Hemisphere Loop, Suite 101 Tucson, AZ 85706 Re: Vistoso Memorial Chapel, Vistoso Commerce Loop Revised Landscape and Bufferyard Plans dated 10/01/07 Dear Mr. Federico: The Vistoso Master Community Architectural and Landscape Review Committee has completed the review of the revised Landscape and Bufferyard Plans, dated October 1, 2007, for Vistoso Memorial Chapel and has found that the revised plans satisfactorily address the concerns set forth in the September 17, 2007 comments as follow: ■ The height of the berms was revised to a minimum of T-6" as required; ■ The berms and bufferyard areas were revised to incorporate the supplementary, "typical installation" requirements for all berm installations. Therefore, the Committee has conditionally approved the revised plans as submitted. Please note that the following specific stipulations apply: ■ Landscape treatments must be consistent with the overall project landscape plan and follow guidelines set forth in Sections 5.0 through 5.4 of the Design Guidelines for Rancho Vistoso All Non - Residential and Multi -Family and Commercial Development ■ Landscape treatment shall meet or exceed all current and applicable standards set forth by the Town of Oro Valley and those landscape requirements set forth in the PAD. Where there is a conflict, the more restrictive requirements shall apply. • Landscaped berms are to be constructed to enhance the Rancho Vistoso street scene, to promote visual interest and to screen unsightly views especially parked vehicles ... Berms in landscaped areas shall average no more than four (4) feet in height with ... slopes planted with ground cover are not to exceed 2 to 1. • Decorative rock ground cover placed adjacent to the street must match the existing material in Rancho Vistoso rights -of -way. This material is %" screened granite "Wildcat Red" as supplied by Kalamazoo Materials. • A minimum of thirty (30) feet of the setback area as measured from the property line bordering arterial streets is to be devoted to landscaping. Landscape elements are to be a "long-lived" variety. "Short- lived" materials may be utilized only as a supplement to 'longer -lived" elements. • Landscape elements within the front yard or visible from the public right-of-way shall utilize a planting theme similar to surrounding developments. All plants visible from the right-of-way must be chosen from the Rancho Vistoso Approved Plant List. • All required trees are to be minimum 24-inch, boxed specimens when installed. When development occurs "out -of -phase" or after the initial landscape plan has been implemented, all plant materials thereafter introduced into the landscape scheme must be comparable in size and species to the existing plants. - Vistoso Memorial Chapel Revised Landscape and Bufferyard Plans November 21, 2007 Page 2 • The, use of clipped hedges is discouraged. Rather; materials for "hedge" purposes in the landscape shall be:selected to attain the desired effect, allowed to grow in their natural habit ... • Landscape irrigation systems must be installed for all Non -Residential and Multi -Family projects throughout Rancho Vistoso. Landscape and irrigation designs and plans shall comply with applicable Town of Oro Valley standards and must incorporate an aggressive water management program using state-of-the-art technology. `The use of effluent for irrigation purposes is highly encouraged. Builders may contact the Town of Oro Valley to determine availability. • The landscape and irrigation plans are also to be submitted to the Oro Valley Development Review Board and Town Council for approval prior.to commencement of construction. • Irrigation system design and installation shall conform to the requirements of the Oro Valley Water Company. • All landscape irrigation systems installed within the Town of Oro Valley rights -of -way and/or maintenance district areas are to be designed in accordance with the.Town of Oro Valley's provisions. ■ The :irrigation system is to be designed to meet the peak moisture demand of all plant materials used within all landscaped areas, ■ The landscape sprinkler irrigation system is to be designed and operated to prevent or minimize run- off and discharge of irrigation water onto roadways, driveways, adjacent properties and any _area not under control of the user.,. . • The Property Owners shall conduct on-sitesoils testing. This information is to be,used to establish a thorough soil preparation and treatment program to be included in the Landscape Plan and implemented following final grading., • The Property Owners are responsible for the design; development :and maintenance of landscape areas on their sites -in accordance with these guidelines, • All plantings are to be maintained 'in a healthy;, growing condition. If any plant -within the landscape scheme dies, it must be promptly replaced (maximum 10 days) with°the same plant species of equal size. •' Property Owners will be responsible for erosion and weed control... ; The. irrigation system js to be maintained in good working order. Damage to the irrigation system is to be repaired within 24 hours to avoid loss of plant materials. The irrigation system is to be monitored to ensure that the normal watering demands of landscape materials are meta All other provisions of the Design Guidelines for Rancho'Vistoso All Non -Residential and, Multi-Familyand Commercial Development shall apply; Please be advised that a field inspection of the actual; installation and release by .the Landscape Consultant is required prior to the Association's final approval of the Project. Per your request the submittal includes; 3 copies (24x36) of revised plans, 3 copies of revised plans (11 X17), 1 24X36 sheet showing the changes (existing in gray changes darkened) along with this letter which briefly explains the changes that were made to the approved landscape plan. The one major change that was made is the CMU screen walls along Rancho Vistoso, Vistoso Commerce Loop and partially on the northern property line have been replaced by earth berms. The design team along with the client has decided to make this change for two reasons one we feel that these berms will enhance the look of the project along the major intersection and second is will be a cost savings to the owner. Pamela you had stated that once you receive this revision an administrative review could be done