DEVELOPMENT REVIEW BOARD REPORT
MEETING DATE: February 11, 2003
TO: DEVELOPMENT REVIEW BOARD
FROM: Thomas Keiran, Planner I and Bayer Vella, AICP, Senior Planner
SUBJECT: OV12-02-19; COMMERCIAL DEVELOPMENT PROPERTIES, INC.
REPRESENTING THE TOSCO CORPORATION, REQUESTS
APPROVAL OF A DEVELOPMENT PLAN FOR A COMMERCIAL
DEVELOPMENT TO BE LOCATED IN THE ROONEY RANCH
PLANNED AREA DEVELOPMENT AREA B, NORTHEAST OF
THE HOME DEPOT, PARCEL 22008001J.
BACKGROUND:.
The subject property is located on the northeast corner of La Reserve Drive and North Oracle Road
within the Rooney Ranch Planned Area Development (PAD) Development Area `B". This particular
parcel has been earmarked for commercial development for the past 13 years ever since the Rooney
Ranch PAD was adopted in February of 1990. The PAD was created with eight specific land use
designations, Areas "A" through "I", and each area has detailed permitted uses and development
standards. Additionally, this property was originally designated as Sub Area 6 of Area `B." As with
the larger areas, the sub areas had defined development criteria. Ordinance (0) 97-17 deleted the sub
areas and set new development standards for Area `B." The ordinance also specified that permitted
uses of Area `B" are extended "in the area formerly known as Sub Area 6" to allow one Retail /
Convenience Use Gasoline Sales. The Planning and Zoning Administrator has determined that the
proposed non -convenience use Retail / Auto service is less intense than a gas station and, as such, is a
permitted use.
SUMMARY:
General
Commercial Development Properties, Inc. has proposed to develop the subject property for a "Big-0
Tire" service/tire center and retail shop. The property consists of 1.43 acres with a proposed net
building area of .24 acres. The development plan includes a 5,154 square feet structure for the tire store
and another 5,448 square feet structure for a variety of retail uses. The later structure will most likely
have three or four tenants.

Development Standards
As mentioned above, the development standards for the Rooney Ranch PAD Area `B" apply to this
property and when an item is not addressed the standards of the Town's C-2 zoning district apply. The
property must also comply with select standards of the Oracle Road Scenic Corridor Overlay District
(ORSCOD).

The proposed development plan complies with the development standards derived from the PAD and
OVZCR except for the Northern landscape buffer, the parking space counts and the location of the loading
zone. The applicant seeks adjustments by the DRB and the OVZCR provides a degree of DRB zoning
discretion on these three items. Each issue is discussed in the OVZCR Compliance section of this report.
PAD AREA "B"
The proposal complies with the Rooney Ranch PAD Area `B" development criteria except item F, which
stipulates that auto service bays shall not face Oracle Road. Staff finds that the applicant has successfully
placed the building so that the service bays are angled away from Oracle Road. While they do not directly
face Oracle Road, they will be visible. The applicant has included combined a 5 feet high screening wall and
3 tiered landscaping screening to effectively screen the service bays. Also, the landscape screening buffer
yard is between 5 to 10 feet more than required by the Landscape Code.
OVZCR
ARTICLE 8-3. C-2 COMMERCIAL DISTRICT
The proposal complies with the standards and regulations of the C-2 Commercial District.
ORSCOD
The proposal complies with the standards and regulations of the ORSCOD except where exempted by
OVZCR Section 10-401 A.2. A Viewshed Analysis was submitted in accordance to the ORSCOD
requirements and the property was determined to not be located in a significant view corridor.
LANDSCAPING
The buffer yard requirements are also derived from the documents mentioned above and are as follows:
Direction Required Proposed
North 15 feet 5 feet
C-2 adjacent to a residential
district (OVZCR Sec 14-207
A)
South 0 feet 10 feet
C-2 adjacent to C-2
East
West
30 feet 30 feet
(OVZCR Sec 10-407 C.5.a.)
