NATURE OF REQUEST: This request is for a"0 setback variance" on the south west side of the property (the side facing Pusch Ridge). The Previous owners had built a porch which abuts the edge of the property line. The current Oro Valley code requires a 10 foot setback for all covered porches. We are currently seeking this variance with the support of the planning department, with the end goal of bringing the porch constructed by the previous owners into compliance with the Oro Valley city code. If necessary attached written narrative. APPLICANT: Bernard M. and Dawn M. Chaudoir PHONE: 630 902 1969 FAX: ADDRESS: 125 West Lambert Lane City Oro Valley State AZ Zip 85737 Email mchaudoir69@gmail.com OWNER: Bernard M. and Dawn M. Chaudoir ADDRESS: 125 West Lambert Lane City Oro Valley State AZ Zip 85737 PROPERTY LOCATION FOR VARIANCE REQUEST: 125 West Lambert Lane PARCEL#: LEGAL DESCRIPTION: CURRENT ZONING: APPLICABLE FEE: $150.00 ATTACHMENTS: SINATURE OF AP -ICANT (ALSO PRINT NAME) DATE 1 SUPPLEMENTAL QUESTIONS FOR APPLICATION FOR A VARIANCE Please provide the following information addressing 1 — 5 in the Findings from Section 21.6 I of the Oro Valley Zoning Code Revised (OVZCR). In order to authorize a variance request, the Board will be searching for sufficient evidence in accordance with the findings. Please answer the questions below in a narrative format. 1. Are there special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district? This property is somewhat unique,in that the property line in question faces Canada del Oro Wash. Between the property And the wash is an area of open desert approximately 1/4 mile wide. As can be seen from the aerial view(Attached A)the Porch cannot effect, nor is it visible to,surrounding residents. Additionally, this porch was not constructed by The current owners, and we had no idea when moving in that it was potentially in violation of Oro Valley code. 2. Are there special circumstances that exist that are not self-imposed or created by the owner/applicant? Yes. The porch in question was added by the previous owners;the fact that it was not permitted and in violation of city code was unknown to us at the time of purchase. The first knowledge we had was when we received a letter informing us of the situation from the Oro Valley planning department. 3. Is the authorizing of the variance necessary for the preservation and enjoyment of substantial property rights? Yes. Without this variance, the porch in question would have to be removed. This would destroy a roof, porch structure and outdoor kitchen area. These areas allow for outdoor use of the property, and provide a substantial amount of the property's value. Removing these structures would substantially erode the property as it now exists. (See attached pictures B and C). We moved to the Tucson area for work. However,we had been working towards this move for many years, due to Dawn Chaudoir's declining health. She has Firbromyalgia, which was negatively impacted by the climate of Illinois (where we previously resided). Moving to Arizona, with a better climate and subsequent reduction in stress, offered the chance to help improve my wife's health. The stress(financial and physical)from this situation is adversely affecting her health. Resolving this situation will help restore the health benefits of living in Oro Valley she was experiencing. 4. If granted, will the variance impose such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? Yes. The only area affected by this variance will be an area of open desert between the property line in question and Canada del Oro wash. All other properties in the area already have existing structures which go to the same facing property line(see attached sample picture D). • 2 5. If granted, will the variance be the minimum necessary to afford relief and will not materially affect the health, safety, and welfare of the neighborhood or surrounding properties. Yes. If the variance is granted, with the support of the planning department, it will in no way affect the surrounding properties. In fact, the structure in question is not generally visible by the surrounding properties (see attached picture E). Since the area will be facing an area of open desert (owned by Pima County) whether or not the variance is granted, granting the variance will not change the environment or the accessibility of the porch. Summary: We would like to make a personal appeal to the board to grant this "0 setback variance." If the variance is not granted, we will have to destroy a substantial part of our home in Oro Valley. Not only would the necessary removal add a tremendous financial burden, but it would also substantially erode the value of the home, resulting in negative equity. We would certainly owe more on the property and home than it would then be worth. This structure was constructed by the previous owner, and our purchase was based in part on its existence. The stress of the situation has already driven my wife to seek refuge in Illinois while I work to resolve this situation. If the variance is granted, we will avoid serious negative financial impact from our move to Oro valley, without any adverse effect on the surrounding community or environment. We would respectfully request that the board grant this variance. t? .'