RE: OVi1-o6-03, WLB Group, representing Vistoso Partners, requests
approval of a General Plan Amendment and Rancho Vistoso PAD amendment for
Rancho Vistoso Neighborhood 5, Parcels 5-I and 5-R (Parcels #219-20-052Q &
219-54-oo6A).
Dear Paul and Richard,
Thank you for submitting a General Plan Amendment for Rancho Vistoso
Neighborhood 5, Parcels 5-I and 5-R. Staff received the tentative acceptance
letter from the Amphi School district on March 30, 2007 (attached). As a result
of this letter, the core development issues identified require inclusion into this
General Plan amendment. These issues require changes to the provided exhibits
for the Planning and Zoning Commission. This information is discussed in
greater detail below.
Items required prior to Public Hearings at Planning and Zoning Commission:
1. The parcel indicated for the proposed school site has not been platted. It
is difficult to provide any accurate information for a parcel that does not
exist. Therefore, the site is required to be platted prior to proceeding in
order to permit proper analysis. This can be accomplished through a
minor land subdivision. Please submit this application (attached).
2. Two neighborhood meetings are required — one prior to the Planning and
Zoning Commission meeting and one prior to the Council hearing.
Therefore, it would be prudent to begin the neighborhood meeting
process. Please provide staff with the specifics of the first neighborhood
meeting. Notification procedure and distances are specified in the
attached handouts. Generally, the distance for notification is 1,000 feet.
www.townoforovalley.com
Please ensure that the notification procedures "jump across right-of-ways"
and does not divide subdivisions in any way.
3. Furthermore, two public hearing shall be held before the Planning and
Zoning Commission (in different locations). Therefore, it would be
prudent to begin looking for a location for the second public hearing
within the General Plan amendment area.
4. All General Plan amendments shall utilize the Town of Oro Valley's GIS
files. Using these files, revise the exhibits to show the future extension of
Arrowsmith Drive and re -alignments and re -configuration of Moore Road,
as well as the correct parcel information. The GIS files will also provide
the calculation for the open space trade (roughly 1.9 acres).
5. Revise the General Plan Amendment exhibit — proposed conditions to
reflect the realignment and reconfiguration of Moore Road per the
submittal narrative if Moore Road is not intended to connect across the
Big Wash and link the east and west portions of Rancho Vistoso
Boulevard. If this re -alignment is not done concurrently with this
application, a future General Plan amendment will be required. Staff
suggests combining these items.
6. Revise the General Plan Amendment exhibit to delineate the Town ROW
system as it is depicted within the current Town of Oro Valley General
Plan — Figure 4. In addition to the arterials shown in the exhibit, this
comment includes the delineation of the collector street system.
7. Provide additional analysis in the narrative specifically addressing General
Plan visions, goals, and policies, with specific emphasis on the following
issues: compatibility, traffic, and open space. Address the letter to the
Planning and Zoning Commissioners of Oro Valley and specifically focus
on the following policies:
• "The amendment will not adversely impact the community as a
whole, or a portion of the community without an acceptable
means of mitigating these impacts through the subsequent
zoning and development processes."
• "How the proposal will consider development impacts on
natural rolling terrain and emphasize low -density developments
in these areas. This will include evaluating areas with slopes of
fifteen percent (15%) and greater for development compatibility
and safety, with the possibility of preserving them as natural
open space".
• "How the proposal will have new development to locate uses
that depend on convenient transportation access (e.g., higher
density residential and commercial) near major arterial streets".
"The proposed change is sustainable by contributing to the
socio-economic betterment of the Community, while achieving
community and environmental compatibility".
8. Provide detailed calculations of the areas of the individual areas to be
modified and/or traded and label them on the maps in regards to the
proposed open space trade area for the new school site. Trades are
required to be at a 1:1 ratio and require approval from the Planning and
Zoning Commission and Town Council. Please review the attached
"Criteria for Development" information.
The following issues will be conditions of this General Plan amendment:
1. A meaningful open space trade of a 1:1 ratio shall be proposed for review
and approval to from the Planning and Zoning Commission and Town
Council.
2. East Arrowsmith Drive shall be extended north and connect to Moore
Road east of Rancho Vistoso Boulevard.
3. Public gravity sanitary sewer shall be extended from the existing Pima
County Wastewater Management connection point to service the identified
future Amphitheater School site.
4. Provide a floodplain analysis for Big/Honey Bee Washes adjacent to parcel
5-R which determines the location of the loo-year flood limits and
describe mitigating measures that will be needed to provide the acceptable
buildable land area required by Amphitheater School District.
Items required for Resubmittal:
o Minor lands subdivision application for staff review and approval.
Proposed school site is required to be platted prior .to proceeding to the
Planning and Zoning Commission.
o Ten copies of 24"x36" and 11"M7" color copies are required. For the
Planning and Zoning Commission hearing, twenty-eight (28) color copies
11"x17" sized are required. The required maps are as follows:
• Map showing existing General Plan Land Use Map categories;
• Map showing proposed General Plan Land Use Map categories;
• Map showing existing Rancho Vistoso PAD zoning categories;
• A side -by -side comparison of existing and proposed General
Plan Land Use Map categories/ Rancho Vistoso PAD zoning
(similar to map created for the Oro.Valley Marketplace).
All these maps will be created using the Town of Oro valley's GIS files — which
was provided for your use via email June 21, 2007.
o Submit all files digitally on CD using the Town's GIS files (both CAD files
and GIS shapefiles).
o Synopsis from neighborhood meeting, with sign -in sheet. Additional
items to be submitted include the address list of all notified person and a
copy of the letter sent with the notification of the neighborhood meeting.
Additionally, a Rancho Vistoso PAD amendment is required. A Site Analysis and
Tentative Development Plan are required to be submitted. The Tentative
Development Plan (TDP) checklist (Section 3-104) for PAD amendments has
been previously provided for your use. If you have any questions about this
process, we would be happy to schedule a meeting with you. As a reminder, in
addition to the General Plan amendment revised exhibits (ten copies), the
following item swill be required to process the PAD amendment. We understand
that this item will be processed separately from the General Plan amendment.
1. A narrative addressing the following:
a. How the proposal is in compliance with the Golf Course Overlay
District.
b. What the current conditions are — size of parcels (in acres and
square feet).
c. Proposed land use changes with the approximate area of each land
. use to be modified, and the new proposed use.
d. Proposed density of the "proposed" medium density residential site.
e. Site constraints, such as access, slopes and floodplains;
A meeting with the Amphitheater School representative to discuss the General
Plan Amendment proposal is schedule for June 28th, 2007 at 2 pm at our offices.
We look forward to your participation at this meeting.
We look forward to the successful completion of this project. If you have any
questions, please contact me.

