This property is owned by the Episcopal Church.
The S.E.C. of the property has been designated Commercial in the General plan.

The Church of the Apostles owns approximately 33 acres at the N. W. corner of
Tangerine and La Cholla in Oro Valley.
A portion of the S.E.C. of the property abutting Tangerine and La Cholla has been
designated commercial in the general plan. A portion of the designated parcel was taken
when La Cholla was realigned.
The Church would like to reconfigure the existing designated area into a more useable
shape and add some additional acreage to make the property more developable.
They would like to create a parcel of approximately 7.32 acres fronting on Tangerine
running from La Cholla west to Como Avenue.
The parcel would then be developed for light commercial including but not limited to
small retail shops, restaurants, banks and small office uses.
The Church does not need all of their property and would like to sell the property so they
can continue their growth plans to attract new members and increase their buildings and
recreational areas for the congregation.

General Plan Amendment
Engineering Comments
OV11-07-01
Parcel 221-47-0160
Northwest corner of Tangerine Rd & La Cholla Blvd
David Laws, P.E.
1. This current General Plan Amendment and the associated development that would
follow does not meet the access requirements of the Tangerine Corridor Overlay
District with regard to the two following code stipulations:
a. TOV Zoning Code revised (May 2006) —Section 24.1.D.l.a:
There is not enough linear frontage between the Tangerine Road
intersection with La Cholla Boulevard in the east and North Como Drive
in the west to allow for another access drive crossing the code stipulated
Tangerine Arterial Frontage Tract. Approximate Tangerine Road frontage
available is 1150 feet. The minimum frontage required to satisfy the code
requirements of offsetting any tract crossing 330 feet from the nearest
arterial intersection and offsetting 1000 feet from any other tract crossing
(N Como Rd) will be 1300 feet.
b. TOV Zoning Code revised (May 2006) —Section 24.1.D.l.a:
This proposal does not provide enough linear frontage along La Cholla
Boulevard to support the tract crossing requirement of the intersecting
arterial road from the Tangerine Road intersection. Said frontage set back
requirement for access crossing is 660 from Tangerine.

