Re: Stone Canyon Sales Center Building
Request for Extension of Allowable Land Uses
Dear Mr. Vella:
Thank you for your letter dated Oct. 11, 2017 in which you outlined the steps we needed to take to address some land
use violations and then to secure an extension of our ability to continue to sell new Stone Canyon lots and homes from
the sales center building. In your letter you noted four specific items to address:
1. "The resale of lots and homes, Fairfield corporate office use and signage, and golf course and clubhouse
sales must desist within 30 days of this letter (11110117). "
➢ These activities ceased within the sales center prior to 11/10/17.
2. "Sale of lots and homes only within Stone Canyon has been provisionally granted for the next six (6) months.
This supersedes permissions granted on 411116. Over this period, further investigation into the allegations
of outside sales will proceed. Any future violations found relative to umpermitted office uses will result in
termination of all "temporary permissions ". "
➢ No additional violations have occurred.
3. `At the end of the six month period, the Town must decide whether this long term sales use is no longer
considered "temporary". A code amendment may be required. "
➢ We hope that the long term tales use will still be considered temporary because it will come to an
end when the remainder of the new lots and homes are sold.
4. "The HOA offices may be housed in this facility as long as `community ownership' is maintained. "
➢ The HOA has continued to maintain an office and conduct business as the ownership entity has
notb changed.
Therefore, we respectfully request that the permitted sales uses continue to be allowed.
Sincerely,
X e, /%

RE: Request to extend temporary use of the Stone Canyon Sales Center, 405 W. Tortolita
Mountain Circle
Dear Mr. Williamson
In response to your letter dated 2/6/18, the formal request to extend use of the Stone Canyon
Sales Center has been granted for another two year period. This approval is subject to ongoing
compliance with all Section 25.111 zoning provisions.
As you are aware, Oro Valley Zoning Code section 25.111 enables a temporary real estate office in a
residential zoning district only for sales within a developing subdivision. Your attached letter re-
establishes that the building is only used for Stone Canyon property sales. Furthermore, there
appears to be a need for the office due to the number of remaining lots and future subdivision
plans.
Zoning requires reapplication every'two years. When most of the Stone Canyon lots have been
absorbed, it will be time to discontinue the temporary real estate office. It was originally
envisioned that this building would be transitioned to a permanent use such as a
neighborhood/HOA center, home, etc.
Thank you for the timely response prior to expiration of the previous allowance. I look forward to
working with you in the future.
Sincerely,
