APPOINTMENT OF NEW BOARD MEMBER

OATH OF OFFICE
Richard J. Tracy Sr. took the Oath of Office as Board Member for the Oro Valley Public
Safety Personnel Retirement System (PSPRS).
REVIEW ACCIDENTAL DISABILITY APPLICATIONS
A. APPLICANT'S PRESENTATION: Leigh Horetski was provided the
opportunity to address the board. She declined.
B. REVIEW MEDICAL BOARD FINDINGS:
1) Officer Horetski filed the Application for Disability on October 1, 2003. The
waiver of confidentiality was filed on October 28, 2003.
No questions or concerns; all members in agreement with information.
2) The disabling incident occurred November 12, 2001 and Officer Horetski is
still employed as an Oro Valley Police Officer.
No questions or concerns; all members in agreement with information.
3) Dr. Thrasher conducted an independent medical evaluation on October 29,
2003 in Tucson.
No questions or concerns; all members in agreement with information.
4) Accidental Disability Retirement Questionnaire Responses:
a. Officer Leigh Horetski's physical condition would permanently prevent
her from performing her job duties as a police officer.

b. Officer Leigh Horetski did not have a physical condition or injury that
existed or occurred before the claimant's date of membership with the
PSPRS. (Officer Horetski joined the retirement system upon starting the
academy and a copy of her Arizona Peace Officer Standard and Training
Medical History Questionnaire and Medical Examination Report, which
was completed prior to starting basic academy during the Oro Valley
Police Department hiring process, are attached.)
c. The disabling injury was incurred in the performance of Officer Leigh
Horetski's duty as a police officer. (See Supervisor's Report of Industrial
Injury)
CONSIDERATION AND/OR POSSIBLE ACTION REGARDING THE
ACCIDENTAL DISABILITY APPLICATION RECEIVED FROM LEIGH
HORETSKI
5) Chuck Sweet moved to approve the application for disability retirement by
Leigh Horetski finding that it meets all three issues presented to the medical board
and that it is based on medical evidence by a doctor or clinic appointed by the
local board which establishes an accidental disability. It was seconded by Sgt.
Buvik. Motion carried unanimously.
The packet will be completed with a copy of the today's minutes and submitted to the
PSPRS by November 10, 2003. Sgt. Trujillo will confirm that PSPRS received the
packet. The Board will receive copies of the minutes for review. Since the board will
not meet before that November date to approve the minutes, the minutes will be sent in
draft format to the PSPRS.
Item 10 of the Accidental Disability Checklist was read to Officer Leigh Horetski. "An
accidental disability pension shall be reduced in the period prior to the member's normal
retirement date, if the member engages in any employment. The amount of the reduction
shall be equal to the difference between the member's income from employment and the
member's pension. Local Boards will need to request W-2s or earned income
statements from each accidental disability retiree as soon as possible after the beginning
of each calendar year until the retiree reaches his normal retirement date. The offset for
income from employment will need to be considered and approved by the Local Board
as required and written instructions pertaining to the offset should be forwarded to the
Fund Manager's office as soon as possible so the suspension or reduction of monthly
pension can be promptly effected. If a disability retiree refuses to supply the Local Board
with earned income information, the Local Board may suspend the retiree's pension."

A concern was mentioned and a need for edification on how the state calculates disability
pensions for officers that has not been in the PSPRS for three years, as is the case with
Officer Leigh Horetski.

An annual meeting will be held in February or March of each year. The next annual
meeting is scheduled for February 17, 2004(Tuesday) at 4:15 p.m. This will be the
annual meeting to review any new issues, W2's/earned income statements and
recommendations for legal assistance for the Board whether it should be the Town
Attorney or an outside attorney. A reminder should be sent to those on medical disability
to submit a W-2/earned income statement to the board prior to the February 17th meeting.
A Letter of Appreciation will be sent by Mayor Loomis to Herb Rutt's widow for
recognition of his service on the Board(Sgt. Trujillo will draft the letter.)
Richard Tracy moved to adjourn. It was seconded by Chuck Sweet. Motion carried
unanimously. Meeting adjourned at 4:30 p.m.
