We've discussed options with the client and believe it would be the best to install new landscape and irrigation with 3117 E. Flower Street combination of mitigation vegetation. This would include minimal tree replacement at 1:1 Tucson, AZ 85716 with additional saguaros, accents, shrubs and hydro -seed to re-establish a natural buffer Phone 520 882 9655 along Oracle Road. The proposed mitigation will be to re -vegetate the disturbed areas by www.arestudiasinc.com the property owner as well as utility disturbances along the first 30 feet of the property that have not returned to natural conditions. Attached is a proposed plan that maybe used to address the cleared areas on site and along the easement. We may look to extend the mitigation further north along the property line and disturbed areas. This plan may be further revised with the proposed mitigation with the potential PAD amendment and redevelopment of the property. Please review the attached plan and provide approval or comment as to how we should revise or amend the plan so that the property management company may maintain visibility to the site as well as address the Town of Oro Valley's ordnance. Please contact our office if you have any further questions or concerns. Respectfully, ARC Studios, Inc. Swan Road #200 Tucson, AZ 85712 pskillings@westcommerical.com RE: Rancho Vistoso Center Native Plant Removal Violation OV1294-16 Dear Philip, The purpose of this letter is to provide the fines and procedures associated with the unapproved removal of native plants at the southeast corner of the Rancho Vistoso Shopping Center at Oracle Road and Rancho Vistoso Blvd. During the month of December 2016 plants that were originally part of the 1994 native plant salvage plan were removed without prior approval or revised plans. This plant removal is in violation of the Oro Valley Zoning Code (OVZC) section 27.6.B. Staff has researched the plant salvage plan, aerial photos and existing site conditions and have determined that the following number of native plants were destroyed, in violation of the approved Native Plant Preservation Plan: • Six (6) Mesquites • Seven (7) Palo Verdes • Three (3) Catclaws The Development Services Penalty Schedule prescribes the fines to be assessed to Native Plant Salvage Violations. Based on that penalty schedule and the research, the total fee for the violation is $78,300. New permits may not be issued until the required fines are paid to the Town for the purposes of replacing and maintaining protected native plant materials (OVZC 27.6 .B.6.a). Next Steps: A revised landscape and mitigation plan shall be submitted for review and approval. The plan shall provide a ledger with the description, caliper size and costs of the plants of like sizes of the removed plants. Post an assurance for $78,300 plus a 20% contingency fee. The contract for the replacement and three (3) years maintenance is required to be executed by you. An amount equal to but not exceeding the amount you pay for the specified mitigation will be paid to the Town as penalty for the violation. For example: Any fines in excess of the amounts specified in the agreement to replace and maintain plants shall be refunded. For example If your contractfor the replacement and three (3) years maintenance is $100,000 and your penalty is $78,300 you will pay $100,000 per the contract to install the plants and the Town will return $78,300 to you after plant installation. Another example is if the replacement contract is $60,000 and the fine is 78,300 then the fine owed to the Town is 18,300. It is important that you work with staff on any remaining issues or action items to prevent future delays to your project schedule. It is the Town's desire that all remaining issues be resolved so that future improvements can continue as soon as possible. Please contact me if you have any questions. Swan Road #200 Tucson, AZ. 85712 Phil.skillings@naihorizon.com RE: Rancho Vistoso Center landscape plan case # OV1702168 regarding violation # OV1294-16 Dear Phil, This letter is to follow up our meeting from Wednesday, May 23. At that meeting you asked if there was an avenue that would allow you to obtain permits to install new monument signs prior to depositing the violation fines and completing the landscaping near the corner of Rancho Vistoso Blvd and Oracle Road. We also understand that you are interested in submitting a Planned Area Development (PAD) Amendment that could affect the design, drainage and future landscaping at the corner of the property mentioned above. The process that would allow you to obtain sign permits immediately is to first pay the fine associated with the unauthorized removal of the native plants. The zoning code, section 27.6.B.6.a, does not allow new permits to be issued until the required fines are paid. The fine of $78,300 is required to be paid to the Town in order for the sign permits to be released. Next steps related to address the violation: 1. Complete the remediation agreement by: Adding language clarifying that you will be submitting either a PAD amendment or choosing to install the landscaping related to the violation within 6 months of the date the agreement is executed by all parties. Include language that the 6 month timeline may be extended by the PZA if the PAD amendment and associated plans have been submitted for review at the Town. There must be proof the PAD exemption is in process in order for the landscape remediation deadline to be extended. 