0 feet
C-2 adjacent to C-2
10 feet
The Northern buffer yard does not comply with the zoning code requirement as provided for in OVZCR
Sec 14-207 A, TABLE 1:REOUIRED BUFFER YARDS. The DRB may modify buffer yard requirements
where conflicts with standards and code requirements occur per OVZCR Sec 14-207 A.51 The applicant
requests, and the staff supports, the Northern buffer yard requirement be reduced to 5 feet for the following
reasons:
Conflicts with OVZCR
1. 'While the property to the north is technically zoned R1-144 it is, in actuality, a drainage area that
feeds into the Canyon Del Oro Wash. The property, commonly called La Reserve Foothill Wash, is
owned by Pima County and is a Public Drainageway dedicated by BK 37, M&P PG 8. Staff is
confident that the property will never be built on. As stated in OVZCR Sec 14-207 A, the purpose
of buffer yards is to physically separate and visually screen adjacent land uses. The drainage area is
approximately 160 feet wide north of the subject property and effectively separates this project from
the adjacent use and the wall effectively screens the use. Staff finds that the intent of the code is
being met.
NEtigating Factors
1. The property north of the drainage area is the 15 acre Steam Pump Ranch site that is currently in review
to be rezoned from R1-144 to C-2 (OV9-02-12). Buffer yards are not required between two C-2 uses.
2. The proposal includes a 5 feet high screening wall to the north.
3. The Town has been granted by the County a stretch of land 15 feet wide that runs the entire length of
the Public Drainageway immediately north of the subject property for use as a public trail. The applicant
has agreed to create a Trail Head area, approximately 100 SF, at the extreme northeast corner of the subject
parcel, which will be dedicated to the Town. The applicant has also agreed to pay an in lieu fee to create a
paved multi purpose trail for the Town.
4. The width of the Public Drainageway is approximately 160 feet, effectively separating the two uses.
In sum, the County property to the north is not, nor will ever be, developed as a residential use and does
not need to be buffered as such. The applicant has met the intent of the code by including a five feet high
screening wall that both separates and screens the use.
It is worth noting that the landscaping plan is an integral part of this review and is discussed throughout this
report because it is used to mitigate non complying items. The Landscaping Plan complies with the
OVZCR except for minor items that will be addressed during its review.
PARKING
The proposal includes 39 parking spaces. Staff has calculated the number of required parking spaces to be
46 based on the ratios provided in OVZCR Section 27.6 D.3.
Use Required Parking/SF Proposed SF Required
Parking
General Retail 4/1,000 7,599 31
Auto Service 5/1,000 3,000 15
Total 46
OVZCR Section 27.6. C.2 allows the DRB to approve an alternative parking ratio. The purpose of the
alternative compliance analysis is to explain how "the plan will be equal to or better accomplish the purpose
of this Section". This section also contains very specific criteria for DRB to consider when considering the
proposal. The applicant has submitted an Alternative Compliance analysis for consideration, attached
herewith as Exhibit "B". Staff offers the following comments on the analysis (numbered according to the
submittal):
1✓
2. Nearbv Parking: The applicant discusses the availability of nearby parking at the Home Depot site. A
shared parking agreement has not been provided by the applicant.
3. Availability of shared parkin : The applicant states tha
t the two uses on this site will have shared
parking rights. This is a common contractual agreement for commercial development with more than one
` stru ture. However, DRB should not confuse the private shared parking rights agreement stated by the
applicant with the criteria for defining shared parking in OVZCR Section 27.6.D. +. This section states:
When a mix of non-residential uses creates staggered peak periods of parking
demand, shared parking calculations shall be made to reduce the total amount
of required parking for retail, office, institutional and entertainment uses.
The applicant states that the hours of operation of the two retail structures will be similar. He also states
that the second (non Big-O Tire) structure will have a variety of retail uses and has discussed having either
3 or 4 tenants. While the Parking Section of the OVZCR bases required spaces on the total square feet of a
retail use, the DRB may wish to consider the different parking demands of the retail structure having
multiple tenants. Staff has evaluated this report based on the understanding that the retail structure will not
have a restaurant or similar use that generates high traffic.
4. Factors that are unique to this development: The applicant mentions a hardship created when the
entire shared ingress/egress easement (DKT 8894 Page 943) dedicated on the Rooney Ranch Area B
(Home Depot) development plan was placed on the subject parcel. However, it is not known if the
property owner received compensation for placing the easement thusly.
The applicant explains the nature of the express retail tire business will not require many customers to
occupy parking spaces. Staff agrees with this assertion. One of the purposes of the new parking code is to
reduce excessive off-street parking. The applicant could fit in the required parking spaces, much to the
detriment of the overall design. The following design features would be eliminated if 46 spaces are
provided:
I. The number of landscape islands along the northern limits would be reduced. The applicant could
omit a landscape island along the northern limits by moving the dumpster/tire storage unit
approximately 30 feet to the west. However, changing the location would have the undesirable effect of
making the dumpsters become the most prominent feature as one enters the property. Staff would
rather see it remain where it is.