-'1'''•,,,',-4,' skb 1.17;':''':.:71 r , r ky i .. Request for variance for property in Catalina Ridge subdivision from Zoning Code Section 23.6`A.3.b., to allow an accessory structure to be closer to the front lot linethan main building, by Thomas Atkinson, Jr. Property located at 11027 Joy Faith Drive, Oro Valley, AZ 85737. Zoning is CR-2 Cluster, District Melcor Planned Area Development, Parcel #224-29-0540. OV1011-03. Tom O'Connor of Sombra Homes, non OV resident and project manager for the Atkinson's project, was sworn in by Chairman Christopher. 05/24/11 Board of Adjustment Regular Session Minutes 1 Mr. O'Connor explained to the Board the need for the variance on behalf of the Atkinsons, who were not in attendance. A brief question and answer period followed. Karen Berchtold, OV Senior Planner, presented the following: g - Location Map - Zoning Map - Aerial Map - Topography - Variance Request - Summary - Site Photos - Staff Analysis - BOA Findings Member Zinkin commented that if the structure was attached c ed to the home, a variance request would not be needed. Member Fields asked what determines an attachment. Chad Daines, OV Principal Planner responded that the p most direct way would be to attach the roof lines. Member Parisi asked if there were other homes in the area that have situated their houses like this one. Chairman Christopher said the one to the p north appeared to have the same orientation. Chairman Christopher opened theublic hearing. p g Steve Schmidt, OV resident, owner of the home on Catalina Ridge Lot 9, said one of the primary reasons he purchased his lot was due to the unobstructed views of the Catalina Mountains. Mr. Schmidt mentioned that the ' Atkinson's verbally agreed to limit the structure to 11 ft. 6 in. and he would have no objection to the location as long as that condition is met. Chairman Christopher closed theublic hearing. p g MOTION: A motion was made byMember Zinkin and seconded by Vice-Chair Fields to deny OV1011-003, variance request to allow an accessorystructure e to be located closer to the front lot line of the main building. g Member Zinkin said an overhang connected to the house would avoid a variance request. Member Parisi agreed. Chairman Christopher said there are ways the applicant can make it fit within the scope of the code. MOTION carried, 4-0. 05/24/11 Board of Adjustment Regular Session Minutes 2 2. Request for variances for property in Shadow Mountain Estates East from Zoning Code Section 23.6.A.3.b., to allow accessory building closer to the front lot line than main building and Section 23.4, Table 23-2A Dimensional Requirements; which limits height of buildings in R1-36 Zoning District to 18 feet, and Section 23.6.A.3.b., which requires that accessory buildings shall not exceed height of main building, requested by Brad Fairweather. Property is located at 9100 N. Marne Place, Oro Valley, AZ 85737. Zoning is R1-36. Parcel #225-12-0600. OV1011-04. For questions and additional information, please contact Karen Berchtold, Senior Planner, at (520) 229- 4814 or kberchtold@orovalleyaz.gov. After a brief discussion, it was agreed that there should be two separate votes for this agenda item as follows: Variance 1; Height and Variance 2; Location. Chairman Christopher swore in Brad and Noelle Fairweather, OV residents and property owners of 9100 N. Marne Place. Their concerns were as follows: - Reviewed approximately 30 different scenarios with architect - Lot is non-conforming and house is on the eastern edge of the property - Severe slope on the property - Neighbors shown the plans and there are no objections - Unable to build east, south or north of property - Best option is to disturb the land as little as possible Member Parisi asked if the garage could be placed closer to the house. Mr. Fairweather said it would be difficult to maneuver his vehicle and it would eliminate his yard. Brian Rumsey, architect from Rumsey Architecture LLC, and a non-OV resident was sworn in by Chairman Christopher. Mr. Rumsey said they should have made it clear earlier that the owner has plans to build a pool in the future and reviewed the following illustrations. - Figure 1, illustration of single story structure at existing paved area - Figure 2, illustration of single story structure at existing paved areap er staff report - Figure 3, illustration of single story structure at existing paved area A brief question and answer period followed. Ms. Berchtold presented the following: - Location Map - Zoning Map - Aerial Map - Topography 05/24/11 Board of Adjustment Regular Session Minutes 3 - Variance Request - Variance Requests. - Site Photos - Staff Analysis: Location & Height Review - BOA Findings Chairman Christopher opened the public hearing. Scott Quick, OV resident, stated he resides southwest of Mr. Fairweather and was never contacted by him. Mr. Quick purchased his property because of the beautiful views and Oro Valley's stringent rules and ` ordinances. He is displeased that this project would obstruct his view. Charles Glickman, OV resident stated that Mr. .._Quick lives on the north side of his home and knows that Mr. Quick o. s enjhis backyard and J Y y view. The accessory building will be right next to Mr. Quick's residence and will be detrimental to his property. Julian Herrera, OV resident, said 5rs ago he