HomeMy WebLinkAboutMinutes - Government Review Task Force - 3/26/2001 TOWN OF ORO VALLEY GOVERNMENT REVIEW TASK FORCE MEETING MINUTES MARCH 26, 2001 • A Special Meeting of the Government Review Task Force was called to order by Chairman Loomis at 4:07 p.m. • ATTENDANCE: • Chairman Paul Loomis • Vice-Chairman Jim Kriegh • Marilyn Cook • Don Dvorak [absent] • Richard Feinberg • Larry Holden • Susan Baczkiewicz • Kathi Cuvelier • Dan Dudley [absent] • APPROVAL OF MINUTES. Richie Feinberg motioned for approval of the March 19, 2001 meeting minutes. Seconded by Vice-Chairman Kriegh. Motion carried 4-0. • COUNCIL MEMBERSHIP. Chairman Loomis opened the discussion concerning the upcoming Public Opinion Forums (POF). He suggested a revision to Slide #5 (to delete the word "approximate") and to Slide #13 (to include budget information). Chairman Loomis suggested a number of possibilities as to how to present the PROs/CONs in order to encourage more discussion. It was decided by the GRTF, that starting with Slide#15, Richie Feinberg will present the PROs/CONs and then Chairman Loomis will ask the panel for any further comments before opening the discussion to the audience. As with the previous POF, the Council Membership Report and a hard copy of the PowerPoint slides will be made available to the public in back of the Council Chambers along with a copy of the Districting Report for those who may be interested. The POF agenda will be as follows: • 1 — Introduction of the GRTF members and why the POF is necessary (Chairman Loomis) NOTE: Copies of the Council Membership report will be made available to the public at the door. • 2 — Brief explanation of the Town government (Chairman Loomis) • 3 — Presentation concerning the Council Membership from a 5-Member Council to a 7-Member Council. (Richie Feinberg with slides by Civil Paralegal Susan Baczkiewicz) • 4 — Questions/Answers (GRTF) NOTE: Questions should be written on a "blue card" to keep record of the questions. F:\Govt Task Force\Minutes 032601 1 • NEW BUSINESS. Marilyn Cook motioned to continue the discussion concerning the Council Chambers sound system and podium. Seconded by Larry Holden. Motion carried 4-0. • COUNICL POLICIES/PROCEDURES. Chairman Loomis resumed the review of the Council Policies/Procedures at Section 12. • § 12.1 — add "in-laws" to text regarding definition of relatives. • § 12.2 — discussion concerning an appearance of a conflict is not enforceable under Arizona law. • § 12.6 —Town Attorney Dan Dudley will verify amounts pursuant to Arizona law and Town Code. • § 12.7 —Town Attorney Dan Dudley will verify whether verbiage needs to be added encouraging a Council Member to speak with him to help p determine whether a conflict exists. • § 12.8 — in the last sentence, the word "chambers" replaced the word "table." • § 12.9 —Town Attorney Dan Dudley will verify this provision pursuant to Arizona law. • § 12.10 — in the first sentence, the text "and employee" was deleted. In addition, Town Attorney Dan Dudley will verify this provision pursuant to Arizona law. • § 12.11 — Town Attorney Dan Dudley will verify this entire provision pursuant to Arizona law. • § 12.11(C) —the text "or employee" and "or employment" was deleted. • § 12.11(E) — Town Attorney Dan Dudley will verify the discussion concerning a distinction between lawsuits against a Council Member as an individual versus in their official capacity where the Town would pay on a judgment for a Council Member working in their official capacity. • § 13 — this provision is under review by the GRTF by separate action. • § 14.3 —Town Attorney Dan Dudley will verify whether additional text, "attorney privilege" should be included in this provision. • § 14.5 —the last sentence shall be revised to read, "The Council Member shall not use his/her position to influence the vote and shall remove himself/herself from the Council Chambers while the matter is considered." • NEXT MEETING(s). • FORUM:O ROtOpiggappti#017.1411401:01g:;ipp106. ... ..............................................:........ .................... • SPECIAL: Chairman Loomis declared the next Special meeting date on Monday,y, . regarding the final second draft" of the Council Policies/Procedures where all revisions made by the GRTF have been incorporated and highlighted for final review. • REGULAR: Chairman Loomis confirmed the next regular meeting date of Monday,a Y, ........:..:.:.:::,:..:............:.....:..... ...............:......:..:.:. : 0 _r• That upcoming agenda will cover the following: F:\Govt Task Force\Minutes 032601 2 • Approval of April 16, 2001 Minutes • Discussion of the Appointments to Boards/Commissions • Discussion of the draft Application • New Business • Discussion of Next Meeting/Agenda .