2. The landscaped area screening the service bays would be reduced. The applicant could move the
screening wall forward, reduce the width of the landscaped area and still comply with OVZCR
requirements. Two or three parking spaces reserved for staff could fit into this area. The applicant
does not wish to squeeze in parking spaces only to fulfill a code requirement and staff concurs.
3. The loading zone would become more prominent. The loading zone is located behind the retail
structure, effectively screened from adjacent uses and most on -site uses. The applicant could move the
loading area forward and place a parallel parking space abutting the landscape area north of the retail
structure. Again, this would be a detriment to the overall design.
In sum, the OVZCR Parking Code states that it wishes to reduce the number of required parking spaces by
allowing an Alternative Compliance analysis. While the applicant's analysis requires some revision, it serves
to provide a realistic view of their actual parking needs. Staff recommends DRB approval of the alternative
compliance analysis to reduce the number of required spaces from 46 to 39.
Other Parking Issues
Location of Loading Space
The loading space is located 120 feet from the Big-O Tire store, which is further than the 100 feet distance
allowed in the Parking Code_ OVZCR Section 27.7.13.6. allows the DRB to reduce the location of required
loading spaces where they determine that an unusual situation exists. Staff suggests that since new tires are
stored inside and that most likely a truck will pull up to a service bay during off -hours, the loading zone
requirements provided in the OVZCR do not meet the needs of this use. Staff finds that the loading area is
located in the most appropriate location, tucked behind the second retail use and thoroughly screened from
the adjacent property, and recommend the DRB approve the location of the loamag area as proposed in the
development plan.
Pedestrian Access
In compliance with the Town Bike and Pedestrian Plan, the development plan incorporates pedestrian
circulation to the adjacent properties. Specifically, there are pedestrian sidewalks on the east side of the
property (Oracle Road) that will link the existing sidewalk to a future trail. In addition well placed
pedestrian access between the two structures on site.
Location of Bicycle Parking
A sufficient number of bike lockers and bike racks have been provided, appropriately located between the
perimeter screening and the main entry of the "Big-O Tire" store.
Si za e
The applicant has had preliminary discussions with Town staff about submitting a comprehensive sign
package. They are aware that signage must comply with OVZCR Chapter 12.
Lim
A condition has been added to include a General Note that states: "A Lighting Plan must be submitted in
accordance to OVZCR Section 17-301 before a building permit is issued."
Gradin
A Type 2 Grading Permit will be required to construct the building pads, drainage structures, utilities,
parking lot, and any walls necessary for grading on the development site.
Drainage
The existing drainage patterns from the northeast to the southwest will be altered to accommodate water
harvesting and first flush requirements for this site. The developed drainage will be directed south and east
to a depressed landscaped area just north of the existing north entrance drive into the Rooney Ranch PAD
area B. Drainage will then sheet flow across the existing drive and parking lot into an existing storm drain
inlet.
DESIGN GUIDELINES
The development plan complies with the design guidelines of the PAD, OVZCR, and the ORSCOD. One item
worth noting is the ORSCOD consideration to provide pathway links to planned recreation trails (OVZCR
Section 10408 D.5.c.) The proposal includes a sidewalk that links to the existing one in front of Home Depot
and has provided an area approximately 100 SF that will be dedicated to the Town as a public recreational Trail
Head. Furthermore, the applicant has agreed to provide an in lieu fee to create a paved multi purpose trail for
the Town. A condition has been added to include a General Note that states: "The developer has agreed to
contribute an in lieu fee to improve a multi -purpose trail on the Pima County property located immediately
north of the subject property. A bond to insure improvements to the portion of the trail that runs from the
eastern limits to the western linuts of the subject property is required prior to the issuance of a grading permit.
The improvements shall consist of, at a minimum, a 12 foot wide Integral Color Concrete Asphalt path
flanked on both sides by 2-3 feet of stabilized decomposed granite. The bond will expire in 10 years"
Additionally, the proposal adheres to the design guidelines in regards to screening from Oracle Road and adjacent
uses. A screening wall and three tiered landscaping plan provides a satisfactory screen of the use from Oracle
Road while preserving the significant vegetation. The screening wall along the northern property limits is also
successful in separating and screening the property from adjacent uses.
