HomeMy WebLinkAboutOV1801669 2.0 Variance Submittal Content 1. Provide a site plan of the entire property. See Exhibit A. 2. Provide a narrative describing the nature of the request. Include specific details about the property or cased that cause the request. We are requesting to construct an aluminum louvered roof system at the south side of our home. (Construction Plan included as Exhibit B.) The roof system will be 10 feet wide, 16 feet long, and 9 feet high which will be attached to the house and mounted across the open face of the existing patio wall (5 and 1/2 feet tall). The louvered system consists of 23— 10'x8" extruded louvers which can be close or open at angles, with a 2"x8"x1/8" surround frame, then supported by two 4"x4"x9' vertical posts attached to the existing patio wall. The color of the cover will be "Standard Clay" for the louvers and "Textured Bronze"for the frame and posts which will blend in very well with the exterior color of the house. The variance that we are requesting is to allow construction of the cover to encroach 7 feet into the required side yard setback of 15 feet. 3. A Variance from the provisions of the Zoning Code shall not the authorized unless the board finds sufficient evidence: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the districts. - The available flat ground in the back and side yard is limited by the topography. On the east side of the property (back yard), there is rock covered hillside that slopes down into a wash area. The back yard patio and the pool area were then built in different elevation of terraces. Therefore, it is not possible to extend the cover patio into the rear yard on the East side. B. That special circumstances were not created by the owner or applicant. - The property somehow was built very close to the south side of the property line in comparison to the north side. Both the patio and patio wall were already built on the south side when we purchased the home. We do not create any of the circumstances that are leading us to request the variance. - 1 - C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights. - Our current patio does not provide adequate shade to the sitting area due to the south side exposure. The beautiful sunshine here in Arizona, though we appreciate it, shines directly on the sitting area most of the day all year round. Especially our outdoor grill area is completely exposed in the sun. There is not much option to move the grill since everything was already built in. We live here all year round with small children. We would like to spend more time in the back yard and the louvered roof will add more shade and create a more functional outdoor living area. D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located. - We are not requesting to build a structure that is unusual for our zoning district. Properties of similar size in the neighborhood all and should have adequate outdoor living area due to either the size or the better position of the patio. Other options that require no variance reduction such as shade sails or retractable awning would look more intrusive and clearly diminish the value of the property. We selected a design that will blend into the surround of the house with a size that does not stand out from the neighborhood. E. That the authorizing of the variance be materially detrimental to persons residing in the vicinity,to adjacent property, to the neighborhood or the public welfare in general. - The only neighbor that will have direct affects by this variance reduction is the adjacent neighbor(A) on the south side of the property. Our property slops lower than the neighbor's. There is a clearance of 50 feet from their patio to the property line between us and no windows looking into our side of the property. With a matured tree in between, the cover structure in question is not in anyway obstructing the views of the neighbor"A". Their view is mostly towards to the east where their backyard and the mountains are. We have discussed the project with the neighbor "A" and they do not have any objections. Neighbor "B" on North side of our home will not have visual of the cover at all. Neighbor "C" and "0" directly across the street are a considerable distance from our property. Their backyards strategically sit lower in elevation with the wall blocking the street and showing only the view of the tip of the mountains. They will not see our louvered roof even if they stand up in their backyards. To make -2 - sure we are in line with property value in the neighborhood, we have also obtained an approval from the Moonridge HOA which is attached (Exhibit C). We appreciate your consideration and approval of our variance request. It would definitely create a much more functional outdoor living space for us and potentially increase the value of the property. -3 - '4', A' •••MMM""" •.• 44:011L, ' • Oft 4 * , arlOW s ' ' ' - / p . , ,,,,,,, Ai ir • .-41.", •' , , 4*.. .----; . ,, 'ilL".- liltt i ... 4 ' 40 .