in one week's time assuming that there no major setbacks we look forward to hearing from you on this submittal. OV12-05-36B Copperstone Development LLC requests a time extension to January 19, 2013 for an approved development plan for property located between Hardy Road and Calle Concordia on the west side of Oracle Road RECOMMENDATION: The development plan meets all zoning code requirements. The applicant submitted the request before the expiration date. Staff recommends extending the development plan approval until January 19, 2013. EXECUTIVE SUMMARY: The applicant seeks an extension to a previously approved development plan. The Zoning Code requires development plans to be re -approved if more then two years have elapsed since the prior approval without improvements occuring. The development plan approval expired on December 6, 2010. The first extension was approved by Council in 2008 and this is the second request. The rationale for the requested development plan extension is provided in the attached request letter from the applicant. The proposed medical office development has been slowed by economic conditions. There are no land use policy or zoning district changes affecting this property since the development plan was originally approved. BACKGROUND OR DETAILED INFORMATION: Site Conditions: • The proposed site is currently vacant and undisturbed. • Site is 3.35 acres in size. • A 20' alley separates this property from the adjacent residential property line. • The zoning is R-S, Residential Service District. Proposed Improvements: • The entire property will be developed in one phase. • Two buildings are proposed totaling 40,800 square feet. Each will be two stories in height (28' 6" on the west side of the building and 33' 4" on the east side of the building). • The proposed uses will include medical and general offices. • Mitigation measures (lowered height, setbacks, bufferyards, etc.) were incorporated on the site to lessen impacts on the adjacent homes to the west. Approvals to date: • Board of Adjustment approved a height variance for this project, allowing a maximum building height of 34 feet, on July 2006. • Town Council approved the development plan for this project on December 6, 2006. • Town Council approved a development plan extension in October 2008. Zoning Code Compliance: All site design elements were addressed as part of the development plan process. There have been recent code updates (landscape code) that may require changes to the development plan when building plans are submitted. The proposed development plan is in conformance with applicable zoning code requirements. FISCAL IMPACT: N/A SUGGESTED MOTION: I MOVE to [approve, approve with conditions, OR deny] OV12-05-366, Copperstone Development LLC., represented by Scott Welch, request for a development plan extension for a period of two years to expire on January 19, 2013. Pelletier, Planner Page 1 of 3 MEETING DATE: July 18, 2007 SUBJECT: OV12-05-35B, Advantech Facility Design Inc., representing Beverly Harold, appeals the decision of the DRB to deny a revision to the approved landscape plans for the Vistoso Memorial Chapel, located at the corner of Rancho Vistoso Blvd. and Vistoso Commerce Loop. DEVELOPMENT REVIEW BOARD ACTION: The revised landscape plan was reviewed by the DRB on June 4, 2007. Issues identified as concerns at the Board meeting included possible increased water usage with the new design and the possibility that the proposed berms would not properly screen the site as well as a wall would function. The motion was made by Harold Kandetzke and seconded by Mike Zinkin, Chair to deny OV 12-05-35B on the grounds that there are concerns about the screening and it appears that there may be issues with water usage. The MOTION carried, 3-1 with Tom Gribb opposed. SUMMARY: mew Information: The applicant is appealing the DRB decision to deny their request for a revision to the approved landscape plans and the change to the color palette. The revisions include the removal of select screen walls (three and one-half (3 '/2) feet in height) on the north, south, and west property lines. These walls are proposed to be replaced with three and one-half (3 %2) foot high landscaped earth berm and additional landscaping (review the attached revised landscape plan). Per the OVZCR Section 27.6 F 4: "Screening devices required by this Section shall be masonry (or similar) construction, earthen berm (3:1 slope), and/or vegetation to provide a five (5) foot high opaque screen". The replacement of select screen walls with the proposed earth berms meets this requirement of the OVZCR. The amount of landscaping provided as approved remains the same — and therefore, the water usage also remains the same as approved. Additionally, per Section 27.6 F 7: "If a wall is used, vegetation shall be required and maintained on the external side of the barrier to provide visual relief when viewed from the property being buffered". The approved landscape plan included landscaping on both sides of the screen wall to meet this requirement. The number of plants provided in the landscaping has not changed, only the replacement of select three and one-half (3 '/2) foot high screen walls with a three and one-half (3 I/2) foot high landscaped earth berms. Furthermore, the Development Review Board- approved color for the walls was submitted for revision. The =proved color - Dunn Edwards Quicksand — was not approved by the Rancho Vistoso HOA due to the light --flectivity value. The Rancho Vistoso HOA has a stricter light reflectivity value than the Town of Oro TOWN OF ORO VALLEY =OUNCIL COMMUNICATION Page 2 of 3 MEETING DATE: July 18, 2007 Valley. The new proposed color - Dunn Edwards Apache Tan still meets all OVZCR requirements (the light reflectivity value is fifty) and promotes a tonal link to the existing buildings north of the site. Current Site Conditions: ■ The Development Review Board (DRB) approved the original landscape plan on September 19, 2005. The 2.6 acre site is zoned Rancho Vistoso PAD C-1, Commercial District. A Minor Lands Subdivision was approved by the Planning and Zoning Administrator for Parcels # 223-020-017M, 223-020-017N, and 223-020-017F on May 4, 2006. The proposed revisions to the landscape plans meet the screening requirements as listed above in Section 27.6 F 9. The proposed revision is a better design component.