GENERAL PLAN COMPLIANCE:
The Development Plan complies with the General Plan as proposed. The following items are noteworthy:
• Policy 3. IM, "specialty commercial developments is encouraged in appropriate locations"
This particular type of development, which provides a variety of retail shops, is encouraged as part of the
General Plan.
• Policy 9.11), "all development proposals should attempt to arrange building, massing of buildings, and/or
arrangements of lots to preserve views from adjacent properties and streets while providing privacy for
residents ".
Policy 9. IH, `Landscape improvements are to:
- preserve, restore, and enhance the ecological and scenic qualities of the natural landscape;
- mitigate negative visual impacts of buildings and parking lots;
- add aesthetic chcnm, interest and character; and
- improve the functional use of a site "
PRESENTATION REQUIREMENTS:
As established in Resolution No. (R) 98-31, "all presentations before Boards, Commissions, and Council" must
be formatted to be shown on the Town's projection system or overhead system. A presentation must be
designed to insure that the audience staff and the voting; body can view the rauhics. Examples of acceptable
computer formats are PowerPoint, ArcView, videotape of presentation boards, and/or overhead transparences.
The applicant is responsible for the development, presentation, and coordination of all presentation materials. If
an applicant does not conform to the aforementioned resolution, the item may be continued due to non-
compliance.
RECOMMENDATION:
Staff finds that the proposed Development Plan for the `Bib O Tire" store and retail shops is good layout —
particularly in context of the Home Depot site.
The DRB is being asked, and has the authority, to modify the following items:
1. Reduced landscape buffer to the North
2. Reduced parking space requirements
3. Permission to locate the loading zone further than 100 feet from the front building.
Staff has addressed each of these items in detail above and finds that they are appropriate requests.
Staff recommends approval with the conditions in Exhibit A

Hello all,
After reviewing the event checklist for next week there are only a few
details that are in need of a volunteer on the day of the event. If
someone (Laura maybe) could send me the criteria for the AICP CM
write-up, I will take care of that this week and send to Karen. What I
have listed for the day of the event are:
* Order Food: Pamela
* Pick-up Food: volunteer needed
* Distribute Food: Laura
* Beverages: Kelly
* Sign -in Sheet: Kate
* Cashier: Kate
* Speaker Gift: Volunteer needed, doesn't Danny have the gifts
rolling around in the back of his car, or stuffed in his closet?
* Introduce Speaker: Pamela
After event
* Clean-up: everyone
* Forward sign -in sheet to Karen: Kate
* Thank you letter: Jason
The only other consideration is that the computer at the conference room
doesn't accept flash -drives. In the past, I have used my laptop and
plugged it into the blue projector cord that is attached to the ParkWise
computer. If someone has a laptop that they can bring, it will ensure
the presentation is seamless. In the event there is no computer to be
used, the staff at Pennington have the capability to burn the
presentation to a CD and use that (it's a pain).
Once the computer is plugged in, there is a remote control in the 2nd
drawer from the left that turns on the projector. There is no remote
control for the presentation, unless one of you bring one.
I think that covers all the bases, or have I forgotten something? Jason

RE: OV1208-22, The WLB Group, Inc. on behalf of Big O Tire, requests approval for a
Minor Land Division to split one lot into two to create a new lot for the existing Bedmart
building, parcel # 220-08-001J.
Dear John:
Thank you for attending the DRC on December 8, 2008 to discuss this project.
Staff has determined that this request does not meet the requirements for a minor land division
by researching the parcel genealogy through Pima County Assessors. It appears this parcel is
derived from parcel 220-08-0010. That parcel has been split 3 times since October 1988, when the
land was annexed. Under the Town's Zoning Code definitions, a subdivision: "Shall mean
improved or unimproved land or lands divided for the purpose of financing sale or lease, whether
immediate or future, into four (4) or more lots ..."
Under a minor land division, a parcel may be split to create up to three lots, but four lots triggers
the subdivision process.
At the DRC meeting, staff discussed open space requirements. Staff confirmed that if the lots
were split, they would not need to individually meet the 20% open space requirement.
As noted, staff informed the Barclay Group they must file a subdivision plan for the entire
Rooney Ranch Area B site. If you wish to subdivide the Big O Tire parcel, it may make sense to
do so as part of the overall subdivision.
Please do not hesitate to contact me if I can be of further assistance.
Sincerely,
Karen Berchtold, AICP