Oro Valley General Plan Policy Document
Adopted June 15, 2005
Adoption of Amendment. The disposition of the General Plan amendment proposed shall be based
on consistency with the vision, goals, and policies of the General Plan, with special emphasis on:
1. The proposed change is sustainable by contributing to the socio-economic betterment of the
Community, while achieving community and environmental compatibility; and,
2. The proposed change reflects market demand which leads to viability and general
community acceptance; and,
3. The amendment will not adversely impact the community as a whole, or a portion of the
community without an acceptable means of mitigating these impacts through the subsequent
zoning and development processes..
The applicant for the amendment shall have the burden of presenting facts and other materials to
support these conclusions.
PROJECT CONFORMANCE WITH PLAN
Arizona State Law requires that zoning be in conformance with the General Plan. ARS Section §9-
462.01 F defines conformance as follows: "a rezoning ordinance conforms with the land use element
of the general plan if it proposes land uses, densities or intensities within the range of identified uses,
densities and intensities of the land use element of the general plan." All rezoning proposals and
development projects shall be evaluated for conformance with the Plan.
Rezoning Conformance
Per the Town's zoning code, "[a]ny new proposal for development, which does not comply [with the
General Plan], will be subject to denial by the Town Council." Thus, new development proposals
must match the land use map in accordance with the Town's zoning code and the requirements of
the State statute referenced above.
Further, the Growing Smarter Acts, as noted by the Arizona Department of Commerce Community
Planning Program, require that "all rezoning ordinances and regulations adopted shall not only be
consistent with, but must conform to the adopted General Plan. The rezoning ordinance shall further
the implementation of, and not be contrary to, the goals, policies, and applicable elements of the
Plan. A rezoning ordinance conforms to the Land Use Element if it proposes land uses, densities or
intensities within the range for the subject property as stated in the General Plan." To this end,
proposals for zoning change should be evaluated in relation to all of the policies in the General Plan
(not just the map and those in the Land Use Element). When a proposed zoning change is not in
compliance, the applicant will be required to amend the General Plan, or the proposal, prior to
initiating a rezoning.
Development Review
General Plan conformance shall also be used as a criterion in the approval or denial of other types of
development proposals, such as development plans, plats, and architecture. When considering a
development proposal, Town staff, the Planning and Zoning Commission, the Development Review
Board, and the Town Council will evaluate the proposal as to how it relates to the key concepts in
the General Plan. It is the burden of the applicant to provide clear and convincing proof, through an
analysis of each applicable policy, that the proposal is in conformance with the General Plan.

