GOVERNMENT REVIEW TASK FORCE
MEETING MINUTES
JUNE 04, 2001
• A Special Meeting of the Government Review Task Force was called to order
by Chairman Loomis at 4:10 p.m.
• ATTENDANCE:
• Chairman Paul Loomis
• Vice-Chairman Jim Kriegh

• Dan Dudley
• APPROVAL, OF MINUTES. Vice-Chairman Kriegh motioned for approval
of the May 21, 2001 meeting minutes. Seconded by Don Dvorak. Motion
carried 5-0.
• COUNICL POLICIES/PROCEDURES. Chairman Loomis opened the
continued discussion concerning the revised final draft of the Council Policies/
Procedures. In the latest version, all of the proposed revisions have been
accepted and any of those modified revisions will be listed below. In addition,
all other sections discussed have been listed below. Vice-Chairman Kriegh
began by noting changes in reference to a few titles and/or page numbers in
the table of contents. Also, Vice-Chairman Kriegh noted that in most cases
the word "Town" should be deleted when it proceeds "Council" to remain
consistent throughout the document.
• § 1.1(C) —Vice-Chairman Kriegh proposed that a name change occur
since the Town Council Policies document may be confused with the
Town Council Policies & Procedures document. The Town Council
Policies & Procedures will now be known as the Town Council Rules &
Procedures.
• § 3.1 — this provision should read, "The Mayor, or in the Mayor's absence,
the Vice-Mayor is the Presiding Officer of all meetings of the Council. A
Mayor Pro Tempore shall be appointed by the Mayor, or by the Council if
the Mayor is unable to make such an appointment, and that person shall
serve until the return of the Mayor or Vice-Mayor. In the absence of both
the Mayor and the Vice-Mayor, the meeting shall be called to order by the
Town Clerk, whereupon, the Town Clerk shall immediately call for the
selection of a Mayor Pro Tempore."

• § 4.1(B) —the last sentence is deleted
• § 4.3(A) —this provision should read, "In accordance with Section 2-4-2 of
the Oro Valley Town Code, Special meetings may be called by the Mayor,
and notice shall be posted by the Town Clerk at least twenty-four (24)
hours prior to the meeting or by a majority of the Council and notice shall
be posted by the Town Clerk at least forty-eight (48) hours prior to the
meeting."
• § 4.4(A) —this provision should read, "Study Sessions offer the Council an
opportunity to study items in an informal manner. No action may be taken
during a Study Session. Such meeting shall be held at the call of the
Mayor or the call of three or more Council Members. In the absence of
having a quorum, a Study Session shall be declared a Sub-Committee
meeting of the Council, and shall continue to follow these Rules &
Procedures."
• § 4.5(A) — Chairman Loomis asked that Town Attorney Dan Dudley add all
scenarios to hold an Executive Session meeting.
• § 4.6 — accepted as revised by the Town Attorney
• § 5.1(B) — after the Town Hall Courtyard and Oro Valley Police
Department address, this provision should read, "...or as established by
the Disclosure Statement of the Town Council."
• § 5.2(A) —the third sentence should read, "...the Agenda Committee shall
meet on or about the Monday following the deadline..."
• § 8.5 — accepted as revised by the Town Attorney
• § 8.8 — accepted as revised by the Town Attorney
• § 9.1(F) — [formerly § 9.1(H)] the second sentence should read, "Once the
Public Hearing is closed, no additional oral...."
• § 9.1(G) — [formerly § 9.1(F)] this provision should read, "The proponent
shall be allowed to answer questions posed by the Council, a brief
statement to rebut statements made by the public, and/or to offer a
compromise."
• § 9.1(H) — [formerly § 9.1(G)]
• § 10.2 —the fifth sentence is revised by deleting the word "meeting"
• § 10.7 — accepted as revised by the Town Attorney, in addition, the last
sentence is revised by deleting "regular" prior to "rules."
• § 10.8 —this provision should read, "The Mayor shall ask Council
Members to designate his/her vote by announcing "aye" or "nay." If a
Council Member abstains from voting, that vote is considered a neutral
vote. The effect of the abstention, whether through deliberate neutrality or
otherwise, may have the effect of a "nay" vote. If, prior to the vote or after
the vote, any Council Member requests a Roll Call vote, the Town Clerk
shall call Roll, and each Council Member shall state his/her vote aloud."
• § 10.11 — accepted as revised by the Town Attorney
• § 12.4 —the title is revised to read as, "Substantial Interest"

• § 12.8 —the revisions in the second sentence were not accepted, and the
fourth sentence, is revised to read, "The Council Member who declared
the conflict may return to their seat when the agenda item is completed."
• § 12.9 — accepted as revised by the Town Attorney, however, deleting the
last sentence.
• § 12.11(C) — the "public officer" text is replace with "Council Member" text
• § 13 — this entire section is deleted from this document and will become
part of another document concerning the appointment to Boards,
Commissions, Committees, Advisory Boards, and Task Forces
• § 14.1 — [now § 13.1]
• § 14.2 — [now § 13.2] this provision is revised to read, "Council Members
shall meet in accordance with the Arizona Open Meeting Law and as
required by Arizona state law discussing only those issues noted on the
agenda. Council Members shall only discuss and decide issues at a
properly noticed public meeting."
• § 14.3 — [now § 13.3]
• § 14.4 — [now § 13.4]
• § 14.5 — [now § 13.5] the second sentence should read, "The Council
Member shall not use their position to influence the vote and shall remove
themselves from the Council Chambers while the conflicted matter is
considered."
• § 14.6 — [now13.6]
• § 14.7 — [now13.7]
• § 14.8 — [now § 13.8] accepted as revised by the Town Attorney
• § 14.9 — [now13.9]
• § 14.10— [now § 13.10]
• § 14.11 — [now § 13.11] the first sentence should read, 'A Council Member
may serve..."
• § 14.12— [now § 13.12] this provision should read, "Council Members shall
be available at reasonable times to Town residents for the conduct of
official Town business."
• § 14.13 — [now § 13.13] this provision should begin, "Council Members
shall seek improvement..."
• § 14.14 — [now13.14]

• ADJOURNMENT. Larry Holden moved to adjourn at 6:00 p.m. Seconded
by Marilyn Cook. Motion carried 5-0.
