Chuck Trujillo seconded the motion. Motion carried unanimously. OLD BUSINESS: REVIEW MEDICAL BOARD FINDINGS: 1) Officer Tucker filed the Application for Disability on June 11, 2004. The waiver of confidentiality was also filed on June 11, 2004. No questions or concerns; all members in agreement with information. 2) The disabling incident occurred March 8, 2001 and Officer Tucker was still employed as an Oro Valley Police Officer. No questions or concerns; all members in agreement with information. 3) Dr. Thrasher conducted an independent medical evaluation on June 23, 2004 in Tucson. No questions or concerns; all members in agreement with information. 4) Accidental Disability Retirement Questionnaire Responses: a. Officer Keith Tucker's physical condition would permanently prevent him from performing his job duties as a police officer. b. Officer Keith Tucker did not have a physical condition or injury that existed or occurred before the claimant's date of membership with the PSPRS. (Officer Tucker joined the retirement system September 6, 1982 and a copy of his Arizona Peace Officer Standard and Training Medical History Questionnaire and Medical Examination Report, which was completed prior to starting the Oro Valley Police Department and during the Oro Valley Police Department hiring process, are attached.) OV PSPRS Minutes 8/10/2004 Page 1 of 2 c. The disabling injury was incurred in the performance of Officer Keith Tucker's duty as a police officer. (See Supervisor's Report of Industrial Injury) CONSIDERATION AND/OR POSSIBLE ACTION REGARDING THE ACCIDENTAL DISABILITY APPLICATION RECEIVED FROM OFFICER KEITH TUCKER 5) Chuck Trujillo moved to approve the application for disability retirement by Officer Keith Tucker finding that it meets all three issues presented to the medical board and that it is based on medical evidence by a doctor or clinic appointed by the local board which establishes an accidental disability. Seconded by Richard Tracy Sr. Motion carried unanimously. The packet was previously submitted to PSPRS. Dr. Thrasher's signed Accidental Disability Retirement Questionnaire will be sent with today's minutes and submitted to the PSPRS by fax today and also sent overnight to PSPRS. Sgt. Trujillo will confirm that PSPRS received the packet. The Board will receive copies of the minutes for review. Since the board is not scheduled to meet until the annual meeting in February 2005, they will not be able to approve the minutes until then. The minutes will be sent in draft format to the PSPRS. Item 10 of the Accidental Disability Checklist was not applicable to Officer Tucker. REVIEW OF RETIREMENT APPLICATION No questions. The Board members reviewed Officer John Leigh's application for retirement. Richard Tracy, Sr. moved to accept Officer John Leigh's normal retirement. The Board recognizes that an adjustment on the final contribution may be necessary due to Officer Leigh's potential for overtime. This adjustment is acceptable to the Board Seconded by Chuck Sweet. Motion passed unanimously. NEW BUSINESS: The Board wants Human Resources and/or Finance to reconfirm the years of service and the calculations after they have been calculated, submitted to PSPRS then are accepted and agreed upon by PSPRS that they are within acceptable range.