SUBJECT: General Plan Amendment in Rancho Vistoso — Neighborhood Five
Oro Valley, Arizona
WLB No. 185050-A-005
Dear Ms. More:
This letter is intended to accompany an application to amend the Oro Valley General Plan within
Rancho Vistoso Neighborhood Five. This proposed amendment is not broad in scope, but rather
focuses on the location of the designated school site within Neighborhood Five. This proposed
amendment would not adversely affect the public. In fact, as explained below, this amendment
would reduce commute time to and from school, thus slightly reducing traffic volumes on nearby
streets and lessening the need for Moore Road to eventually cross Honey Bee Wash and connect to
the current school site location.
Parcel 5-1 is currently designated in the General Plan as "School" and in the Rancho Vistoso PAD
(RVPAD) as a "Junior— Senior High School". Amphitheater School District has determined that their
long-term needs would be served more efficiently and effectively by relocating the designated school
site onto Parcel 5-R, which is near Rancho Vistoso Boulevard and Arrowsmith Road, approximately
one mile southwest of the current school site location. The most apparent reason for this
determination is that the bulk of the student population that is anticipated to eventually attend the
school will live to the west of Rancho Vistoso Boulevard, especially in Neighborhood Ten, and
beyond. Thus, relocating the school site from Parcel 5-1 to Parcel 5-R brings the school in closer
relation to its anticipated service area. Parcel 5-R is currently designated in the General Plan as
"Medium Density Residential" and in the RVPAD as "Medium -High Density Residential". We have
met with the District on several occasions and have agreed to provide an equivalently sized school
site on Parcel 5-R and surrounding area currently designated in the General Plan as "Resort / Golf
Course" and in the RVPAD as "Recreation Area / Golf Course". Conceptually, the future school
buildings would be constructed within the existing buildable limits of Parcel 5-R, while portions of the
future sports fields would extend into the current golf course area to the east. The proposed
amendment would essentially reverse the Parcel 5-1 / Parcel 5-R land use designations in both the
General Plan and the RVPAD so that 5-R becomes the designated school site and 5-1 becomes
medium -high density residential. The entitled portion of Parcel 5-1 is approximately 16 acres larger
than the entitled portion of Parcel 5-R. However, the entitled portion of Parcel 5-1 is unconstrained
by excessive slopes orflood plains. In addition, the Rancho Vistoso PAD allows up to 3555 dwelling

units within Neighborhood Five, of which only 650 have been developed, and less than 170 entitled
acres remain. As such, the entire entitled portion of Parcel 5-1 has been designated as Medium
Density Residential in this General Plan amendment. This proposed amendment is needed in order
to secure the school site desired by the School District.