tried Y g to get a permit to build a guest house with a kitchen and it was not allowed. He stated he did not have any objections to the construction, but was concerned that theu g est house would be used as a rental which would increase traffic and noise level. Chairman Christopher closed theublic hearing. p g Mrs. Fairweather said prior to their residence there there was of a huge, ugly recreational vehicle, and now neighbors will see gardens. There should not be concerns regarding extra traffic because it will not be a rental. Mr. Fairweather said the Town of Oro Valley has approved variances on 6-8 homes within a half mile of their home. There is a lack of consistency and uniformity on how the code is applied and enforced. Chairman Christopher suggested that the Board start with item #2, variance on the location. MOTION: A motion was made byMember Zinkin and d seconded by Vice-Chair Fields to approve OV1011-004, variance from the Zoning Code section regarding gthe location only. Vice Chair Fields said the lot is unique and different from the other lots in the area and meets all the criteria. Chairman Christopher said the topographyis very unique to the lot and it was not created by the applicant. There are no special privileges and it is inconsistent with other properties. The variance specifically related to the placement of the structure from the frontro ert line p p Y and that specifically is not detrimental to others residing in the vicinity. 05/24/11 Board of Adjustment Regular Session Minutes 4 MOTION carried, 4-0. MOTION: A motion was made by Member Zinkin and seconded by Member Parisi to deny OV1011-004, the variance regarding the height of the proposed guest house. Member Zinkin said a guest house is not a required condition that everyone enjoys, but the garage is. They can have the garage, pool and the extra square footage, but does not feel 3 ft. are required to improve any kind of room. Member Parisi said there are other places on the property where the existing house can be expanded for more living area. Changing the height would be unique and special. MOTION carried, 4-0. 3. Planning Division Manager Update Chad Daines, OV Principal Planner, gave the following update: - Upcoming Neighborhood Meetings: Taco Bell & Big Horn Commerce - CDRB and Town Code amendments - June 1, 2011, Town Council meeting - Design Standards - July 6, 2011, Town Council meeting - Zoning code amendments: Major General Plan amendments file date to be extended and request to allow outdoor displays in commercial districts. ADJOURNMENT MOTION: A motion was made by Member Zinkin and seconded by Vice-Chair Fields to adjourn the BOA meeting at 4:24 p.m. MOTION carried, 4-0. 05/24/11 Board of Adjustment Regular Session Minutes 5 1 TOWN OF ORO VALLEY BOARD OF ADJUSTMENT MEETING DATE: October 25, 2011 TO: BOARD OF ADJUSTMENT FROM: Karen Berchtold, AICP, Senior Planner HEARING DATE: October 25, 2011 CASE NO.: OV1011-07 REQUEST: Request for variance for property at 125 W. Lambert Lane from Zoning Code Section 23.5.C.2.a.iv. to reduce the required rear yard setback from ten feet to zero feet. The variance requested is to allow a covered patio to extend into the required rear yard setback. REQUEST SPECIFICS: The applicants are the owners of a two-story, single-family home in the Lambert Acres subdivision (Attachments 1 & 2). The property is zoned R1-36 Single Family District (Attachment 3). The lot is a flag lot that is 46,987 square feet in area. Pima County Assessor's data notes the home includes 2,491 square feet of livable area (1994). The home is located near the southern property line. The property includes a paved driveway, covered porch at the rear of the home, and a swimming pool. The home was built under Pima County zoning standards and was annexed by the Town in 1994. The applicants recently purchased this home. Prior to the home purchase, the previous owners built a covered porch at the rear of the home that extends to the south property line with a zero foot setback. The Zoning Code requires that: "Covered porches may extend into the required yard provided that they are not nearer than ten (10') feet to the rear property line. . ." On August 30, 2011, the owners were issued a Notice of Violation of the Oro Valley Building & Zoning Codes. The Notice states that the Zoning Code requires that the covered porch must be set back at least ten feet from the rear property line, and that corrective action is required. The applicants have submitted this request for a variance from the rear porch setback requirement. The setback requirements of the property are: Front yard: 30 feet (R1-36 Single-family District) Side yard: 15 feet (R1-36 Single-family District) Rear yard: 40 feet (R1-36 Single-family District) The property was zoned CR-1 Single Residence Zone under Pima County zoning, which was translated into R1-36 Single-Family District under Oro Valley zoning. No special conditions were noted related to the annexation. NOTIFICATION: All property owners within 300 feet of this property were notified of this hearing by mail. The property is posted with a notice of hearing; notice was posted online at www.orovalleyaz.gov and at Town Hall; and the public hearing was advertised in the Daily Territorial. TOWN OF ORO VALLEY BOARD OF ADJUSTMENT, OV1011-07 Page 2 of 4 