Individual pads were excluded from the landscape plan because it was understood that the landscaping would be installed as those pads were developed per the approved landscape plan general note #9. Ownership of each parcel isn't an issue the Town normally gets involved in. The landscape plans are submitted and approved as part of the overall development and expected to be installed as such regardless of ownership changes thought time. The Oro Valley Zoning code section 27.6.C.4.0 refers to the responsibility of buffer yards such as the Oracle Road side. "The first use shall provide the required buffer per table 27-7, which is the landscaped 30' buffer. The first user, Evergreen in this case, creates the buffer yards. It is surprising that Evergreen does not want to complete the entryway and bufferyard landscaping as approved. Evergreen did such a fantastic job with phases 1 and 2. Those perimeters and entries (common areas) were landscaped early in the development even though there were other ownerships at the time. Unfortunately some of those parcels remain vacant but the entry and perimeter landscaping is still intact and helps detract from the vacant parcels. I'm not sure applying for an amendment to the landscape plan would work because your aren't asking to change it but to eliminate some of it. I have attached a pre -application form that you could use to explore the amendment option. The pre-applicaiotn meeting is an informal meeting to discuss potential develoepment issues for a project. It's a good way to get started without spending too much time and money on something that may or may not go forward. You'll notice that it's dated September loth, 2010. We completed our review and identified what remained to be constructed (landscape) on the 15th of September (completed by Jonathan Lew). The letter sent from Laura Ortiz to the attention of Shane Stephens, which was also copied to Paul Popelka and other town staff in March of 2010, discusses the potential deferral of landscape work on the Mid -First parcel. I don't think any final agreements were reached or revisions to the plan agreed to that I can find record of. As previously noted, the landscape bond is in place to assure completion of the landscape installation, and survival for not less than one year before we are authorized to release it. If we were to fully release the bond in place for this parcel, which was included in the original bond in question, there would no longer be assurance that this would be constructed as approved. The greater number of trees and understory plants occur in the buffer zone and entry corridor. I'm not sure why these wouldn't have been constructed as a part of the overall landscape package for thisphase of the development since this area. The only options that I'm aware of that would allow a release would be a substitute bond for the portion that is proposed to be constructed in the future; or an amendment to the landscape plan that removes the parcel owned by Mid -First. Since I was not involved with the original Development & Improvement Plans I will need your help understanding the requirements for Landscaping. It appears that during construction meetings it was discussed that MidFirst was not building and a decision was made on our end to not install all of the landscaping because MidFirst would install on their property when they built as part of their permit requirements. We sold this property to MidFirst in 2008. 1 am not sure if MidFirst will ever build or even if this will be a bank since they may sell the property. I don't like having our money outstanding on their development which may not happen for 3 + more years. Was this required as part of our development plan to 11 /08/2011 Page 3 of 6 install at the very beginning or is there some path to go forward where this will be a condition of whoever develops this parcel? I am very interested in doing a walk-thru on the other landscaping so we can get that portion of the bond released and also on the Phase II outstanding bond which I believe is from Wingate's construction. I am meeting QuikTrip on Thursdaay 11/10 from 10 —11 but could be available after (preferred) or before this time to walk the site. Please let me know what makes the most sense. Involving Mr. Williams or Michaels at this point would probably not be an effective way of changing the status since we are the division doing the bond reviews. The last letter that I've seen (generated by Jonathan Lew) was dated September 15, 2010 (5 days after the letter between Shane and Paul Popelka), and it identified what was needed to get the bond reduction to the 10% level. It was copied to Paul Popelka and Shane Stevens and identified 14 trees and associated understory plants that were not in place. I know that Jonathan also had discussions with Shane and he may be able to shed more light on it than I can. If the vegetation mentioned is on a separately owned property but is encompassed in one landscape bond then I would guess a substitute bond would be needed for the portion not planted at this point. It seems that we were released for the 10% for the landscape we installed but there was a remaining 5% for plants on the MidFirst parcel that was discussed with Paul Popelka and a letter was written explaining this and it was discussed at a meeting that we were not installing this landscaping because this was on MidFlrst's land that we did not own (the letter goes into more detail). It appears that after Shane understood the release sent by William he sent an email to Paul I<eesler (attached) and that Paul forwarded this to David Ronquilo who was going to speak to David Williams about this (email attached). Unfortunately for me this was never relayed when I took over the project a few weeks later so I never followed up. I just put the 10/12 release on my calendar to follow up on. I would love to get what we can released now and continue this discussion for landscaping on the property we do not own. I am going to be at Steam Pump Village with my property manager on 11/10 for a meeting with QuikTrip at 10, 1 could meet someone from the town at 9 or 11 to do a walkthrough of the landscaping if possible or we can pick another date and time. In response to the inquiry about the landscape bond (specifically); I know that there were two bonds that were requested to be reduced at the same time. The grading bond, which was reviewed by Chad Dalton, and which was allowed to be reduced to the 10% threshold for one year; also the landscape bond, which was reviewed by Jonathan Lew. In working with Shane Stephens two letters were provided that