RE: Pima County's Response to OV11-06-03, Rancho Vistoso Neighborhood 3, Town of Oro Valley
Major Plan Amendment request
Dear Ms. Gay:
Thank you for the opportunity to comment on the above -referenced. Pima County offers the
following comments on the major plan amendment request submitted to your office.
Comments from the Planning Division, Pima County Development Services Department:
There is concern over how this amendment request would impact the Resource Transition (RT)-
designated area on the east side of Oracle Road at its intersection with Tangerine Road. The
project site is contiguous to the RT area, separated by Oracle Road.
Other comments related to environmental planning, flood control and transportation are appended
herein.
Environmental Planning
This proposed amendment to the Oro Valley General Plan seeks to revise, re -configure, and re-
designate various land uses as identified in the existing General Plan and PAD for Rancho Vistoso
Neighborhood 3. We understand that the end results will:
• re -designate approximately 37 acres in the Big Wash floodplain as Natural Open Space and
transfer previously approved development to other areas within Neighborhood 3;
• re -align the future bank protection extension such that it better aligns with the boundary of
the Big Wash floodplain;
• re -configure and expand the park site to incorporate a node trail system; and
• consolidate commercial and office uses along Oracle Road thereby reducing fragmentation
of open space.
Comparing this proposal with what was approved in the existing PAD, there is no change in the total
number of acres designated for parks and open space. Neither is there any change in the total
number of acres proposed for development nor the types of planned land uses requested.

1 = Estimated acreage of natural open space (N.O.S.)
The existing PAD and the current proposal provide approximately 383 acres of parks and open
space; this is approximately 47% of the area within Neighborhood 3 (there is no further distinction
between open space and natural open space). At face value, there appears to be a deficit between
the amount of open space that is proposed (and previously approved) and what is expected in order
to conform to CLS objectives.
However, conservation objectives within the larger Rancho Vistoso Development area, of which
Neighborhood 3 is part, are likely being fulfilled with execution of the Development Agreement
between Pima County and Stone Canyon L.L.C. (3/12/2002). This Development Agreement creates
and preserves the Honey Bee Canyon Biological Corridor by designating approximately 70% (247
acres) of Neighborhood 12 as natural open space and permanently protecting 988 acres of natural
open space within the larger Rancho Vistoso Development area through conveyance or
conservation easement to Pima County. These requirements plus the on -site provisions of
Neighborhood 3 suggest that CLS conformance has been achieved.
Although the specific elements of this proposed plan amendment, as referenced on the previous
page, are environmentally -favorable revisions when compared to the existing PAD, there is
additional opportunity to consolidate a broader natural open space corridor to enhance the
protection of Big Wash's hydrologic function and natural resource values while keeping the same
ratio of development to open space. Open space in the southeast quadrant — in the area of the
Tangerine Road and Oracle Road intersection — could be transferred into the northwest portion of
Neighborhood 3 that lies between Big Wash and the current alignment of N. Vistoso Village Drive
that is currently designated for Commercial/Office Park. Otherwise, existing development (including
bank protection) and grading in preparation for pending development have effectively precluded any
further jostling and re -arrangement of land uses within the proposed amendment area to
accommodate/consolidate a broader natural open space corridor for Big Wash.
Comments from the Pima County Department of Transportation:
The site of the proposed general plan amendment lies wholly within the Town of Oro Valley and has
no direct access onto County maintained roadways. The parcel is situated west or Oracle Road
between Tangerine Road and Rancho Vistoso Boulevard.