2. Submit a complete draft of the agreement for review and approval by the Town. 3. Once the agreement is approved, it will need to be signed and notarized 4. Deliver the signed and notarized agreement to the Town Oro Valley, it s in our nature. 11000 N. La Canada Drive, Oro Valley, Arizona 85737 www.orovalleyaz.gov I phone: (520) 229-4800 1 fax: (520) 742-1022 You may then proceed with either one of the following processes you choose in the agreement: Install the landscaping per the approved landscape plans associated with the native plant removal violation. After installation, the Town verifies the plants and irrigation have been installed per the approved plans. Request a refund of the fine with documentation showing the final costs of the plants, irrigation and installation. Refunds of violation fees are based on evidence that final costs met or exceeded the amount of the fine. If the final costs are below the amount of the fine, the difference between the fine and costs are held by the Town. OR . Submit the PAD amendment with the proposed landscape plans and native plant salvage plans. i. Complete the review and gain approval for those plans. ii. Obtain the associated grading permits iii. Post a bond for the work related to the PAD exemption iv. Install the improvements associated with the PAD exemption V. Request a refund of the fine with documentation showing the costs of the plants, irrigation and installation according to section a.ii above. vi. 90% of the landscape bond could be released once the landscape improvements pass final inspection. The remaining 10% is then held for 1 year as a warranty period to verify the survival of the installed landscaping., Please contact me if you have any questions. Regarding 1J, my questions is why is the Monument sign specifically mentioned. I would recommend that it be amended to say something like any future disturbance of the landscaping needs to be approved by the Town. Something else to bounce around, I was thinking that there should be a clause where, at a date picked by the Town, if WCCP has not completed installation of everything in Exhibit "A" that WCCP agrees that the Town has express permission to engage the services of a landscaping company to enter the property and complete the work and that WCCP further agrees to pay the Town for all costs associated with ant Town landscaping installation. Maybe this can be a subsection 1.g? or If we do this Section 8 can be taken out of the agreement or Section 8 can be a place for this language. Section 11, are we sure we want to go to Arbitration? Just a question but if we go to either Mediation or Arbitration the Town is not likely to get all we are asking for. Who drafted this up? Joseph N. Next Steps: 1. The corrections listed in items 1 through 6 in the September 19, 2017 letter were addressed in the second submittal. However, staff has one comment related to those plans. Ironwood trees are proposed to be planted in place of Mesquite trees. Due to the water expected to accumulate in the drainage area, Mesquites should be planted instead of Ironwoods. Within 60 days from the date of this letter: 2. Develop and submit a draft of the landscape installation and 3 year maintenance service agreement (OVZC Section 27.6.B.6.d). An example was forwarded in an earlier email and is attached to this letter. 3. Deposit the fine of $78,300 into an account with the Town. 4. Post an assurance for $98,721.60 (probable cost estimate which includes a 20% contingency fee) 5. Once the agreement is approved, fines are paid and a bond is posted, other permits for the property can be released. This includes the monument sign permit which is currently on hold. Within 6 months from the date of this letter and after items i thru 5 above are completed: 6. Install the plants and irrigation per the approved plans. 7. Submit, to the Town, final receipts of plant and irrigation installation costs. 8. After verification of installation, the total contract cost or fine amount, whichever is less, will be returned. 9. The landscape maintenance bond will be held for three (3) years to align with the maintenance agreement. Please contact me if you have any questions. The landscape plan was required due to the unapproved removal of native plants at the southeast corner of the shopping center. That plant removal is in violation of the Oro Valley Zoning Code (OVZC) section 27.6.B. Staff had determined that the following number of native plants were destroyed, in violation of the approved Native Plant Preservation Plan: • Six (6) Mesquites • Seven (7) Palo Verdes • Three (3) Catclaws Review of the first submittal of the landscape plans, to mitigate the unauthorized plant removal, has been completed. Below are comments for sheet 1 of 1: 1. The following "required notes" need to be removed as they are not relevant to this project: 2,3,4,5,6 & 8. 2. Modify the language in the Maintenance Provisions, note #1 to be relevant to this project. 3. List the size of the proposed saguaros. 4. Provide an irrigation plan in accordance with OVZC 27.6.D. 5. Add case number OV1702168 to the plans. 6. The plant, Justicia Californica has a water use of type 2/3 which is not allowed along site perimeters, per OVZC 27.6.C.3. Next Steps: • Submit a corrected landscape plan • Submit a landscape bond estimate with a ledger of the proposed plants, size and costs. • After the bond estimate is approved, post an assurance for $78,300 plus a 20% contingency fee.