EXISTING LAND USE AND ZONING: Subject property: Single-family home zoned R1-36 Single-family District North: Independent Living Facility under construction zoned R-4, Townhouse District East: Single-family home zoned R1-36 Single-family District South: Pima County Flood Plain land zoned R1-144 Single-family District West: Single-family home zoned R1-36 Single-family District SITE INFORMATION: The subject property is Lot 7 in the Lambert Acres subdivision (Attachment 4, 5). There are a total of 8 lots in the subdivision. The subject property is an irregularly shaped flag lot, with approximately fifty feet of frontage on Lambert Lane that accommodates a shared driveway. The topography of the lot is fairly flat, and slopes slightly to the south with an area of drainage at the western end of the lot (Attachment 6). The majority of lots in the subdivision have similar topography. Photos of the covered porch are provided in Attachment 7. SUMMARY: Findings of Fact: • The property is 46,987 square feet. • The property is situated on an irregularly shaped flag lot with a shared driveway. • The property is in the "Lambert Acres" subdivision which is comprised of 8 lots and was approved in 1993 under Pima County. • The dimensions of the lot are approximately 150 feet deep and 360 feet wide. • The date of construction of the home is April 1994, and the home was built under Pima County development standards. • The land was annexed by the Town in 1994. • The applicant is requesting a variance to accommodate an existing covered porch that extends to the southern property line of the lot. • The primary structure is located approximately 17 feet from the southern property line. • The home is located in the southern portion of the lot. • The property slopes slightly to the south. • The existing home is two stories. The Board of Adjustment should consider the following findings in making its decision for the variance request: A. There are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district. The size of lots in the subdivision ranges from 36,861 to 48,398 square feet. At 46,987 square feet, the subject property is one of the larger lots. There is a range of lot shapes in the subdivision; however, the subject property is the only irregularly shaped flag lot in the subdivision. The home is placed at an angle to the rear lot line, and is located approximately 17 feet from the property line. The placement of the home on the irregularly shaped lot imposes constraints on the use of the rear yard. The property slopes slightly to the south; this topography is similar to other properties in the vicinity. TOWN OF ORO VALLEY BOARD OF ADJUSTMENT, OV1011-07 Page 3 of 4 The subject property is one of four lots in the subdivision that borders Pima County flood plain area to the south. The covered porch is located directly adjacent to this open space area, which may be considered a special circumstance. B. Special circumstances were not created by the owner or applicant. The applicant notes that the covered porch at the rear of the property was added by the previous property owners. Those owners did not obtain a building permit for the covered porch, and the project was not reviewed for compliance with Building Safety and Zoning requirements. The current owners state that they were unaware of the fact that the porch is not compliant with Town codes. C. The authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights. The covered porch is constructed over a patio area. The porch extends from the enclosed area of the home and provides coverage for an outdoor bar/dining area and additional area adjacent to the swimming pool to the west, and for the area extending to the property boundary at the south of the home. The longest dimension of the covered porch is approximately 32 feet and the width is about twenty-eight feet. A shaded rear porch area may be considered a typical backyard amenity for homes in the region. If the variance is not granted, the porch would have to be removed, partially removed, or replaced with a smaller structure in order to meet the required setback. D. Any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located. The applicant notes that the only area affected by granting the request would be the open desert area to the south. Setbacks are intended primarily for separation between developed lots and the covered porch setback reduction will be indiscernible from the large open space area. The applicant also notes that other properties in the area have existing structures that extend to the property line. Staff review indicates that the properties to the west do not have structures that extend to the property line. The property to the east has a fence and a wall that appears to meet Zoning Code requirements. The layout of the homes in the vicinity provides most of these homes with larger rear yards than the subject property. E. The authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. Due to the layout of the subdivision, there are no neighbors in the vicinity that would have a direct view of the porch from their homes. The porch would have little impact to individuals walking in the flood plain area to the south. The location of the covered porch adjacent to the open space area to the south imposes the least possible impact on neighbors.