TOWN OF ORO VALLEY
STAFF REPORT TO PLANNING & ZONING COMMISSION MEETING DATE: September 18, 2007
TO: PLANNING & ZONING COMMISSION
FROM: David Ronquillo, Senior Planner
SUBJECT: Study Session: OV11-07-01, Park West Development, representing Episcopal Church of the
Apostles, requests preliminary review of a general plan amendment for the northwest corner of
Tangerine Road and La Cholla Boulevard. The minor amendment would reconfigure the
designated land use boundaries in this area.
EXECUTIVE SUMMARY OF APPLICATION:
Nature ofApplication:
Based on the criteria specified in the General Plan, this application will be reviewed as a "minor amendment".
The General Plan amendment process for such an application involves staff review and analysis of land use
compatibility, environmental constraints and conformance with General Plan Policies and the Town's Economic
Development goals and strategies. At least one neighborhood meeting is required early in the review process.
Once a formal review is complete, staff will evaluate the proposed amendment and prepare the necessary
background information, then forward the application to the Planning & Zoning Commission, which in turn
provides a recommendation to Town Council.
The applicant has submitted a formal application for this project; however, prior to proceeding to a formal
public hearing has requested a preliminary review by the Planning & Zoning Commission.
Current Site Conditions:
• The site is approximately 7.32 acres in size.
• The existing zoning on the property is R1-144, Single Family Residential.
• The existing general plan land use designation is neighborhood commercial/office and public/semi-
public.
• The surrounding land use designations consists of primarily neighborhood commercial/office on all four
corners of the intersection and a mix of residential densities (from low to medium). The majority of the
properties in proximity to the intersection are currently undeveloped.
• There are two riparian areas that transverse the site from north to south that are designated as Significant
Resource Areas in the General Plan.
• A church building is currently on the site and will remain.
Property Owner's Request:
The applicant is requesting the following changes to the General Plan:
• Reconfigure and increase a portion of the "neighborhood commercial/office" designated on the site.
• A portion of the existing public/semi-public designation would be changed to "neighborhood
commercial/office."
• Reconfiguration of portions of the "Significant Resource Area" boundaries.
• The designated riparian area would be reconfigured and/or traded for other areas of the site.
• A neighborhood scale commercial development would be proposed.
TOWN OF ORO VALLEY
PLANNING & ZONING COMMISSION STAFF REPORT Page 2 of 4
SUMMARY:
Approvals to date
The existing church on this property was approved in Pima County.
Surrounding Zoning
North: SR, Suburban Ranch, Pima County Land.
South: R1-144, Single Family Residential, Vacant Land (across Tangerine Road).
East: R1-144, Single Family Residential, Vacant Land (across La Cholla).
West: R1-144, Single Family Residential, Existing Church.
PROPOSED GENERAL PLAN AMENDMENT:
As specified in the General Plan Policy document, "amendments proposed shall be based on consistency with the
vision, goals and policies of the General Plan," with special emphasis on:
1. The proposed change is sustainable by contributing to the socio-economic betterment of the community,
while achieving community and environmental compatibility; and,
2. The proposed change reflects market demand which leads to viability and general community acceptance;
and,
3. The amendment will not adversely impact the community as a whole, or a portion of the community
without an acceptable means of mitigating these impacts through the subsequent zoning and development
processes.
Site Analysis
The applicant's proposal is to develop a neighborhood scale commercial development. The existing General Plan
currently allows approximately 6.5 acres of neighborhood/conunercial office at this intersection. However, within
this commercial designation approximately half of the property is designated as a Significant Resource Area in the
General Plan. The reconfiguration of the commercial land use boundaries, approximately 8 acres, attempts to
accommodate a more suitable development based on the environmental site constraints.
Based on a formal review, the following items will be significant issues as part of this development:
1. There are two designated riparian areas that transverse the site from north to south. The development
proposes to encroach within a portion of these areas. The applicant has consulted with Westland Resources
to analyze the extent of the riparian boundaries. Based on a specific study, Westland Resources has
concluded that the riparian boundaries should be re -aligned and trade areas have been proposed. The
applicant will present the details of this study at the meeting.
Based on a preliminary review of the riparian habitat assessment, staff agrees with the concept of
reconfiguration of the riparian boundaries; however, we have significant concerns regarding the proposed
trade areas. The trade areas should be located directly adjacent to the riparian areas. The specifics need to
be further discussed with the applicant and the Planning & Zoning Commission.
TOWN OF ORO VALLEY
PLANNING & ZONING COMMISSION STAFF REPORT Page 3 of 4
2. The Tangerine Road Corridor Overlay District (TRCOD) restricts access to this site off Tangerine Road
and La Cholla Boulevard. In order to achieve access off these roadways, a variance would be required.
Currently, the only potential access to serve this development would be off Como Road on the west side of
the property, which is a dirt road and may not be adequate to serve this development or a shared access
with the existing church entrance off La Cholla Boulevard.
3. The applicant has submitted a conceptual plan, which includes a preliminary layout of the proposed site. It
provides the building layout, circulation and parking etc. A portion of the proposed development
encroaches within the designated Significant Resource Area. The concept plan does not clearly illustrate
how the proposed development overlays with the specific riparian boundaries determined by Westland
Resources. This is critical in determining whether a suitable development can occur in this area based on
the environmental constraints and whether staff would support this location and any trades.
ENGINEERING SECTION:
Traffie
With respect to site access, this current General Plan Amendment and the associated development that would
follow do not meet the requirements of the Tangerine Corridor Overlay District with regard to the two following
code stipulations:
a. TOV Zoning Code revised (May 2006) —Section 24.1.D.I.a:
There is not enough linear frontage between the Tangerine Road intersection with La Cholla Boulevard in
the east and North Como Drive in the west to allow for another access drive crossing the code stipulated
Tangerine Arterial Frontage Tract. The approximate Tangerine Road frontage available is 1150 feet. The
minimum frontage required to satisfy the code requirements of offsetting any tract crossing 330 feet from
the nearest arterial intersection and offsetting 1000 feet from any other tract crossing (N. Como Rd) will be
1300 feet.
b. TOV Zoning Code revised (May 2006) —Section 24.1.D.I.a:
This proposal does not provide enough linear frontage along La Cholla Boulevard to support the tract
crossing requirement of the intersecting arterial road from the Tangerine Road intersection. The frontage set
back requirement for access crossing is 660 feet from Tangerine.
Drainage
This project shall conform to the policies and requirements of the Town of Oro Valley Drainage Criteria
Manual. Any encroachment into regulated flood plains shall also require the issuance of a Floodplain Use
Permit.
Grading
This project consists of the development of a commercial property. A Type 2 Grading Permit will be required to
construct private access/driveways, parking areas, drainage structures, building pad(s) and site utilities. All
grading shall meet the requirements of the Town of Oro Valley Zoning Code, Section 27.9
TOWN OF ORO VALLEY
PLANNING & ZONING COMMISSION STAFF REPORT Page 4 of 4
PUBLIC INPUT:
A neighborhood meeting was held by the applicant several months ago. Staff was not in attendance, but the
applicant reported that there were no significant issues identified by adjacent residents. The applicant will provide
a summary and the specifics will be presented at the Commission meeting.
RECOMMENDATION:
This proposal is being presented as a study session item in order to gather feedback and identify issues from the
Commission; therefore, a formal recommendation will not be provided. It is important for the Commission to
address any comments/issues to provide direction to the applicant. Prior to scheduling this project for a public
hearing, there are numerous issues and concerns, as previously identified by staff that must be resolved.