identified the status of the site landscaping (in accordance with the approved plans). The letter dated August 26th was provided to Shirley Gay who at the time was the lone person responsible for administering and tracking bonds. The September 15th letter which was copied to Shane Stephens, Paul Popelka (Planning Manager at the time), and Shirley Gay is the one that allowed the reduction to 15% of the original bond (to its current level) and also identified what would be needed to further reduce and eventually fulfill the bond requirements. Whether action was taken by Shane to administer the completion of necessary plantings identified in this letter I don't know. 11 /08/2011 Page 5 of 6 My recollection was that since future development wasn't known in these areas he didn't want to have it done. If this was done we were not requested to follow up with a third inspection to allow further reduction to the 10% threshold, which is why the bond remains at 15% of the original amount today. My guess is that the letter from William Vicens was probably confusion between two separate bonds, for the landscape bond was reduced to, and remains at, 15% of the original amount. Without making excuses, there was training taking place to have the permit techs take over the administration of bonds. Also, Shirley Gay missed a significant amount of work due to health issues around that time period. Regardless, the bond amount is currently at the 15% of original and can only be reduced by an additional 5% if the plantings are in place. I certainly apologize for the confusion on this one. I fully understand why you would be under the impression that the landscape bond had also been reduced to 10%. As stated previously, we'll be glad to follow up with a third inspection to see whether the further reduction can be done; or can meet on site to discuss this. Let me know what we can do to help, and to hopefully clarify where we're at today. We didn't revise the plans, they recommended that we just as -built them. For reference, attached is the limit of construction on the landscaping. I think this is the area you may be referencing where you don't see all the final landscaping installed. Let's talk when you get the chance. Thanks Jonathan. You might speak to Paul Popelka — he was in one of the meetings where we discussed the deferred improvements. PLAN 91 shows the islands that we are proposing to install the irrigation system only, but no landscape materials. We can also provide the decomposed granite to provide a more finished look, but are really hoping to save the water and the maintenance on the trees and plant materials for BASIS and the existing owners/tenants at Steam Pump. Additionally, PLAN #1 also shows the light poles/bases that will be installed now (circled in green) and the bases only that we will install now (with the poles to be deferred). The Entry Walls and Seat Wall are also shown to be deferred. PLAN #2 shows the property line/ownership boundaries of the MidFirst parcel. We hope to hear back from MidFirst by Friday on their final answer of whether they want us to proceed with constructing all of the improvements on their parcel (up to the fairly tight building envelope shown on the plans), but I think it is most likely that they will not want us to construct their improvements at this time. In the event they do not want us to build all of their improvements, then we would not build the parking lot/lighting/landscaping highlighted in yellow. Additionally: 1. PLAN #3 shows the landscaping at the entry that we would still construct, in order to provide a good looking entrance into the project. There are four salvaged trees off to the side that we would also 08/26/2010 Message Page 2 of 2 install now. The monument sign in this area is the one I mentioned yesterday that we would also construct. Other than what is highlighted in orange, none of the other landscaping would be constructed until MidFirst develops their parcel, and then they would install the remaining improvements. 2. PLAN #4 shows the water line extensions to their building envelope that we would not construct if MidFirst does not want us to construct their improvements at this time. We would install the extensions out beyond the pavement/improved landscape areas and then cap them. I hope this provides adequate detail and definition to our "phasing" proposal, but please feel free to call me if you have any questions. Even though we may not hear from MidFirst until Friday, I am hoping we can reach agreement on the phased improvements without having to get a final decision from MidFirst. If they do want us to build it all, then we will. But, if they don't, then at least we'll already have our agreement in place with the Town and can quickly spring into action either way. Popelka, RLA/AICP Planning & Zoning Town of Oro Valley 11000 N La Canada Oro Valley, AZ 85737 RE: Steam Pump Village — Landscape Plans (Phase 3) Construction Dear Paul: You may recall we were permitted not to install all of the landscaping on the MidFirst pad per a request from Laura Oritz. Attached is a copy of the request email from Laura and the drawing that accompanied it which was discussed during one of our Town Meetings during the construction of the Basis School. We have completed the landscape improvements (as highlighted) on the MidFirst pad. At our meeting we discussed not modifying the plan, but rather just marking it up when it is completed on the plan. I have attached that plan for your files and use. Johnathan Lew requested your approval on this plan to finalize and release the bonding (since a formal plan was not submitted but rather discussed and agreed upon during the Basis construction). Attached for your use and for Jonathan's release of the bonding is a plan showing the grading lines and the landscape plan (with the marked up completed area). We kindly request you provide approval for the release of the final bonding (15%) based on the plans that were discussed and the attached. MidFirst will come back with their construction drawings for the remaining landscaping as it will be installed during their construction (therefore, we feel any bonding for their future improvements should be required during their permitting/construction). Upon your receipt and review of this plan, please provide clarification of the Town's acceptance of the modified landscape plan sheet (attached) for Johnathan's use in releasing the bond. Thank you for your assistance and please call if I can provide any additional information. Tb.Mk you eh'ane Stephens Evergreen Devco, Inc. cc: Johnathan Lew (with attachment) ,.
