Subject: Parcel # 225-11-1100 located at 225 W. Meadowbrook Drive, Oro Valley; AZ 85704. REQUEST SPECIFICS: The applicant has a single family home with an existing carport in the RI -36 Single Family District. The carport is 480 square feet and encroaches seven feet into the 15 foot side yard setback. The carport was built under Pima County zoning standards, and is non -conforming to current zoning setback standards. The applicant wishes to convert and enlarge the carport into a 1,092 square foot garage to provide storage space and shelter for four vehicles. The new garage would align with the existing carport, so the additional garage area would also encroach seven feet into the side yard setback (See Atlachmen! 1). In addition, the zoning code prohibits garages in the front yard. However, an accessory structure built in the front yard that is structurally connected to the primary structure meets zoning requirements. The proposed garage is twelve feet tall. The setback requirements in the RI -36 Single Family District are: Front yard: 30 feet Side yard: 15 feet Rear yard: 40 feet Maximum Building Height: 18 feet The applicant is requesting a variance to encroach 7 feet into the required 15 foot side yard setback to construct the expanded garage/storage area. NOTIFICATION: All property owners within 300 feet of this property were notified of this hearing by mail. The property is posted with a notice of hearing, was posted online at www.orovalleyaz.pov and was advertised in the Daily Territorial. EXISTING LAND USE AND ZONING: Subject property: Single family residential zoned R1-36 Single family Residential North: Single family residential zoned R1-36 Single family Residential East: Single family residential zoned RI -36 Single family Residential South: Single family residential zoned R1-36 Single family Residential West: Single family residential zoned RI -36 Single-family Residential SITE INFORMATION: The subject property is Lot 78 in the Shadow Mountain Estates subdivision. There are a total of 150 lots in the subdivision. The subject property parcel is a rectangular shape. The lot is relatively flat, with a six foot change in grade sloping downward from west to east. There is a drainage channel at the rear of the lot. 61111T113KII AV Findings of Fact: • The property is .84 acres. • The frontage of the property is 127.4 feet wide. • The site is relatively flat. • The property is of a generally rectangular shape and is not unusual in configuration or topography. • The property is in the Shadow Mountain Estates subdivision which is comprised of 150 lots and was approved in 1959. • The subdivision is located within the Town's original 1974 incorporation area. • The applicant is requesting a seven foot encroachment into the side setback for the expanded garage, which would result in an overall 8 foot side setback for a 52 foot long structure. Total building area encroaching into side yard setback would be 196 square feet. • The applicant has depicted in the concept plan that the expanded garage would be attached to the primary structure. • There is an existing carport in the front yard of the property. The carport does not comply with current zoning requirements. The existing structure encroaches into the side yard setback. The Board of Adjustment should consider the following findings in making its decision for each variance request: A. There are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district. The subdivision plan includes a range of parcel sizes and shapes. This parcel is .84 acres with a frontage of 127 feet. There are approximately 20 lots in the subdivision with a similar size (same slightly smaller, some slightly larger); shape (generally rectangular); and frontage (aborti 120 feet). The topography is generally flat and typical for the area. There do not appear to be unique features relative to location or surroundings. Some of the homes on the 120 foot wide lots are at an angle, which creates more room for expansion than if the house is square with the lot. B. Special circumstances were not created by the owner or applicant. The applicant is proposing to replace and expand an existing carport which is non- conforming Under current zoning. C. The authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights. It is typical for a single fancily !tome to have covered parking for tvo cars or trucks. The property currently has a carport The applicant is proposing to improve the carport to an enclosed garage, and to expand it. The expansion of building area north of the existing carport could be contained in the setback or scaled back, preserving more of the existing setback for the neighbor to the east. D. Any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located. The applicant desires to extend the wall of a grandfathered, non -conforming use. The request does not appear to be based on special circumstances or conditions that are different from[ those of other lots in the subdivision. E. The authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. Under this proposal, the length ofwall encroaching seven feet into the side yard would increase from 24 to 52 feet. The intent of a side yard setback is to provide separation between buildings. This nnay be considered detrimental to the adjacent property to the east because it reduces the required setback between the proposed building and the adjacent property. In addition, this reduction in setback occurs near the property frontage in a visible location, in a manner that is not consistent wish other properties in the neighborhood. SUGGESTED MOTIONS: The Board may wish to consider the following motions: 1 move to [approve, approve with conditions, or deny] OV 1010-09 variance request to reduce the fifteen (15') foot side yard setback to eight (8') feet to allow a garage. vid Williams, AICP Planning Division Manager ATTACIEWENTS: 1.
