into 1711 W. Placita Caracol's back yard. If the applicant built on the south end of the residence, the bank would have to be removed, thus exposing 1711 W. Placita Caracol's back yard. This would be detrimental to the property value of 1711 W. Placita Caracol. In the future, if the applicant decided to install a pool, which is common in the neighborhood, the south end of the residence would be the only location to install a pool without encroaching into the side or rear yard setbacks. This would also maintain the privacy of 1711 W. Placita Caracol because the bank would remain intact. It would also be aesthetically displeasing to add an addition to the south end of the residence. The existing residence is already three times wider than deep. [See attached page 5] To notably elongate the house any longer would diminish the property values of the applicant, adjacent properties, and neighborhood. NORTH: The buildable area to the north is limited due to the steep topography. The buildable area ranges from approximately four and a half feet to 22.5 feet before the lot slopes downward at a rate between 20 to 25 percent. [See attached pages 2 and 3] As stated earlier, it would also diminish the property values of the applicant, adjacent properties, and neighborhood by building on the north end of the residence. The residence is already three times wider than deep. To notably elongate the residence would be aesthetically displeasing. This would negatively affect the property values of the neighborhood. Due to the topography, the current dimensions of the residence, and the need to relocate the entryway to the garage, the north end of the residence is the best location for the entryway ofthe garage. The current location of the entryway to the garage (east) makes it almost impossible to maneuver in and out of the garage. By relocating the entryway of the garage from the east side of the residence to the north side, two garage spaces can be added without encroaching into the rear setback, notably elongating the residence, or relocating the circle driveway. By locating the entryway of the garage on the north end of the residence, the residence is only extending seven and a half feet rather than 26 feet. [See attached page 5] It would also prevent four garage doors from being visible in the front of the residence, which increases the curb appeal from the street. EAST: Due to the steep topography and mature vegetation, the buildable area to the east (front) of the property is minimal. The lot begins to slope downward at a rate of 25 to 99.9 percent immediately after the driveway, which is located directly in front of the residence. [See attached page 3] From the residence, the buildable area to the east ranges from 32.5 feet on the south end of the residence to 13 feet on the north end of the residence. The actual distances from the residence to the end of the driveway are five feet longer than the dimensions just provided. [See attached page 2] However, in accordance with the building code, buildings must be setback from the top of the slope by a minimum of five feet. Due to the steep topography, if the addition was built to the east (front) of the residence, a grading variance and a height variance will be needed. The amount of fill needed to build the addition east of the residence would exceed the six foot maximum cut and fill requirement, thus requiring a grading variance. It is estimated approximately eight feet, if not more, would have to be filled just for the residence and the required five foot minimum setback of the residence from the top of the slope. This would only allow ten feet, and possibly less, for the foundation and the residence. This would not be enough height for the addition, thus a height variance would have to be requested. By placing the addition to the east of the residence, a large retaining wall would have to be built. This would scar the contours of the natural slope of the lot and negatively impact the property values for the applicant, adjacent properties, and neighborhood. The location of mature vegetation also limits the buildable area to the east of the residence. If the addition is placed east of the residence, mature native plants including Palo Verde trees and saguaros would have to be relocated or destroyed. Due to the size of the trees and saguaros, it would be difficult to relocate them with the assurance they would survive. If the Palo Verde trees were relocated or destroyed, the applicant's house would become visible from the street view in the cul-de-sac. Currently, these Palo Verde trees completely shield the applicant's residence from the street view of the cul-de-sac. [See attached page 8] If the Palo Verde trees were retained in their current locations and the requested height variance was granted, only a top portion of the proposed addition would be visible from the street view in the cul-de-sac. The rest of the proposed addition would be shielded from the street view in the cul-de-sac. Building the addition to the east of the residence will be more detrimental to the views of adjacent properties than building up. With the current setbacks (properties to the north and south) in comparison to applicant's property, the properties to the north and south have panoramic views of natural open space. [See attached page 9] By placing the addition east, it will obstruct 1720 W. Placita Caracol's views facing south, which consist of the Town of Oro Valley and the City of Tucson. Placing the addition east will also obstruct 1711 W. Placita Caracol's views facing north. They would no longer have the The height being requested, 22 feet, is the minimal amount needed to build the proposed addition. This allows nine feet for the first floor; two feet for the floor joists and HVAC; nine feet, if not less depending on slope of flat roof, for the second story; and two feet for the roof joists, HVAC, and slope of flat roof. Granting the variance will be the least intrusive on adjacent properties and the ground. Granting the variance will allow the integrity of the plot locations to stay intact; allow the mature native plants to stay intact; keep the integrity of the natural landscape and slope; allow the circle driveway (it would just be narrower) to stay intact; and has the least impact on adjacent properties. First, our property values would probably go up with the improvements made on Kylie's property and it would spur others to do projects on theirs. The extra taxes generated would also help Oro Valley's coffers. Second, no one in the culdesac would be effected. " Posted: 05 20 10 9:00 a.m. cp RANCHO FELIZ LOT 447 Building Height Variance OV1010-04 Engineering Comments, 1St Submittal David Laws, P.E. May 19, 2010 The Town of Oro Valley Public Works Department has reviewed this submittal and has no comments regarding the proposed variance request. However, please note that the project must still be checked for compliance with Hillside Development Zone requirements. See the comments below for additional information to assist you during the Building Permit and Grading Permit submittal process: General Comments 1. Per the Final Plat, this parcel is subject to Article 44 of the Hillside Development Zone (HDZ) Ordinance. Article 44 of the HDZ Ordinance refers to an old version of the current Pima County HDZ Ordinance located within the Pima County Zoning Code, Chapter 18.61. Per the Oro Valley Zoning Code, any recorded subdivision plat approved in compliance with the Pima County HDZ regulations may be developed in compliance with the conditions and stipulations as approved (Section 24.2.C.2). Please coordinate with the Planning and Zoning Department to determine the Pima County HDZ Ordinance to be applied to this project (i.e. original Article 44 Ordinance or current Ordinance per Chapter 18.61) or if the current Oro Valley HDZ Ordinance may be used if desired by the applicant. 2. HDZ requirements place restrictions on the amount of grading that can occur on a particular lot. The type of information and analyses to be submitted with the Building/Grading Permit submittal will vary depending on the HDZ Ordinance applied to this project. This may also include whether or not an Average Cross Slope Analysis, Sloped Area Analysis, etc. will be required to be certified by a qualified registrant, for review and verification by the Town Engineer prior to any clearing, grading or the issuance of a Building Permit or Grading Permit. Once the applicable HDZ Ordinance is determined for this project, coordinate with the Planning and Zoning and Public Works Departments for HDZ submittal requirements to accompany Building/Grading Plans. If you have any questions, please call David Laws at (520)229-4808. GENERAL NOTES NOTES (cou'r.)