Comments from the Pima County Regional Flood Control District:
Big Wash runs along the eastern edge of the property. There is existing bank protection along the
southern reaches of Big Wash adjacent to the development. The applicant proposes constructing
additional bank protection north of the current improvements to minimize the flood hazards
associated with Big Wash. There is a FEMA Letter of Map Revision (LOMR) that affects a portion of
the property. The LOMR removed areas from special flood hazard designation due to the bank
protection improvements.
It should be noted that Pima County Regional Flood Control is embarking on a study to re-evaluate
the hydrology along much of the Canada del Oro wash, including its tributary watercourses. The
main objectives of the study will be to determine accurate discharge values for the watercourses,
and then assess whether existing levees are adequate to deal with the expected discharge. It is
recommended that the applicant meet and coordinate with Pima County Regional Flood Control
District regarding the proposed bank protection and any hydrology studies related to the
development.
Several other minor washes traverse the property that should be considered in any drainage
improvement for the parcel. Finally, there are also several areas of Important Riparian habitat on the
parcel. These are mainly associated with several of the smaller washes on the property as well as
within the channel of Big Wash. Avoidance and preservation of these areas to the maximum extent
possible is recommended.
Comments from the Pima County Department of Natural Resources, Parks and Recreation:
Natural Resources, Parks and Recreation Department staff do not have any comments on this request.
On October 11, 1 received another request from Oro Valley (OV11-06-03 Rancho Vistoso Neighborhood
5) to forward comments to the Development Coordinator by October 20. Please be informed that it would
not be possible to obtain comments from the various Pima County departments to generate a report for
this request in nine days. Moreover, I am not so sure that this request fulfils the 60-day review period
required by the Growing SmarterAct. Unless, of course, "Rancho Vistoso Neighborhood 5" happens not
to be an Oro Valley major plan amendment request. Please advise.
Again, thank you for the opportunity to participate in the Town of Oro Valley's general plan amendment
process for major plan amendments, and we look forward to continued participation in the future.

SUBJECT: Neighborhood 5 School Site
Dear Todd,
SEP 0 5 2007
The Town of Oro Valley has requested a letter from Vistoso partners memorializing our
agreement regarding dedication of a school site in Neighborhood 5 to Amphi School District.
They have requested that the letter outline the agreements between both of us, and that both
parties sign and notarize the letter so that the Town will feel comfortable that both parties have
agreed.
The following is an outline of our agreement as I know it from our last meeting regarding moving
the school site shown in Neighborhood 5 PAD documents.
1. Vistoso Partners will relocate the 35 acre school site shown on the PAD document
from its present location in Parcel I over to the Parcel R location on the PAD map.
This process is being done through a PAD and General Plan Amendment within the
Oro Valley zoning procedures. Please reference the attached map of Rancho Vistoso.
2. Vistoso Partners will agree to extend Arrowsmith Road from its present location north
to tie into the Moore Road alignment at Rancho Vistoso Boulevard. The roadway
design will incorporate design features (such as a multi -use walking path on one side)
appropriate for this type of roadway. Furthermore, Arrowsmith Road will be extended
in a manner to allow bi-directional access from the proposed school site (referred to as
the Loop Road).
3. Vistoso Partners will install a sewer line from the connection point on Tangerine Road
and Big Wash, up to the lift station at Sun City Vistoso, no sooner than five years
(unless able to do so earlier) or when Amphi School District applies for a C of O.
Location of the sewer line will Be along the bank protection. If there is a delay with
Pima County replacing the critical link of sewer line along Tangerine Road to the
identified point of connection, the condition will be revisited at such time.
4. Amphitheater School District agrees to handle all onsite drainage/flood control
measures to protect public improvements for their site. Both parties shall share and

coordinate the floodplain and drainage information to ensure suitable protection for
their respective land.
Please review this information and return a signed/notarized letter to me for my signature. We
are processing the property through the PAD and General Plan revisions at this time.
If there are any questions regarding this, please contact me at 602-723-1170.

RE: Neighborhood 5 - School Site
Dear Sarah,
SEP 1 3 2007
In follow-up to Pamela's request, I have sent a letter to Amphi School District outlining
what our agreement is. I have called Todd Yeager to explain why the letter agreement
requires a notarized signature block for both of us, but have not heard back from him.
Please keep this in your files as verification that I have requested the school district to
sign and notarize per the Town's request.
Sincerely,
Richard Maes
